    I am not sure if the article writer actually thought this one through. In engineering as I understand it there is a category of engineers called professional engineers, which are allowed to sign off on work done and are held liable for any defects that may arise through normal, non extraordinary use. Bridge falls down under a normal load limit and well within expected age, s/he's on the hook. Building collapses with no reason, s/he's on the carpet explaining themselves. These engineers are for the most part licensed on a state by state basis and are mostly concentrated in the civil/structural engineering field, though there are others.

    For fields in which there is no state by state regulation, or products which are not confined to a single state (cars, airplanes) there is a thing called an industrial exemption, which basically stipulates that engineers are exempt from individual licensing and liability in designing and manufacturing products while under the employ of a company. The thought behind this is twofold (or more):

    1. It would be unfair to require and individual to maintain multiple license for each state the product is sold in, for the case of a company like Ford, all of them
    2. Existing product liability laws are in place in case the product does fail in order to recompense the public for any defects. Not saying that is right or not but there it is.

    Now given my semi understanding of the field of professional engineering licensing, which I will admit is only based on heresy and 10 minutes of Google research, I am wondering which model of licensing the author is proposing? The once where licensing is done on a state by state basis, which would effectively kill any sort of large software distribution, including Microsoft, Linux, Google, and any thing else that grows beyond someones the locale city website. Or the one in which software is treated as a product, covered by all the end user license agreement and statements that it is delivered as-is, with no guarantees of suitability for purpose and which does not actually require a licensed engineer to make?

    Now obviously IANAL nor am INAE, but I think that maybe his proposal will not work out the way he thought it would.

Then your looking at an hour of downtime during business hours while you re-image yet again with your boss asking what the hell the problem is and what you were doing on the weekend if you weren't solving the actual problem.

    When your job is the only thing feeding a family in a weak economy with high unemployment and a penchant for outsourcing your type of work, the right choice is keep your mouth shut. The world is never quite as black and white as you make it seem. You could make the "correct" choice for yourself but what about people depending on you (dependents)?

    Federal Minimum wage is currently 7.25. Fast food and call centers often go higher than that and they are always looking for folks. The best choice for anyone who is not independently wealthy and is asked to possibly violate federal and state law as part of their job duties is to refuse. You are not going to be supporting a damn thing while you are incarcerated.

    Why should he let them get away with just taking the images down? They were the ones that started playing dirty with the calls to his clients. I think he should first hire a lawyer, then subpoena the sales records for the images in question. After they get the records, then amend the claims to treat each sale as a separate infringement and seek the maximum penalty allowed ($250,000?). If the case is a strong as the blurb makes it out to be and the stock photo company is smart, they will attempt to settle out of court. If not, then Mr. Photographer may very well end up with a sizable amount of money as he bankrupts the company.

    (Note: IANECTAL-this observation is made early in the morning while I wait for my coffee to brew so any advice should be treated as suspect)

    Reality is, the school has no jurisdiction over what the student does off school grounds. Including what they do on their computer.

    Oh, if only that were true, but the school system will invent law out of whole cloth if you do something they do not agree with, as can be seen by this case. Really disappointing actually, because everyone knows Jesus would roll blunts and pass it to his boys like it said in Chong 4:20.

    Funny, when I went through out processing if I didn't have anything that I needed to turn in I got to sign a statement of charges, in other words I payed for what I lost. How would it be considered stealing if I payed for it? Furthermore if after paying for it I should come across the items in the back of my closet or whatever, I would think that ownership would in fact be mine. Meaning I can do with it whatever I want, including selling it.

    So, a gay person with AIDS is treated by a fundamentalist doctor who believes sexuality is a lifestyle choice, and thus, AIDS treatment costs are an unnecessary burden on the tax payer. This is truly the extreme of what the US already has in place with HMOs who are constantly crunching numbers, as opposed to doing everything in their power to help people get better.

    Not so extreme as you think, where a pharmacist refused to process a birth control prescription because of his beliefs. With cases like that already on record, I wonder how long it will be before a fundamentalist pharmacist or doctor refuses service to an HIV positive patient due to some ill conceived notion that only homosexuals can contract HIV.
