Think Secret is NOT an Apple fan - in fact they often report negatively - partner with the resellers that are suing Apple - and do so at the expense of Apple buyers (stealing press thunder, building up expectations too high, and litigation/cease and decist concerns)

  2. Shield Law/UTSA/Copyright/Trademark/Patent on Judge Finds For Apple in ThinkSecret Case · · Score: 4, Informative

I think you are referring to the shield law, but that applies to criminal and federal cases where the journalist can prove he may be at harm or be casued damaged if they reveal sources (even then - it doesn't apply to federal cases)

The law that does apply here is the UTSA - Uniform Trade Secrets Act - it specifically says you cannot report or disseminate information you know or can easily research and know is trade secret.

Really, copyright law applies here too - Think Secret was posting copyrighted/Patented information (that was not yet available at USPTO.GOV)

Your moderation proves who's the dumb one I think.

The most accepted theory is that they were aliens - this was also touched on by Spielberg in interviews AFTER the "controversy" popped up on the internet.

"People are too wrapped up with what the law says..."

Yes lawlessness has overwhelmed us ... statements such as this only prove it. A little money here and a little money here are equal to a little crime here, and a little crime there - they both add up over time.

People who feel they can break the law in one way - will start to desensitise themselves to any law.

In the case of P2P - I am for file sharing - but I am not for sites that run paid services illegally or sites like SuperNOva who's main content was illegal downloaded software, illegally obtained and filmed movies, and other questionable content.

This said, people who think all downloads of everything its ok to rob people of their property and property rights are the same people who agree with imminent domain. You have to. You feel that property should be shared and that private property is yours for the plundering.

So, those who are often worried about their 1st ammendment rights - should take a look at the 4th ammendment. Seizure of private property by governments is happening everywhere - my thoughts - your robbing from someone because they are wealthy mentality.

    "Opressed people throughout history..."

This is a good statement - but NO ONE is being opressed by not being able to listen to music in a certain way = digital download! Please don't compare our forefather's struggle death for civil rights to Napster - which acurately or not - is compared to Communism!

By the way - call people wealthy - not rich. Call people low income instead of poor. Poverty is a cliche - at least in the US.

  17. Anything for notariety on EFF Joins Fight Against Apple Lawsuit · · Score: 1

The EFF also supports websites like: www.itunesisbogus.com - so this is no surprise.

I hate it when comments like this are made without a clue as to the real reasons Apple is seeing this a necessary step:

As long as Think Secret is not bribing or blackmailing people there should be no problem.

Extend the list of offenses that you think Apple has merit in this case to: solicitation.

Think Secret - apart from ALL OTHER rumor sites - specifically solicits information through a phone number. Therefore, enticing people to call.

What many of you are confused about on the bribery part is ... one doesn't necessarily have to pay someone $$ to bribe them. Anonymous ego boosting notariety is also payment to some.

Think Secret was inarguably one of the most hits websites around MacWorld Expo. In fact - it even broke the top 25 according Netcraft on 2 days.

Do you not think the people that gave the information to Nick Ciarelli were proud? Do you not think some of them felt important? Do you not think some of them are reading boards like this right now - revelling in the fact that we are discussing the very information they dealt out illegally - making them feel even more important???

I have brought this point up sveral times as well - I'm not sure if Think Secret/Nick Ciarelli are entirely all good intentions. It has always bothered me that they seem to be the first one with breaking news about the reseller lawsuits. These suits are completely without merit and come from two of the WORST resellers to ever hock Apple products or services EVER! (There's plenty of proof online - such as http://www.omino.com/~dom/readme/tomsantos.html)

Think Secret is no different than an underage porn site. It is illegal to publish it, yet there are plenty who are curious to see it.

One person had this to say on my website:

"...Think Secret (in achieving a degree of accuracy that can only be a result of people breaking their NDAs) becomes analogous to the old Head Shops, that sold drug paraphernalia. Nothing they actually sold was, strictly speaking, illegal. But the only uses for most of their products WERE illegal. And so Head Shops were made illegal, too."

And as a note, can we stop using similie and metaphor here - these are NOT - trade secrets - they are business plans, they are actual schematics, they are property. Some of us are trying to take meaning out of the words trade secrets like it's just a few words. This actual documentation that people hold that is privately OWNED information important to a business's success vs it's competitors.

FROM THIS POINT ON - you can be assured that rumor sites will be getting VERY close looks from the competition. In fact, I would be amazed if Creative didn't have a special position at the company now to find out future iPod information so they can beat Apple to market.

I have noticed this myself.... most blogs are turning in to spamblogs.

Engadget (where slashdot gets a lot of its stories) is a great site, but the ad content has risen significantly over the past few months.

Blogs were originally meant to be diaries and driven by either pseudo journalism for fun or just a way to rant about topics the owner loved to talk about. In some cases, they were meant to be ways to keep in contact with friends.

The mainstream, embracing blogs, has prompted many of the "original bloggers" to become greedy and place ads all over their sites - whoring different products.

I have a blog for my website that is used mainly as a comments forum. It has been very useful for me to get into keyword searches.

I refuse to whore ads from companies to take advantage of some system where I don't merit the money. I advertise on the main site with advertisers that I have contacted and told them the benefit of our synergy.

Another reason I don't use Ads by Google or a shared banner type ad placement is because Google and "Click Ad Companies" don't police spyware and ad ware banners and websites. I don't want anyone reading my website or visiting my commerce site to be associated with any of that.

I also charge based on what the customer can pay to possibly garner future business and word of mouth. Someone in need with little cash - they usually are your best advertising.
