my point is, like the other responder to my post, you are arguing a fallacy of exclusion. in order for your argument to make any sense, the premise "as a bittorrent user" must be removed.

let me restate the OP's point for those of you who didn't get it (those of you who intentionally misunderstood it in order to allow yourselves to babble are beyond help).
using most (if not all) bittorrent clients, you cannot choose to not upload. you are forced into distributing these files as you are downloading them. now here's the important point: just because i'm downloading a file that is copyrighted does NOT mean i'm breaking the law. if i am downloading a divx version of a movie that i own on dvd (or any other medium) i'm obeying the law. if i am being forced to upload to someone who does not have any legal rights to the material, i am forced into breaking the law. if the software i am using allows me to elect not to upload to users, thus protecting me from potentially uploading to someone without legal rights to the material and thus breaking the law, that would allow me to be MORE SELECTIVE about my involvement in the distribution of the file.
so no, as a bittorrent user, you cannot be VERY selective about your involvement in the distribution of the file(s).
there is actually a third, more sinister, problem at play here. namely, the fact that the vast majority of the workforce are overpaid morons who are just barely qualified to be mexican migrant workers.

musicians and music engineers have come up with an easy way to avoid this confusion. tracks that are recorded with the sound level high are said to be "hot", sound levels that are so high as to induce massive clipping are usually referred to as "damn that's way too hot, lookit it's clipping there man turn that crap down"
but anyway, we usually refer to the "hotness" of a recording when we are talking about this stuff as "loud" is normally a reference strictly to volume.
i don't work for free unless i can realize a direct benefit from it (ie. not drawing a salary off a start-up you own, putting in a little extra at a startup someone else owns if you have a reasonable belief you will benefit later)
anyone who asks you to do so is a cheap bastard who will not appreciate anything you do and deserves to have you wait until they need you the most then quit with no notice. better yet, wait until everything goes down, go to lunch and never come back, throwing your cell/pda/blackberry/etc. in the garbage on yer way to lunch

that having been said, if you read the site (not the article) it appears he may not have tried to collect upon previous monies owed. it looks like he merely told them he would need payment for the future as he could not offset the costs out of his own pocket, using the $300k as an example of the kinds of costs he was talking about. the department refused to pay, thus he had to shut the site down. to which the department responded by arresting him, a gross misuse of the power and trust placed in their hands.
this having all been said i conditionally hope for the following: 1) if he really did ask for $300k in back payment, he needs some time in a small grey cell to think it over.
or
2) if he didn't, and merely asked for payment in the future to offset the costs of running the site. the sherrif and/or whomever made the decision to have him arrested, and possibly the officers who arrested him, should be dismissed and be brought up on charges of wrongful arrest and whatever else they can tack onto 'em.
