Well that doesn't reflect my experience at all, but we're comparing what people find interesting so it becomes a battle of the anecdotes. In terms of fantasy, paranormal, or science fiction I feel I've far more and better options than twenty or even ten years ago.

Indie authors and musicians are not "sharply on the rise".

A swing and a miss. I believe the author of "The Martian" was an indie. Self publishing is taking off in a big way - but don't take my word for it, google it yourself.

And to think that stronger and longer IP protections is the reason behind the rise of indie artists is just dumb.

Not just small independent artists but large corporations also, stronger protections make creative work more valuable (this can't be disputed) and encourage higher quality. I mean who wants to put in a lot of time and effort if some nimrod is just going to filch it. However they apply to ALL creative work, not just whatever is put forth by Sony.

The people who say "stronger and longer IP protections is good for creativity" are almost universally people who have never done anything creative.

The problem is the DMCA's shoot first ask questions later incentives. When a DMCA takedown request is received you HAVE to take down the content. There's no counter process that allows 'due process' to happen while the issue is sorted out. Youtube took down Justin Bieber's ENTIRE CHANNEL over a bogus request, linky.

If a prank can result in a world-wide multi-million dollar star's content being removed without someone questioning the validity of it. The system is fundamentally flawed.

Or how about this. Jay Leno sees a video on Youtube and shows it on the Tonight Show. After the show airs, that video is pulled from Youtube. Why? Becuase, amazingly enough, it matched the 'signature' of what was played on the Tonight Show and NBC *automatically* had it pulled. linky

Not so much. The same ruling allows companies to use a 'good faith belief' that something is infringing. And more importantly, it explicitly says they don't need to do ANY research to develop this 'belief'. So it's absolutely useless from a Fair Use standpoint.

The thing is, everyone has something to hide, either due to loss of status, embarrassment, or a whole host of other reasons. Lying is a common social interaction, and most people choose not to share every aspect of their lives, thoughts, feelings, et cetera with anyone who cares to ask. "That's none of your business" is a common phrase, as is lying to protect privacy. It also isn't enough for law enforcement to say, "We don't care about most stuff you would normally lie about." While I've already written about the hearings for the Copyright Office concerning copyright on pre-1972 sound recordings, but I wanted to call out one particularly egregious and ridiculous statement from the RIAA. The RIAA's Jennifer Pariser claimed that there's no value to a work in the public domain. Apparently Pariser is unfamiliar with the works of Shakespeare. Or Beethoven. Is she serious? I mean, you could make the argument that it makes life more difficult to sell those works for the labels she represents, but those works have tremendous value. Pariser, of course, is famous for making ridiculous statements, sometimes under oath. Back when she worked for Sony-BMG she made some statements, on the stand and under oath, in the Jammie Thomas trial that were blatantly untrue. Only much later, after the jury had ruled, did the RIAA admit that Pariser "misspoke" while on the stand. One hopes she "misspoke" here as well, but I get the feeling she actually believes the blatantly incorrect statement she made.

If the lab techies can't extract the murderer's image from the deceased's eyeballs, they must not be trying hard enough!
