    Sony would fight this in court as something that fell under a contract not as Copyright infringment. That is what I'm getting at. Which would then modify what the penalties would / could possibly be. If it's found to be a true Copyright infringement that is equivalent to that of an individual person pirating digital media, then the same laws should apply. I believe that Sony will use their full legal force to argue the case as a contractual issue not a copyright issue.

    There are sevearl things to consider.
    1. There was a contract in place and we are not privy to such details at this time
    2. Contractual lawsuits are different than those that are out-right theft
    3. While USA has a lot of influence in the world and court systems, it is likely that no precedents set here will have much affect in Mexico.
    4. Individuals pirating music or movies who clearly don't own a CD or DVD should be treated differently in court.
    5. Another key thing to consider is that Sony's lawyers aren't stupid, they set up shop in Mexico, and they would clearly know what was within their rights banking on the Profit vs Loss if they did infact infringe on the "Contractual agreement". They will force an arguement that it was not piracy but a contractual loophole.
    6. And if Sony is clearly in the wrong, then they get what they deserve, but if not, that artist is in for one hell of a counter-suit.

    To me this makes sense that Google patent their page because their home page is their Company Logo basically. As we have more and more companies that only reach people via the web this makes sense, to a degree. I cannot disagree with their actions, however, if the patent is defined loosely so as to prevent others from simplistic home pages, then the patent system is even more flawed than ever. /popcorn

    I used to believe that this country would pride itself on being at the bleeding edge of technology, but now I hear more and more about how other countries have provided for their citizen in the area of technology far better than we do here in the USA. In many other countries, you don't get dropped cell phone calls. In many other countries (yes smaller) they provide wireless everywhere. Heck we can't even get digital or basic cable to some rural areas of this country.

    Simply, because this country is all about profit. What's the least amount of goods and services we can provide and charge the highest amount for? We are charged large fees for telephone / cellphone / text / internet services. Cable providers are outrageous too. Where we should flourish in modern technology, we have become stagnant.

    I don't know how I feel about this.

    On one hand, if someone has paid their debt in full to society, then the goal is for them to be able to get a fresh chance to start over, and I tend to want to believe that people can be reformed to become productive members of society.

    Yet, all too often, we hear about repeat offenders who seem to easily be able to hide their dubious past leaving law abiding citizens in danger of being a victim of repeat offenses.

    Our system of justice does state, INNOCENT UNTIL PROVEN GUILTY, therefore while I personnally don't know where I stand on this discussion, I think our legal system will combat this tooth and nail.

    Shouldn't it only be the exact same sound? Otherwise any hunter out in the wood, who is duck hunting will owe this company money. I cannot fathom that this one would be acceptable. If one person makes a duck sound that is drawn out versus another that makes it sound short, how can you patent one generic duck call for all of those variations. I would say that NBC has their chimes and they've made that a distinctive trade mark and I'm not sure how elaborate that trademark would be. The Aflac sound is distinctly saying Aflac. But a duck call is too generic imho.

    .... now many of us will likely replace our current PC with a new one. Well I would suggest that you move all of your personal data to a different PC. Then use one as a gaming PC, and use the other as a personal pc. It's a tad more expensive, but then the gaming companies have nothing to target their ads to. You won't have browsing history, you won't have personal data available to them and so all they will do is advertise to you the products you already play. That's where I think targeted ads are almos stupid, they tend to try to target ads at you for places that you shop at already so it's more of a waste of money. Give them less info, then thier ability to target ads to you is even more limited.

    At least that's my take on it. I'm probably wrong though.

    Unfortunately, this is not how I wanted the comment to come across. I was thinking along the lines of how many crimes had been committed in even one single act of sending fraudulent mail to a banking institution throught the US mail via the fake mailing. Since I'm not really sure of all of the various laws that may have been broken I was more curious than anything else. I'm guessing that one act alone would be breaking at least (and this is a guess) 5 federal laws, not to mention how many local laws would fall on-top of that.

    Wait, they fake where the CD's were coming from? Wouldn't that constitute as Mail Fraud? And isn't that a Federal offense? Hmmm, it reminds me of the movie "the Firm". Sending a CD with Malware may not be illegal, but faking the source might be. I'm not sure of the law here, but I would think this would draw greater attention to federal authorities.

    I do have a cause though. It is obscenity. I'm for it. Unfortunately the civil liberties types who are fighting this issue have to fight it owing to the nature of the laws as a matter of freedom of speech and stifling of free expression and so on but we know what's really involved: dirty books are fun. That's all there is to it. But you can't get up in a court and say that I suppose. It's simply a matter of freedom of pleasure, a right which is not guaranteed by the Constitution unfortunately. Anyway, since people seem to be marching for their causes these days I have here a march for mine. It's called...

    True the Adults versus child differnces make complete sense in your response, but parents need to then make the decisions for their children. If they are concerned whether the science is true, ultimately it comes down to parents taking control of what their children are exposed to. And thus back to my initial arguement, if we let ourselves use stuff that may or may not be bad for us, we are in that essence self-experimenting.

    Maybe my arguement would have been better addressed to the parents of this world, take control of what your children do, and if you allow them the unlimited freedoms, don't blame anyone else for these actions if the results are less than favorable. And if your children are sneaky and devious, make them responsible for their actions.

    I'm not against self experimentation, really, it's that type of attitude that has allowed scientist to test and further discover stuff.

    Guess this is really something for a good debate over a cup of coffee. Hee

    Look, why don't we just let people be to what they want to be exposed to. Why would we want clothes to emit something that counteracts something else. Keep clothes pure.

    Honestly, why must we keep inventing ways of counteracting what we know exists rather than just fix what exists first?

    I'm not trying to troll here, but it seems that we are all for self experimentation.

    For example, We have knows cigarettes are a big cause for cancer since the mid 70's or 80's yet we (humans) keep smoking that crap.

    We've known for well over a decade that cell phones emit some harmful radiation. We keep buying them, and we haven't demanded that the industry fix itself.

    We keep letting ourselves get duped into thinking all is ok. We are as much to blame for what we consume as those that sell us those consumer products.

    One of the best benefits was that people could correct the entries of information, but when good / correct information is modified with someone elses agenda, it can be come exhausting having to clean up a mess of bad infomation to spin things a specific way.

    I can see why colleges will not allow users to utilize Wikipedia as a valid reference. While there is often very useful and helpful information, it's not reliable that the information will be static from one hour to the next.

    I think that more people would be willing to help keep it updated if it wasn't so easily corruptable.

    I have a great puzzle game called Think Cross that's simple and fun. It's a decently done application, fits on a 3.5" floppy, yes I still have those and the machines, and I just enjoy the game.
