What this would actually prevent in either case... You can't really stifle all forms of communications between two parties no matter how many "laws" you have on your side. Just think about our prison system and how gangs communicate with the outside. This kind of thing would only work if the party you are trying to silence really lacks imagination.
On the other hand, something like this in the U.S. would go pretty far in instilling paranoia in liberals. At least the 3-4 who are not already.
I would have nothign to worry about. I would just copyright some random POS and send it through the internets, then send my attack dogs... i mean lawyers... claiming the ISP violated my copyrights by copying the file to look at it. Then I would claim they had to pay damages. Then if I won I would keep sending the same file over and over and sue again in multiples. I know you think this does not work, but if Blizzard can pull some sort of copyright BS with the maker of glider, which was the stupidest copy right rational ever, then anything is possible.
How on earth can the entire command staff of the Enterprise be that young? They don't require people to have serious experience (time in the field) before they can get to positions of that much responsibility?
They have the future equivalent of Bush I guess. It's sad to know we haven't outgrown patronage and cronyism by the 23rd-24th century.

Streaming movies and shows doesn't exactly come with a bandwidth warning. And I'm sure as hell this is what's behind their cap. They don't want me watching on demand stuff if it's not from them.
