IANAL but after looking at the website it strikes me that on this scale the effort and pictures can almost be considered artistic. this guy did some very creative stuff with those boxes and I'm pretty impressed with the results. It seems pretty draconian even for DMCA to stifle this kind of work.

The GM's will readily admit that they are only chasing marvel characters,vs DC or other copyrighted characters (I.E. DBZ characters which also run rampant last I played), because marvel is sueing them. Marvel is sueing because at the time they were not enforcing it as much. Now that the courts are involved they are bound to try a bit harder to deny marvel any further evidence to use against them.
How much are the games? 50-70$? I think I might just stick with my outdated gameboy at prices like that. Tetris has served me well for almost a decade and I think that is value Sony will be hard pressed to compete with.
... That is actually going to ignore this movie. I refuse to give lucas and other assorted madmen one more dollar for the previlage of being dissapointed. Any weakness will be shored up by howard the duck rentals.

its stealing yeah but I dont see any difference between downloading the thing or recording it when its on TV or Tivo. Its just faster. If they were smart they would just figure a way to make profit off this new medium rather than be retards about technology they cannot control. The Pr0n industry is already well along with virtual movie theatres (so I hear anyway...) theres no reason why the MPAA cant do it as well.

I dont know how many people remember back in the SNES days there were some really horrible licensed sports games. They were just counting on the names and trademarks of teams to sell units. So it turned out that the non-licensed games 9 times out of 10 were much more fun to play because they depended on gameplay rather than fanatic sports fans. I expect all this deal will do is inspire the other gamemakers to take it up a notch just to compete. If history repeats itself the only downside is that official sports games might suck for awhile.
