As an attorney duly admitted to practice in the Courts of the State of New York as well as the Federal Eastern and Southern Districts of New York-
I call bullshit.
Without doing any research I can tell you that the standard for it to be a recompensible taking under eminent domain is that it has to reneder the property worthless.
For example, rezoning your commercial property to less valuable residential zoning would not be a taking. you may be losing significant value from rezoning but it is not a taking.
However if your property was rezoned to 'park or nature habitat only, development prohibited' then it could become a taking subject to compensation.
The companies that this would benefit already get significant income from selling of bandwidth. That they cant gouge customers is tough shit and not a taking.
JANNYAtty.
How about a short 'safe harbor' period whereby a patent holder is notified of a problem patent and then has an opportunity to withdraw it. they could be subject to the refund of point 3 but not the 50% fine.
Otherwise what your proposing sounds interesting.

The exxon valdez jury awarded 5 billion dollars in punitive damages. That oil spill has left a ring around that bay that is clearly visible to this day. The courts reduced this by a factor of 10. Because it would be unfair to make one of the worlds richest and most profitable companies pay for their own f--kups that continue to afflict Alaska. Will this kid get a reduction? No. Becouse the court is a conservative court of 7 justices apointed by republican presidents.
What does it mean that the court is conservative?
The Court sides with the prosecution over the defendant, the state over the condemned, the executive branch over the legislative, and the corporate defendant over the individual plaintiff.â Thatâ(TM)s conservative jurisprudence in a nutshell.
under FISA the government has three days after the fact to actually get the warrant. so start the tape recorders, while we get someone started on the paperwork.
It was a rock, lobster!
From the B-52's:
His ear lobe fell in the deep
Someone reached in and grabbed it
It was a rock lobster
We were at the beach
Everybody had matching towels
Somebody went under a dock
And there they saw a rock
It wasn't a rock
It was a rock lobster
Motion in the ocean
His air hose broke
Lots of trouble
Lots of bubble
He was in a jam
S'in a giant clam
Down, down
Underneath the waves
Mermaids wavin'
Wavin' to mermen
Wavin' sea fans
Sea horses sailin'
Dolphins wailin'
Red snappers snappin'
Clam shells clappin'
Muscles flexin'
Flippers flippin'
Down, down
Let's rock!
Boy's in bikinis
Girls in surfboards
Everybody's rockin'
Everybody's fruggin'
Twistin' 'round the fire
Havin' fun
Bakin' potatoes
Bakin' in the sun
Put on your noseguard
Put on the lifeguard
Pass the tanning butter
Here comes a stingray
There goes a manta-ray
In walked a jelly fish
There goes a dogfish
Chased by a catfish
In flew a sea robin
Watch out for that piranha
There goes a narwhale
HERE COMES A BIKINI WHALE!
Its a fav of mine.
Seriously, looking at this list, dont they realize how badly all of the earlier show hold up?
I mean they are embarrasingly bad. Buck Rodgers? Hey, I was as big a fan of Erin Gray in a tight jumpsuit as anyone, but they play it late on Scifi and it is bad. really really bad.
Here's my list of 'you will be in pain watching these':
47. 'Buck Rogers in the 25th Century' (makes comic books look well written- oh and 'Hawk!')
40. 'The Thunderbirds' (does not hold up well)
38. 'Batman' (okay as a comedy)
36. 'The Bionic Woman' (actuallly thought this was better the 6M$Man)
35. 'Battlestar Galactica' (Original) (saw the 'beings of light' episodes recently- w/patrick mckneeewww)
33. 'Lost In Space'
29. 'The Six Million Dollar Man' (answered the immortal question: whats up with bigfoot?)
24. 'Wonder Woman' (really really embarresing)
16. 'Flash Gordon'
15. 'Logan's Run'
Avengers- Thor, Iron man, Power man, the wasp, the vision, scarlet witch. Hey they also had the hulk, spider man. wasnt the she-hulk a member for a while?
Remember that part were the Cylons have gotten copies of all the militaries computer code, and they disable the military and wipe out the human race in a surprise nuclear attack?
Now replace Cylons with "Chinese" and human race with "America"
Microsofft has given the chinese government windows source code. The US military uses windows.
Simputer: I came from a planet that was ruled by a chauvanistic simputer that was really a simbot. Do you know what it's like, being a simputer in a simbot's simputer's world?
the lead of this article suggests that one of these going off anywhere in our galaxy is planetocidal, but when we read the article- the model they are using is one of these going off 6000 ly away. Since the galaxy is over 100,000ly across and we are about 2/3 out from the center, a random distibution of these things suggests their model is of a very close one.
Wow, this thing moves almost as well as the wind-up monkey that I have. And its from from 1911.
To be fair though, its only 8 inches tall so I cant ride in it, and its armed with cymbols instead of nerf guns.
At first I thought it was a cool show. And the continueing storyline, with smoking man and deep throught.. Then I finally realized it: This show is not going anywhere. The continueing plot- there was no point. no direction. This was not babylon 5 with a 5 year story arc. No this was just 'lets make up some b.s.'... this was a soap opera! Look at the last movie.. did that advance the plot line? no..
In retrospect, its those filler episodes that appeal to me now. I dont feel like Im being jerked around...
Oh and fear and distrust of the government- this show helped deligitimze the goverment. Then it seemed to morph into the whole 'Clintons killed vince foster and a whole lot more' that still maintains traction. Although I may be projecting a bit on this last point.
sounds good to me, give every user a 64 or 32 meg usb drive for $10 apeice...
This of course precludes the far cheaper use of cdrw as a storage medium at under a $1 apiece with far larger storage capacity..
and no HD??? they are using a CF card? well, more power to them, but those things tend to have finite w/rw cycles. (like 100,000- still you might not want it for a memory swap use...)
What are we talking about 256Mb CF card? I dont picture them going bigger then a 512mb cf card, becouse of the price point....
I hope in the US market version, we will be able to open a slot and swap in our 4gb cf hard drive...
and of course it needs its own computer memory-
64mb? 128?
They show it with a small lcd in the homepage of the.org site. Doesnt even look like a 15 incher.. Does this imply a 640*480 maximum resolution???
It does seem like it would be a good platform for commercial/POS use. Cheap, small, runs an lcd. hopefully it supports the lcd as a touchscreen.
Probably its a unitized mobo, with hardwired cpu attached. as for the memory...??? and of course integral video, and audio.
a 640*480 video display suggests a max of 2mb of video memory, probably allocated out of the general computer memory. not very impressive.
Conclusion- This also seems like it would be a nice car pc. Still I want it to play a dvd, onto a nice size 15 or 17 inch screen. hopefully that level of hardware will be available in a slightly up rated version.
Slate (has a nice piece on how the NY Attorney General is the most powerful person outside DC.
Here's the money quote:
The short form is that thanks to the 1921 Martin Act Spitzer can "subpoena any document he wants from anyone doing business in the state," make investigations secret or public as his whim, and "choose between filing civil or criminal charges whenever he wants." Extraordinarily, Thompson notes, "people called in for questioning during Martin Act investigations do not have a right to counsel or a right against self-incrimination. Combined, the act's powers exceed those given any regulator in any other state."
I think the future of travel (50 years of more from now) is replacing long distance travel with underground tunnels that are in a vacuum and have mag lev trains running at speeds over 1000 miles per hour. Eventually I think we'll have a network that will stradle the globe! Very expensive to build but once its ready its very efficient!
The other solution will be Arcologies. a building big enough to house a small city!
While your at it, put in a central vacuming system. I know this is a little off topic, but since we're running tubing all over the house... You can add a vacuming kick panel in the kitchen- sweep dirt right into it.
I dont have an Ipod but I thought this sounded neat when I started reading the article. Then I got to the punchline- its a text based game. I really thought it would be multimedia- hear an audio file, a text description and maybe a low res graphic. "You enter a room, theres a growling sound from the corridor you just came from. which way do you go" {Hear growling and scrapeing sound} [see graphic of small section of map- use dircetional pad to choose direction.] you get the idea.

who knew? That makes it actually interesting!

Marketing. And here in America. I am shocked.

needs to be built at the equator. Easier access to space.

Geez, you would think Imax is worried about loosing its 'cool' status. Run the damn films, controversy might get some more people to the theater.
But how soon will they be able to print out mila jovovitch???

Any ideas where I can get a small electric motor to drive an ebike? I dont want to do the hub centric thing.
