    So why can't you just say it might actually affect me as a EULA if I intend to modify something covered by the GPL but not distribute it? That was quite a few words but you didn't directly refute what I said. I still cannot modify it legally without accepting the GPL. Its a EULA. Using passive aggressive language instead of just plain aggressive doesn't change anything.

    Weird, just re-reading the GPL, as I am prone to do, it says that it is the only thing that grants me permission to modify the software. If I modify the software I have to follow certain steps. This language is independent of the copyright language. If it reads like a EULA and sounds like a EULA...

    Kinda like modifying iTMS content. Whatev, I'm not interested in either. Type of content that is, not the modification thereof.

    I doubt anyone would care. If all publishers were certain of a sale of at least one copy of all titles to each and every library in America, I think they would welcome it with open arms.

    It would probably make alot of the marginal propositions profitable if libraries were buying every game that came out.

    So buy it for them. When you have a limited budget and you have to choose between replacing your one copy of The Grapes of Wrath that has become too wretched to keep through years of use and OMFG LETS GET UT2k4, which one do you think the library will pick?

    Your comparison is a little off. The songs on an album would be more like the chapters of the same book, and yes you would likely miss the artist's intended effect if you didnt read those chapters in order. If you think an artist does not consider which songs make the album and in what order the songs should go, you have obviously been listening to the wrong artists.

    I'm not totally on board with the brain damage thing, but there is a lot to be said for a good total record and it can be greater than the sum of its parts.

    Heh, the clear channel rock station here has hardly a DJ at all local or otherwise. Most of the song introduction/explanation stuff is handled by listeners who called in to request a song. They record a little thing and its "Hi Im X from Y City and this is B record from C band."

    Its pretty hot. Radio DJs are lame.

    Unless the judge ruled that the GPL is so totally unenforceable that the authors have now given their code away and anyone who has used it is indemnified from their previous actions and just now have to cease usage. And don't say that's outside the realm of possibility. It isn't.

    So, you are suggesting that perhaps IBM, RedHat, Novell, Sun, Netscape, et al, are only supporting Linux and OSS because they expect the license on it to become invalid and somehow result in a victory for them?

    No, I'm saying that in my context those people don't matter. The people that "matter" in this context are those that are on the bubble, but see people getting sued left and right over this GPL thing and decide they don't want anything to do with it. The groups already on one side of the fence or the other don't "matter" when it comes to being convinced.

    OR alternately if the GPL is ruled enforcable it could send everyone that matters running screaming away from GPL'ed code. If the GPL is ruled not enforcable but for a clause that has nothing to do with EULA's in general, well its pretty obvious where that leaves things.

    I guess the outlook has alot to due with if your glasses are rose-colored or not at this point.

    Actually you can know. There is no rule preventing a company from asking the consumer if they want it. This is called "research".

    And for MMORPGs it isn't an "issue", they are making money. If they would have to spend 2 million to get your 9.95 per month, its pretty clear they know exactly what they are doing.
