You should read the article again... It's not that the game makers are illiterate. It's the gamers that don't read anything else that is not Tolkien-related, so they tend to discard anything that doesn't fit those parameters.
A bad example (IMHO) was that The Verve made the song "Bittersweet Symphony" which uses a sample from a Rolling Stones song, which allowed them to sue The Verve and take over their song rights. "Bittersweet Symphony" credits today are for Mick Jagger.
I don't recall a good example right one, but I'm sure there are some out there. Can anyone provide?
Eye candy is the most apt label you could put on this game. DOA's fighting rings go beyond good looks, and are probably some of the most interactive arenas seen in a fighting game to date.
That "interactive arena" bit reminded me of this comic, I expect the same interactivity in DOA4:-P...
For example, AFAIK, it's illegal to rip DVDs to your hard drive, even if you have no intention of violating copyrights.
IANAL as well, but why should be illegal to rip DVDs to my hard drive?, there used to be a time where I could keep a backup of the media I bought for safekeeping reasons. The ability to rip the DVDs seems to me valid as long as you don't go wild distributing it.

Not to mention that the video memory Windows uses is less video memory for my applications, unless the driver uploads and downloads the memory state, and I think such switching will hurt my performance.
The operative system should not cope all the system resources, but well, there's nothing new happening here. I remember I couldn't run Quake 2 on my Pentium 100 because of the overhead Windows caused...
I find my tin hat very useful to protect my brain from cosmic radiations! I don't see why you couldn't use it for your film.
