I know this because this happened to me in middle school when I made a website saying crazy stuff about some teachers. The police showed up one day and pulled me out of class. Luckily no teachers wanted to press any charges and I suffered a 3 day out of school suspension. While everything I did never took place in school, the school disciplined me on my actions. I saw this as complete B.S., but at the same time, I would rather have the suspension than get sued outside of school by a teacher if they had lost their job because of something I said.

You should read the franchise agreements between your county and the broadband providers in your area. These franchise agreements are required to be public by law and contain information on everything that company is required to do, including situations like this. In my county, if a house isn't covered, the ISP is required to implement the hardware necessary to get that house online within 6 months of that household's request for service. In other words, our town declared that the only way that ISP can operate here is if everyone can use their service.

Comcast claims that they need to throttle speeds in order to keep traffic from being clogged. The problem here, which I see in my current provider (Mediacom, a sister company of Comcast), is that the ISP puts too many houses on one fiber node. I know that the Franchise Agreement with my city says that no more than an average of 500 homes per fiber node are allowed.
The ISP's...
1. Put too many homes on a fiber node.
2. Sell old ladies 8Mbps connections at the higher price knowing they will only check email and look up cooking recipes once a week.
3. Don't update to DOCSIS 3.0 because it they don't want to spend some money...even though their customers would benefit greatly from it.
4. Throttle the connections of the people that actually use the bandwidth they pay for.
If the ISP sells their customer a certain speed, they should have the capacity to serve every customer at that max speed. This is a "worst case" scenario, but more people than expected use the bandwidth they are paying for, and the ISP can't handle it because they are trying to get away with saving money by giving you part of what you paid for.
I have service with one of Comcast's sister companies and I notice the throttling. They also don't give their customers the speeds advertised. It is B.S. and monopolies like Comcast will continue to thrive and give their customers crap service.
