the second point is that regardless of samples if its a "spoof" ie humourous takeoff then its also exempt from the rule due to a free speech issue with copyright....sunscreen song, not the sunscreen song....most weird al although he does ask for permission in most cases hes not required to.
The 3rd point is if this is targeting samplers as well as mixers ( you dont mix whole songs so in essence its a sample)
there are very few songs which dont include someone elses work...ie someone released a track that is completely silent....and song wioth a pause in it could be sued. Tribute (greatest song in the world) by Tenacious D is 90% stairway to heaven just in a different order musically with different words....
folk music which is the basis for most melodic music evolved it was not created from scratch... the C chord, picked in different ways then adding different bass notes and different words then change to the major 4 and major 5 or minor 3rd etc its all paterns with different parts added or chjanged...therefor all music is a copy of all other music because we all use the same notes (frequencies) its almost impossible to do anything
Perhaps the way they rate the time is based on the distance you need to travel around and not how long the user takes to work it out.

I find it strange that they think their product is never going to reduce in sales EVER!! Isn't it likely that the CD is not the optimum product in the future? Isn't it likely that the products they them selves manufacture and market would also reduce the Demand.

I also would like to point out that I have purchased about 45 Music products this year....DVD Concerts & Collections. Sure i bought CDs too but i purchased more DVD music products than CD based this year because i have a big screen and surround sound also.
Why can't they look at the sales of Music PRODUCTS rather than CDs...its not that we less its that we buy multiple mediums also.
if you look at the gamecube sales they increased only after about 2 years when someone finally worked out how to crack them
sony became dominant in Australia because they were piratable....

The hard part is making your consoles pirateable so you can generate sales but not so easily that average joe can do it himself with his normal computer....some effort has to be made so that Sony/MS & a minimal amount of smarties can copy them.
Blu-Ray Vs DVDHD or whatever they are called is basically a manufacturer discussion.....ease of manufacture....machinery changes.....support from designers and such....

Server 1 year later......i find it intresting that they kill workstation before server on the same core a year earlier...I would have thought that server patches and workstation patches to be interchangeable anyways....
you can run a script and turn server back to workstation on windows nt/2K and even 2003. its just a matter of having extra services disabled and a heap of server only reg keys renamed...
im currently running 2003 server as my workstation in workstation mode with more success than i had with XP pre sp2....post sp2 i haven't tries xp but then why downgrade when everything works....i havent found a program to cause a problem yet in 2k3
irrelevant really MS is the source of the patches etc but i can list over 30 mirrors that host stuff that the original company folded many years ago...the same will happen for anything popular...mirroring less than 2 gig of files and less than 1000 webpages is not going to kill any mirror company therefore they will host if for as long as possible...probably beyond it usefullness
