    The United States lives in clueless blissful ignorance of things such as this. We don't care either-all we want are things to be 'taken care of for us'. Bill Maher said something on Larry King last night that really hit home. He stated that the average American is completely clueless-but does know when their leaders aren't leading (as Obama has been doing the past few months-he reminds me more of a college professor then our President).

    If a human being had done this, we'd be charged with the felony crime of breaking and entering-BUT after all Bank of America isn't a human, are they? Personally, I think that when stuff like this is done they should arrest the President of the corporation, process him and then throw him in a cell with the derelicts (make sure you do it on a long holiday weekend so he suffers for a few days).

    You might think that this is off topic, but it really isn't. Corporations have WAY TOO MUCH POWER-mainly because they have been able to BRIBE our corrupt government into letting them have it!

    I can clearly hear the artifacts on every 128 kbps MP3. Try encoding "Baba O'Riley" on Who's next and listen when Daltrey sings: "Don't Cry...it's only teenage wasteland" At 128 kbps, the artifacts are SO bad that it sounds like his mouth is fillled with marbles! 160 kbps is quite a bit better, as is 192 and the artifact is gone at 256 kbps encoding. Generally speaking, 256 kbps is the MINIMUM that I use with MP3. 320 kbps is even better...and more and more of my library is FLAC and WAV. Another thing is that many MP3 streamers use extreme audio processing (compression, limiting, etc) and the encoder is designed to run with unprocesssed music. This causes even more encoding errors. Generally speaking OGG and AAC+ are the best (standard AAC at bit rates over 96 kbps). 64 kbps AAC+, 96/128 kbps Ogg and 160 kbps MP3 are roughly the same quality wise....at least to my (educated) ears. We should also be discussing something else-the 'dumbing down' of our hearing from all this perceptual coded stuff....

    If he's a public figure (and I believe he'd be hard pressed to claim he isn't) then any comments are protected by the First Amendment. Slander and libel don't apply-unless they are lying about him or his family's personal life.

    So, pound sand, bucko! YOU were the one that wanted to be the big police cheese, and this is a fringe benefit that comes with the job!

    The scary thing is that with the "Keystone Cops" mentality out there-along with the fact that these jokers actually carry GUNS-innocent prople are getting killed every day. As an example, a couple years ago 3 LAPD officers pumped something like 36 shots into a car-killing its occupant. Her crime? Falling asleep in her own driveway with a cell phone on her lap! The "Keystone" LAPD cops startled her trying to wake her up-and one-believing that her cell phone was a gun (after all, cell phones DO look like guns, don't they?), began firing. Without thinking (after all, why THINK?) the other two started firing into the car. One officer after emptying his 15 shot clip, reloaded and continued to fire! Over a dozen shots hit her, killing her instantly-all this in plain site of her family (her father called the LAPD to help get her out of the car).

    This 'fire, ready, aim' mentality, unfortunately permeates many police departments-and its gotten much worse since 9/11. I lived in a small town of 8000 that had its own 18 member police department. Every cop there had the attitude: "I put my life on the line for you every day" even though there had NEVER been an officer that died in the line of duty there EVER! Yet, in recent history they had shot a car driver (fortunately not fatally) for the crime of changing a flat tire. Turns out they punched the wrong license plate number into their newfangled crusier computer (bought with a Homeland Security grant-along with an SUV with a telescoping night sight), and got a 'hit' that it was a stolen car. Of course they never bothered to notice that the car on their screen was a completely different make, model and color then the one with the flat tire. Instead, with their adrenaline 'rush' fully formed, they jumped out of the car pulled their guns, and then the guy stood up and reached into his jacket pocket to get his wallet, shot him.

    Are these isolated incidents? Hardly. Thank god that cooler heads prevailed in this incident-or there could have been a very real possibility of someone getting hurt.

    SCOTUS ruled in the Xerox case that copiers were 100% LEGAL because while they COULD be used for copyright infringement purposes, they also had 'substantial non infringing uses'. Thus, their use was 100% LEGAL. Why is this case not used in the case of TPB? YES they can be used to facilitate copyright infringement-but there are also a BUNCH on non-infringing uses for them as well. Following the current logic, guns should be illegal in Los Angeles, because they mostly are used for illegal purposes there (ie: murder, drive bys and robberies).

    If these numbers turn out to be accurate, it shows rampant abuse of the DMCA-just like many of us predicted. It shows that over half the takedown notices are done for anti-competitive reasons and almost 40% of them are inaccurate and/or fradulent.

    My fear is that-that any law that is put forth to replace (fix?) the DMCA's problems might well more Draconian then the DMCA itself. It's as if the bad known is better then the possibly worse unknown

    What this means is that his 400 user ISP only has the capacity for less than SIX users to be running full tilt at a time! To me that's a bit extreme. I can see 5:1 or even 10:1 but 70:1??!!
