I think their basic defense, which seems to be overlooked in this discussion is:
1) google.com was being censored by Chinese authorities anyway.
a) since this was being done by the government at a third-party level, user experince was far from optimal.
2) google.cn censors keywords, thus maintaining optimum service. censorship is evil but this was happenign anyway.
3) Importantly, google.com is still accessible in China at the same level as it was before. Thus what google is doing is an additional step for imporving service while letting what information that can escape the Great Chinese Firewall through google.com be accessible anyway.

Google Desktop has the option of searching your web history / my Documents from across your own multiple computers, after you have ENABlED it. It is not enabled by default, and only if you sign in with your google account are you allowed to search.
Ofcourse the sub-poena threat is there, and it is a good point that id like to keep in mind, but perhaps they should advise us not to check the option rather than not install it at all.
Like someone mentioned before, the actual demonstration invovled somthign that appears as legit as it should be. Someone set up a ad-hoc network, it worked. The third person supposedly trying to join the 'hackme' network could have obviously detected the ssid if it was boradcast, and seing an unsecured network would have just tried to join in. nothing to see here dammit.
Has anyone demonstrated that windows starts an ad-hoc network, unless specifically set up by the user? this looks, worst case (also not demonstrated i think), more like a case of if someone sets up an ad-hoc network for some reason, and does not disable it, he next time it will still be there.

As almost all other patent issues it boils down to a flawed system, one that grants ridiculous patents but we knew that already. repeatedly. sub-consciously by now.
though Creative has a bit of my sympathy. I mean before apple totally trashed them, they were producing mp3 players for a long time, which i see as basically a good thing. uhm ok not very slick even though feature rich of a good thing. Along with iriver and all, they were one of the pioneers of mp3 players, w/o drm bullshit, and i felt their pricing was always reasonable.
Give them credit also for making popular pcs have soundcards but thats offtopic. I like the patent mess about as much as any other/.er, and this is not a flamebait.
I think there is a point to be conceded here mainly that people are finding lesser incentive to publish information on the net. The revenue is probably inadequate for a large number of publishers (by which i include anyone who publsihes any kind of webcontent) and thus it is conceivable that a lot of this might go down over the years.
i think a decline in the sheer number of free hosting services can be a a kind of indirect empirical proof of this.
I believe they have a clause which allows for the Indian government to overrule any patents in case of a national health emergency / epidemic - precisely what Taiwan is doing - but here the law already spells it out.
well in India for the average SOHO/Home user, linux is pretty invisible. Windows is easy to use, ubiquitous and your vendor installs the version you pick. free.
with the dial-up speeds viruses come slower (:-s) - (i.e. the ones using the buffer exploits.)
besides Nortons free too;)
