1. Every iPod I own has gotten scratches. 2. If you don't like scratches, get a case. 3. If you already have scratches, try Brasso or iCleaner. I've tried both and they work well.
Bottom line, scratches are the responsiblity of the owner. GM won't replace your car if YOU scratch it, so why should Apple pay up if your iPod gets scratched. Meaning that if you own an iPod Nano, it's YOUR fault that you have scratches. Please deal with it in a way that does not involve the justice system as it is NOT their problem.
Vendors (more specifically, the product managers, sales types, etc.) are under pressure to get proudcts out the door to get sales and keep sharholders happy. That forces developers to limit the amount of time they spend writing quality software so that they can keep the PHB's happy. Net result, crappy insecure software.

.... It wouldn't matter. A long time ago in a galaxy far far away, I used to do IT support in a school. I would create user accounts on a Netware 4.11 (see how long ago that was?) server that forced teachers to change the password upon their first logon. The teachers would almost always change the passwords to any of the following:
- Name of their child - Type of car - Licence plate number - Name of husband/wife/spouse/life partner/current booty call
The kids (14 year old and younger) knew this and almost always managed to guess the passwords within a week through social engineering. So changing the passwords is half the problem, using strong passwords (or the lack of using them) is the other half of the problem.
The firmware is upgradable with new CODECS (at least that's what http://www.apple.com/ipod/specs.html says) so I suppose it's possible. However I don't see that happening as Apple loves to push Quicktime as a standard. FWIW, MPEG-4 is already supported as that is part of Quicktime AFAIK.
.... With all of these updates, the 12" PowerBook Specs are exactly the same as before this announcement (that is it uses DDR333 RAM, has NVIDIA Go5200 64MB video, etc.) with the exception of the DVD-RW drive being standard.

I suspect that 640x480 video may be for EXTERNAL video as it supports video out to TV's.
