    I think the race is close, but the percentages are probably fixed. In short, Obama will likely win because certain groups would never not vote for him. Most women, the huge majority of blacks, Hispanics (other than Cubans) and union voters will simply vote for him because they won't vote for a Republican. The Republicans have their own base that will not budge either. There are independents, but they have probably already decided too, or are staying home.

    I love the huge major flaw in our election system.

    It is possible to get higher percentages, but you need a team so charismatic that voters just love them (that's not Mitt Romney) or a screw up so extreme that Democrats become disgusted with Obama (unlikely if he doesn't do anything off-script).

    Obama doesn't need to screw up. A lot of people have been saying that the perceived status of the economy will be what determines if he wins. If people who are underemployed or unemployed don't feel that their situation has improved or it has actually worsened in the past four years they're going to be less likely to vote for Obama. Obama's team knows this and that's why you keep seeing fearmongering style ads and speech's by Obama by saying (paraphrased) "Bush got us into this mess. Romney wants to keep the same policies Bush had."

    Fascism is an utterly pointless word that has been completely devoid of any real meaning since the ending of World War II.

    Soviets called Chinese Marxists fascists. Chinese Marxists called Soviets fascists. Far-right and far-left have both been, accurately, called fascist. Fascism doesn't sit on the traditional spectrums and those that try to mangle it into the left-right spectrum are often trying to do so to use fascist as a pejorative in order to make a very well concealed strawman argument.

    You could also take Mussolini's words as well...

    "Fascism, sitting on the right, could also have sat on the mountain of the center ... These words in any case do not have a fixed and unchanged meaning: they do have a variable subject to location, time and spirit. We don't give a damn about these empty terminologies and we despise those who are terrorized by these words."

    HIPAA only matters if the app is storing PHI and it is being used by a covered entity. So apps targets at patients won't run afoul of HIPAA. They can keep every bit of PHI that you put into them and not have to run any special protections. It also means that if such an app were on the iPhone there's no legal issue if this data is backed up on the iCloud. Apple would not have to suddenly meet new data storage requirements to meet HIPAA standards.

    Lawyers aren't covered entities either so if your personal injury attorney leaks your PHI they don't run afoul of HIPAA.

    My gut feeling on the situation is that they're trying to get rid of the digital evidence which is probably more or less scanned copies of the hundreds of boxes of evidence along with getting the case dropped without prejudice so perhaps lure the doctor back into the US or an extradition country so they could reopen the case and get him arrested for trial.

    That's essentially what happened.

    Panama will not extradite its citizens so there's no way the US will get him as long as he stays in Panama or only visits non-extradition countries. So the evidence, both digital and physical is just sitting there wasting space when it's unlikely that the case will go forward. So the case was dismissed and they get to dispose of all the evidence. The other thing to note is that the case was dismissed with prejudice so it cannot be reopened. The reality was that the only purpose to keeping the case open was to keep the doctor bottled up in Panama.

    The case itself was a company setup to basically gives prescriptions to anyone who asked for them without consulting or even visiting the doctor and there's plenty of specific evidence regarding this doctor never meeting people that he gave prescriptions to.

    One can consume doses of alcohol that do not impart the debilitating effects that lead to the accidents that kill people. The dosage bar for most drugs is significantly lower and virtually impossible to enjoy the drug without the debilitating effects taking hold. In fact, the debilitating effects are often the point of the drug.

    A spreadsheet is a horrible idea. It does not scale well and only is effective if you have a single point of control.

    My company uses spreadsheets to track the usage across 6 physical sites with 3 points of contact. There's essentially three sheets that are kept and must be periodically synced to verify data is identical. It's not reliable. I've seen one issue already where the number of days an employee had were off between the central point and the person who records for the site.

    I've found this is less of a problem with personal contacts than with work contacts.

    I do not have a data or texting plan on my phone. I've told my friends this and they do not text my phone. I've told people at work that I do not have a text plan and to not text me. They ignore it. Ergo, I've gone and had texting on my phone blocked by the provider to avoid the texts.
