"But don't miss the fact that only 1 out of the 4 finalists was a cheater"

Oh, I don't miss it, I just wouldn't use the adjective "only." It suggests that at least 1/4 of the players in your game were cheaters, potentially as many as 100%-3. It also suggests that your security was so slipshod that you allowed a cheater to get so far as the finals, knocking out unknowable numbers of honest players in the process (potentially one that was better than the other three you had present). It sounds like this guy would have won if he simply had the foresight to sneak in a USB key drive. In fact, are you sure one of the other three didn't do just that?

I wouldn't be touting this as an accomplishment, rather this is a failure. This isn't a story of "Cheaters never win," but only "Don't get caught."

They're attempting to use the courts to protect their perceived property rights. Only the most rabid anarcho-capitalist would be against that. Capitalism is all about private enterprise, but that's difficult to do until private ownership is established.

"Lastly, trying to establish property rights or ownership in regards to radio spectrum is a bit absurd. How do you own energy emissions?"

As I said, through the ability to deny it. Simple jamming would give them control over when a frequency can and cannot be used, and one would need to seek their permission and ask them to stop jamming in order to use that frequency inside their zone of influence. Sounds like de facto ownership to me.

"Note that the U.S. government, on the other hand, does not try this, but licenses it -- i.e. taxes it as if its a publicly owned good, which makes the most sense."

"Publicly owned" is a dirty word around here.

Certainly not far-fetched: that's about 3 minutes for 10 million people, erasing spam, updating filters, installing firewalls, reinstalling the operating system, and that's before we get into the felonies he's charged with, such as wire fraud. And what about the hours worked by his victims to pay for the new security software they need?

He's easily caused 65 man-years of life to be wasted cleaning up problems he deliberately caused in an effort to profit off of it. What rational reason is there that he himself should not be subjected to the same loss of his finite time on this planet?

It is no mistake that this is coming out of autonomous territories where federal laws appropriating radio frequencies for specific uses have little or questionable jurisdiction. Whether or not you personally believe they are entitled to, these groups are perfectly capable of jamming radio transmissions used by others crossing over their sovereign territory, so they do have de facto control over them (by virtue of being able to disallow them). They own the territory and have the potential to fulfill this anarcho-capitalist's wet dream of a land where there are no governmental controls over frequency allotment.

Considering the flavor of politics around here, I'm surprised I'm not seeing more posts in support of these First Nations' actions.

The problem with asking Slashdotters about this is that the vast majority (at least 79% according to that poll) are the hardcare gamers that everybody (including/especially Nintendo) acknowledges Sony and Microsoft as gearing their products toward. Even today, there are more than a few modded-up posts in this discussion thread about people who continue to discount the Wii for its graphics and its "mini games," in spite of the fact that the Wii continues to sell as well as, if not better than, it did during its launch.

You'd likely have better luck getting Slashdotters to discuss the popularity of Windows without cynicism. You can't expect accurate predictions about the mainstream from the people that are furthest from it.
