One downloader or sharer committing copyright infringement will probably not gain a response, but serveral en masse would.. therefore, IANAL but I would say that downloading would in fact qualify as civil resistance... The price of freedom is eternal vigilance, and the more useful (i.e. powerful) a technology is the closer it must be watched lest we become the servants and the technology the master.

It seems to me that people *need* a certain amount of flexibility in the law.. Something this rigid is bound to fail...it simply goes too far against human nature.
The consitution is, in effect, the DMCA for the law itself!
So in effect... this is a true battle of corporate law vs. political law.
Will the RIAA be allowed to circumvent the law of the people in order to persecute a person based on a law of the people (established by and benefitting corporations).
This is more "contemporary political reality" raising it's ugly head.
The vast majority of Americans fall between the two extremes by which you classify 300 million people. Most Americans are like every other *person* in the world.. thinking feeling and just trying to get through life happy.
When you stereotype Americans you are as bad as Americans who stereotype muslims, blacks, or any other grouping of people.
Let's all be part of the solution rather than part of the problem!
The more tracking information we allow to be used, the technological conveniences we embrace, the greater the need to keep watch to make sure they are not abused. Technology is a good thing, but like fire, it must be carefully watched.
If we turn lazy and complacent, the price will be our own freedom.
No one is saying that open source is the only solution, just a step in the solution. The "solution" as a whole (hardware to software or vice versa) must be created openly for all to scrutinize and help provide a solution for...
