    Amendment V
No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.

Honest question. It seems that searches are allowed so long as their is reasonable cause, and a Warrant. And holding someone for offenses in case of conflict is allowed as well. How does that Patriot Act differ? I can't find a decent comparison between precedent based on Amend IV + V and Patriot Act. Unfortunately, much of the analysis seems to contain hyperbole without fact.

  12. Re:tech unions? on AFL-CIO Proposed Reforms for the H1B Program · · Score: 2
Not all union situations end up badly or are all unions completely corrupt, but there is evidence that many union members get screwed regularly by union management. The net effect may not be positive for union members. Unions may suggest what appear to be sound solutions to IT workers concerns, but execution is another story. Plus there is the fact that you don't make 100% of your own decisions anymore. Many decisions are made by union bosses and your peers as a group. The mob mentality can be a whole different dynamic.

Additionally, unions have helped destroy entire industries and drive those jobs overseas by not being flexible with work productivity rules. Steel comes to mind. Another example, a union crew at Southwest Airlines turns around 10 planes in a day compared to a union crew at USAirways that turns around 3. No wonder why USAirways is in Bankruptcy.

Some unions have squandered member pensions or other money through corruption, which occurs too frequently for organizations that tend to demonize everyone not on their side. Textbook Examples:

If the tech industry goes heavy union, then many jobs may go overseas. This is because unions come with too many headaches. Unions are using the visa issue only to gain members and power by preying on people's fears.

    You write:

"For $1000 I can get a $200 Walmart PC that will run circles around an imac performance wise"

Where do I start? Does that $200 PC come with iDVD? That piece of software alone is extremely important to the performance of my computer. It is the best free DVD software package I have seen, and reviews back up this assertion.. I can get a quality DVD setup faster because of the better user interface in iDVD than other software. To me this is an important part of the "performance" equation iDVD is free with Superdrive Macs). Same goes for iMovie (Free), which is arguably the best consumer editing software out there. Again, I get work done fast, and produce the quality that I want. Another nice feature is that OS X is UNIX based - nice feature for travel with my laptop (yes I could load Linux, but why go through the extra trouble when it is all in one neat package). The development software (free) is really cool too.

Performance is not just chip speed, but software quality and other features. Also for certain tasks like Video, Apple supplies some of the best software there is (Final Cut Pro), and it won't run on a Wal Mart PC.

  15. Those old movies on Computers Not Working In Education · · Score: 2
"In fact, Thomas Edison himself was a big proponent of the use of movies in schools"

Yes, I remember being in school in the late 70's and 80's watching those woefully outdated propaganda films from the 1950's. They are the same movies that the Simpson's make fun of. My favorites were the movies that showed the use of the Civil Defense barrels stockpiled in the basement.

Computers are meaningless if you cannot read well, or are at least proficient in Algebra (I had to seriously brush up on my own because the public schools I went to did not emphasize math). For all those that say Math is useless (I used to be one), or I'll never use this stuff - they are dead wrong. Higher paying jobs do involve a solid understanding of numbers. If you lose 50% you need a 100% gain to break even.

I wonder how many schools that rely on computers even have programming classes. Plus, the computers may be sucking money away from budgets to get more updated text books.

Nevertheless, just trying to learn and understand math/numbers helps develop the mind.

I have Comcast digital cable. I tried to order a movie last night, but it would not order. I called and got the "we will send a tech out in a week" crap. I asked the rep why I should pay $80 a month for digital cable when the movie ordering system never works. Well the woman on the other end of the line said I don't pay for the movie unless I order it. I had to explain to her that I do pay for digital cable so I have the ability to order a movie when I want.

Needless to say the attitude of many companies these days is all wrong. Making you view popup ads. Trying to blame product shortcomings on the consumer etc. Well, I am cancelling my Digital cable, and I will not visit sites with obnoxious popup strategies.
