    apple wasnt able to sell a product on the premise of being 'hip' and 'cool' for once. japanese preferred function over cool factor. hipster ads didnt cut it. to the extent that apple didnt see any issues with offering the phone almost free with various subscriptions. all the while customers in u.s. being locked in, tortured, and belittled if they wanted to do more with their phone by unlocking it, after paying exorbitant amounts. there's nothing to defend about apple - only way one can do this in this thread and subject, would be probably due to sheer fanboyism. bad. fanboyism is little different from religious fundamentalism.

    get a load of that. private interests are the decider of what's good for society now.

    that's what happens when you allow unbridled capitalism. if there is an unorderly chaos, a lack of authority, more powerful groups fill the gap and establish their own hierarchy. NO different than post roman empire chaos in which roman government wasnt able to restore order. in that feudal lords arose, establishing a new order. it was only in 1400s that central kings were able to establish a valid rule for the land, with the help of cannons, beating feudal lords and freeing them from the whims of robber barons.

    today is no different. we have a king in the form of governments, which WE, as people, control, we have 'private interests', which are trying to assert their own authority in various aspects of social life, hiding behind capitalism, competition and free market excuses.

    the only way that you can have EQUAL, FAIR environment is to bash feudal lords through your central hammer at your disposal - your federal government.

    do it, and you wont live in a virtual feudal domain in your locale under whatever big group controls aspects of life. - for any fool that may err in thinking that they dont : almost all of the services&products you use in your daily life belongs to various corporations which are the holdings of various big megaholdings themselves.

    are those idiots who sue internet presences for bullshitty reasons aware that, the moment they come up and show their animosity against the values of internet, they are making themselves a prime target for all major league hackers and junior league wannabees around the world, instantly ?

    do they think they will be able to sue down unidentifiable major league hackers, say, in germany for example, when out of their annoyance they make that shiney website of them have 50% downtime, or even infiltrate their corporate network and bust their files ?

    it seems to me that many corporations are yet not aware that internet, web is a LIVE environment in which you are always in front of the eyes of the public. and public's perception of you, can make you, or break you in many ways.

    the method doesnt matter, the end result matters.

    as of this point there is an established powerhouse of distribution and intellectual property. they are a handful of people, and they basically decide wherever market and even trends go. they can make or break stars. they can buy laws and buy enforcement.

    this is the end result. it doesnt matter whether they acquired it through some long standing tradition of a belief god given rights, or by increasingly manipulating and cornering the market.

    and you are no part of that aristocracy, if you pardon the offense here. your position as a software developer trying to earn a living on software, is the position of d'artagnan who is trying to make a career and living out of his sword, in employ of Louis XIII first, and Louis XIV later. despite being a novel, it actually pictures many frenchmen's lives in those centuries - trying to benefit from the 'trickle down' effect, which never trickled. an aristocratic system, regardless of the means it was acquired, does not reward or even like outsiders or outsiders trying to rise in ranks.

    you are one of the people. you are one of us. your benefits, your profit, your fate is tied to ours. you should remember that.

    what you picture is like saying either of the below :

    you are in 1780s france. someone is complaining that there is a strict class society. you reply "But hey, you can get ennobled and become even a Count by proving your worth - its a road open to everyone". whereas the number of people who become high ranking (and even lowest ranking) nobles at that time do not number a few dozen.

    Or, you are in 2009. someone complains about the political system and you say that "why, you dont have to have heaps of money to become a powerful politician - politics is open to everyone". which is, we both know, bullshit.

    same goes for music. its THEORETICALLY open to everyone, but its so cornered with various laws and distribution schemes that are monopolized by a handful of corporations that noone else can do any significant shit.

    i didnt lose anything. every day whole server gets backed up with rsync to some new york based backup service, automatically.

    costs 20/month.

    is it TOO hard to set up an arrangement like that ?

    no laws set monopolies to define minimum prices for any type of commodity. but in music, entertainment, basically monopolies are given exclusive rights, indirectly. there is no free market in that environment.

    in a competitive environment, the price of goods should be the value the customers willing to buy that good from.

    and, rather sadly, you are right, there are many people who would give money to their favorite bands, rather than giving money to saving people from cancer.
