Mod the parent up. I started scanning the comments to see if anyone would call bullshit on this article or not. NTP is NOT a patent troll. There are many other cases of patent troll companies, but this is not one of them. Oddly enough, this is one case where the US patent system appears to have worked as intended.

yes, but like has been pointed out by another, your $0.99 purchase expires after the next episode has been released. It's not like a year later you can watch the episode again without paying another $0.99.

That was my poorly worded point.

  8. Re:iPOD comparison on CBS, NBC to Offer TV Shows for 99 Cents · · Score: 4, Informative

I misread your question. The cost difference is $1.00. Comcast is offering their product (with commercials) for $0.99 while Apple is offering their product (without commercials) for $1.99. Again, the Apple download can be viewed multiple times, whereas Comcast is essentially rebroadcasting for your viewing pleasure at a time more convenient for you. You are paying for the service of the rebroadcasting, not a downloadable product.

The res on the new ipod is roughly the same as that on a windows mobile device. At 320x240 you can actually display a pretty decent picture. The days of 128x128 are behind us now.

  17. Re:Once again, the lawyers win on Judge Approves Settlement in iPod Suit · · Score: 1

But in this case, the fees requested by the lawyers weren't even contested by Apple, and did not affect the terms of the settlement, other than inflating the bottom line when calculating how much Apple is expected to pay out. The $25 or $50 rebate for qualifying customers is not going to drop to $23.75 and $47.68 respectively because of lawyer fees. That is just plain FUD against lawyers.

I mean, c'mon - the lawyers win a case for you and you bitch because they charge fees for their service - fees that you don't pay, but that Apple has to pay?

How is this a fraudulent class action? If my ipod batter went south in an unreasonably short period of time, I'd be madder than hell too, and would participate in this LEGIT lawsuit. So the lawyers got paid - what you don't see is how much time and effort it took to settle this suit. It could have been 10 mins, but I doubt it. It could have been done by one guy, but I doubt that too. My guess is that it took a fair bit of time, research and negotiation to settle this suit, all of which costs money.

Next you'll be griping that doctors don't work for minimum wage.

Why is it so shocking that the lawyers get paid for services ALREADY RENDERED? Just because the terms of the settlement give consumers until Sept 30 does not mean that all funds payable need to sit in escrow until said date passes. That just doesn't make sense.

One more thing - the fees collected by the lawyers have ZERO IMPACT on the terms of the settlement for the consumer. Or in plain english, sure the lawyers get paid, but it's not coming out of your rebate so STFU and stop whining.

  20. Re:Works to a point on Google's Turn To Be The Villain · · Score: 1

This is precisely what I was not talking about. Sure, setting up shop in a regional hub makes sense - I wasn't arguing that. But you are still playing to a talent pool that is large enough to support your business needs. My point is that the concept can be taken too far. You may want to live 'close to home' but that doesn't mean it's alright to start your business in some remote location. If the local talent pool is too small for your needs, you WILL have to draw from abroad. This means people will have to move to your area to work for you, and should something happen and they no longer have a job with you, they can be screwed. Likewise, should they decide to leave your opportunity for another, you can be screwed.

  21. Works to a point on Google's Turn To Be The Villain · · Score: 3, Insightful

This strategy works to a point, but can be taken too far. For example: you set up shop in the middle of nowhere, Iowa. You find a few talented coders and begin work. When one of them leaves for whatever reason, you are left scrambling for replacement talent - you already tapped the local sources and now have to draw from abroad. But what coder is going to risk going to Iowa to work for you? Should the job opportunity fail, he's stuck in a place that has no hope of offering him comparable work.

I reccomend reading up on the aforementioned Michael Geist website, or googling for bill c-60 for more information. The whole point of this bill was to make Canada's copywrite laws more similar to the US, so that the *IAA can get all lawsuit happy up here too.
