This seems like a weird idea for Epic to do this. Doing something exclusive like this limits the breadth of licensing they will get. If I wanted to license their engine but they said you have to wait 6 months because Xbox360 has exclusive UE3 for the first 6 months, I would be very hesitant I think...
Why bother with that when they can spend time porting games you have to pay more $$ for, that you have already played like 10,000,000 times back in 1993...
If the UK said "We own Mars!" and had the military power to back up that claim, then the UK would own Mars. The world is basically like a schoolyard, without teachers or any higher power. If the bully says, "I own the swingset!" and nobody has the power or will to oppose him, then the bully owns the swingset...

Maybe it's because they know they are BS patents and don't want the bad PR of squashing small companies for infringement. I don't believe for one second that MS has any benevolent intentions from this.
Hell, if they had just dropped MS an e-mail three years ago, they could have been refused permission straight away, and spent the last three years developing a game using original IP.
It's always easier to apologize than to ask permission.
