Hello!? How do they know what patches you need if they can't look at your system and tell their servers what you've already got.
I don't understand your reasoning here... What would stop WU from simply downloading an XML list of all available updates? The applet could then compare this list to your computer's configuration, and act accordingly... There really is no reason that any data should have to be sent to MS.
The LotR fans and the Harry Potter fans seem to be on some sort of holy quest to rid the world of people that haven't "read the book" before seeing the movie.
I personally enjoyed watching FotR for the first time, having not read the book. I had no idea what was going to happen from scene to scene, and it really helped to draw me into the movie. This attitude that somehow seeing the movie without reading the book will rot your mind and ruin your life is just ridiculous.
Isn't there a limit to what you can claim as infringement? If they were making their own BIOS chips and calling them "Phoenix", I could understand. But AFAIK, Phoenix Technologies doesn't make web browsers. If I made a soft drink called "Phoenix", I somehow don't think it would bother them as much...
You can only trademark English words to a certain extent... otherwise people could trademark the word "computer" and start collecting on every use.
Open source isn't about everyone and their grandmother being entitled to having their personal patches stuck into the main Linux tree. Open source is about being able to edit the software for your own personal use, not inflicting your changes upon everyone else in the world, simply because you think that you're right.
