Teledesic, the company partially owned by Bill Gates that plans to create a giant network of communications satellites, is reported looking at using converted Russian ICBMs to launch some of its satellites.

You can sue a doctor for malpractice, since he/she is licensed, you could sue a nurse, since he/she is licensed...i.e. they are licensed to provide a certain level of quality caregiving...Hell you could sue a lawyer, a CPA...but sorry, Programmers are off limits
You cannot, I repeat cannot sue a programmer/company for insecure software, maybe you should just change vendor's if you are unhappy with your product, its the Capitalist way.

I don't know how programming shortcomings are related to business ethics.
IMHO, these are two different things, shoddy programming and trying to monopolize the market, are punishable, or are they?
Both require some action, yet can a common punishment fix the two? By splitting M$ up, will IIS suddenly be security hole free? I think not.
