It is policy that dictates usage for personal communications and that varies by branch and office.
What you do have are laws preventing the use of federal systems for purely political uses. This is what was the problem with the mailing system a year or so ago. People were given blackberries and other systems for political and party related messages and because of government requirements not given those same types of tools for government business. People being people and since they had those tools available to them tended to use them for all types of messages.
The other big problem was that law there was no penalty for not recording the email for the national archive but there are penalties for using government systems for political reasons.

The position of the Vice President is that only work ordered by the President are covered those done as being a leader of the Legislative Branch are not. Also the group bring the suit are tryng to get access purely political conversations which the national archives have already ruled are not to be archived.
If all you haters really want to look at something slimy how about the case was made that the NSA was "not an agency of the government" so keeping communications by the national archives was not required.

Look at Windows 2008, you had the first RC out 6 months before product release then a second RC 3 months before release and they both had major bugs and RC0 was missing features that showed up in RC1 and release.
Which also brings up the questions what exactly a pre-Release Candidate is.

In Microsoft speak a RC is a feature complete product, parts are still buggy but the capabilities are in, they still reservice the right to add features but will not remove them.
Now that is not to say that things still will not change for instance with the release of parts of Office 2007 some products would work in the RC phase on Windows 2000 but come release they stopped working. However at that phase you can usally start developing for the new product and it will work on the release with at most minor changes.

The missile defense system is not a factor with this, it is on the back burner and Russia problem is not the system but that we are housing it in Czech Republic and Poland. They have said they would have no problem it the US housed in Russia and have provided locations they would be willing to lease for a cheap price.
The problem is NATO and allowing Ukraine and Georgia to join. President Bush is pushing to get them quickly accepted but France is fighting it, some some minor acceptance of this from other European countries. B.O. will be in a hard place of either repairing US ties with Europe by stopping this push or ignoring Europe. Going through with the push from President Bush will causing a rift with Europe but strengthening the former Soviet countries and what they want to do; doing what Russia and France want us to do will heal the poor relationship the US has with Europe but tell all the former Soviet countries that the US does not care what happens to them, especially after the attack into Georgia. The main thing is that Russia does not want those countries to be part of NATO or to strength ties with the US and if anything what they can to stop it.
However at this time, and until B.O. is sworn in, nothing is going to be happening with either of those items so if this was an attack from Russia they have the worse timing around. The foolish writer of that article should of tied it in with the war games that Venezuela and Russia are having but that is Naval based so even less of a cause.
