How can Neilsen Media Research even think that they are the only entity allowed to own such a list and I assume dictate who else can either display it or use it? Anyone can browse the various websites these TV networks have, and come up with a list of their own.

Websites like TV.com for example, list TV shows, are they going to get sued for being able to list the stations based on geography?

I think the Neilsen Media Research is overreaching themselves and certainly, when push comes to shove, if this ever went to court, they would lose. A short while ago, there was an article about "Apple Rejects iPhone App As Competitive To iTunes.

I replied with the following thread: SDK Agreement, anyone read it?.

That thread has extracts of the SDK and GTM agreements and after you read it, you will see how Apple is able to take it upon themselves to patent something which "isn't" supposed to be their product.

So, unless Intellisync had an agreement that this was their product, etc... with Apple, then, they left themselves open for a take over.

Worse is that the agreements which Apple provides you with you 1) download the SDK and 2) use their Go-to-Market program to sell in their stores, are pretty clear.

But Apple has a sneaky way of delivering this information.

When you download the SDK, you don't get to see the GTM agreement clauses.

As far as I'm concerned, when you download the SDK for the iPhone, you should also be provided with the agreement for the "Go-To-Market" program. But this is how Apple gets to take advantage of people who don't read the fine lines and don't do their homework on the legal side.

Whatever equipment they send, have a missile or something that can impact or dig into the soil, be launched from space directly onto Mars soil. The resulting hole that would be from could receive the visit from a drone, who could take samples and make various analyses. After all, the surface soil samples they've been doing, it's all nice and dandy, but the real story, I believe should be what's underneath it all.

That way, they get data from the air and they get a sample of what Mars is made of down below. We may end up finding more resources available to help with towards a real man space exploration, as there may be resources awaiting to be utilized.

Depending on cost, etc.., they may even be able to have key locations targetted for drilling and just have a drone in each location dropped.

Gives a better perspective, might see some variations in what is found, depending on location..

But paying for a game, and having the amount of times I can re-installed it controlled is not good, and forcing the CD in the game at all times, without being able to even make a legitimate backup isn't good either.

I will never buy games like that. This DRM is causing pirating in the first place, that and the high cost of the games.

Because I loved the Doom franchise, I didn't mind forking out the 70$ back then, when it came out. Same for Wolfenstein, although as I recall, I only paid about 45$ for the game.

But in the end, when a game is more than 30$ for PC, Unless it's got a killer review and I mean a KILLER review, I will more than likely not going to buy it and no matter how cheap the game is in price, if I have to suffer that level of DRM, such as limited amount of installs and having the CD in at all times, I'm keeping my money and spending it on console games like the Wii.

Anyways, that's how I see it.

  20. Re:SDK Agreement, anyone read it? on Apple Rejects iPhone App As Competitive To iTunes · · Score: 1

You know, the thing that really sucks is that, at first, to develop the application, you need the SDK and that's pretty much all the info you get is at the download level.

But, the other agreement, is when you submit your app.

One would think that Apple would offer all of this information under one roof.

But no, it's a nice ploy, most developers don't think about it and/or look for this info first hand and this is how you get a lot of honest developers, working on projects, ending in futility, when Apple pulls a quick one on them.

So, in this respect, Apple is a bit.."ahem" sneaky and maybe even a bit.. "cough cough" dishonest in their method.

The right thing to do, is to put all of this info upfront.

Then, those who are willing to risk it, know what they are getting into.

  21. Re:I don't know if I fully agree with that on Fire Your IT Boss · · Score: 2, Insightful

Unfortunately, I do agree, in principal, IT Managers that don't have the know-how to do it themselves, should not manage IT based projects..

The big issue with managing IT based projects is that, if the manager doesn't know enough of the technologies behind a project he/she is managing, then this manager has no real control over timelines, efforts and cost, because in order to know if the estimates are correct, he's got to rely on what he's being told, not what he understands.

That's why I don't undertake contracts to subcontract to others, unless, if something happens, I'm not able to step in and do it myself.

Now, the reality is, managers who know what they are managing at the IT level, are a rare breed.

And while it's true that managers are there to manage people, well they are also there to manage the project and an IT project is more than likely based on one or several frameworks and, hate to say it, one or several types of technologies, from scripting/coding platform to databases, etc.. If the manager isn't proficient in these disciplines and technologies, how can he accurately manage the project to success and/or within budget in the first place? The only way that's happening, is if he's lucky and got a great and "honest" team to work with. But then, what if "stuff" happens? How can this manager truly know what's the deal from the fake? That puts a project in jeopardy. Now, maybe, for these "non-IT" managers, they have a special tool to help them, did I hear that there are Ouija Boards out there that can help with that? Is that the secret for these managers?

    :)

    1. Relationship With Apple Inc. ("Apple"). You understand and agree by becoming a Registered iPhone Developer, no legal partnership or agency relationship is created between you and Apple. Neither you nor Apple is a partner, an agent or has any authority to bind the other. You agree not to represent otherwise. You also certify that you are of the legal age of majority in the jurisdiction in which you reside (at least 18 years of age in many countries) and you represent that you are legally permitted to become a Registered iPhone Developer. This Agreement is void where prohibited by law, and the right to become a Registered iPhone Developer is not granted in such jurisdictions.

    9. Apple Independent Development. Nothing in this Agreement will impair Apple's right to develop, acquire, license, market, promote or distribute products, software or technologies that perform the same or similar functions as, or otherwise compete with any other products, software or technologies that you may develop, produce, market, or distribute. In the absence of a separate written agreement to the contrary, Apple will be free to use any information, suggestions or recommendations you provide to Apple for any purpose, subject to any applicable patents or copyrights.

    iPhone App Submission Agreement

    1. iPhone GTM Programs. The web applications you submit will be considered for inclusion in Apple's iPhone product pages, ADC web pages, Apple eNews programs and other related Apple developer and marketing web pages and programs (collectively "iPhone GTM Programs"). You understand and agree that Apple has complete discretion over whether to include your web applications in any iPhone GTM Program. You also understand and agree that Apple reserves the right, at its complete discretion and without prior notice to you, to remove your web applications from any and/or all iPhone GTM Programs. Should Apple decide to include your web application in one or more iPhone GTM Programs, you agree that Apple shall have the right, and you hereby grant Apple a worldwide, royalty-free, non-exclusive right and license, to use, reproduce, publicly display, reference, link to, and distribute in connection with such iPhone GTM Programs, your web application URL and all related information and materials (including without limitation images, trademarks, and logos) you provide with your submission to Apple (collectively, the "Submitted Materials").

    End Result

Apple covered themselves very well on this topic and basically, if you are going to develop an app for the iPhone, you should be well aware of the risks and they are fairly, clearly stated.
