    Reminds me of the legaleize that scrolls rapidly by on some tv ads.

    No one can be expected to read that at normal broadcast speed. Just for yuks, I've tried playing one of them back on TiVo to see if they are readable. Nope. The text is too tiny and blurred to read _at all_.

    So, what is the point? Some lawyer decided that the "terms and conditions" needed to be included on the ad.

    "But no one will ever be able to read that!"
    "Well, it really doesn't matter -- this is just in case some loony takes us to court. We can still say that the T&C were provided on the ad. The lawyer says we need it, so it stays."

    Or, my other favorite is on cereal commercials where they are running some sweepstakes: "many will enter, few will win"

    The hell is that? At one point I seemed to recall is was more like "thousands will enter, about a hundred will win". Seems like at least you got some inkling of the odds of winning. Now it sounds more like they are just covering their obligation to provide some token statement of odds.

    Third Official: Well most things we do for pleasure nowadays are taxed, except one.

    Politician: What do you mean?

    Third Official: Well, er, smoking's been taxed, drinking's been taxed but not ... thingy.

    Politician: Good Lord, you're not suggesting we should tax... thingy?

    First Official: Poo poo's?

    Third Official: No.

    First Official: Thank God for that. Excuse me for a moment. (leaves)

    Third Official: No, thingy.

    Politician: Thingy!

    Second Official: Ah, thingy. Well it'll certainly make chartered accountancy a much more interesting job.

    It's not a "new" domain. windowsupdate.com always just re-directed to windowsupdate.microsoft.com -- they just removed the DNS for this convenience address (probably temporarily at that).

    True, the next worm will probably just point to the real url (not sure why this one didn't?)

    which appears to work just file. Didn't try it from IE tools menu, tho

    I think that's what everyone is hoping. If IBM is really serious about long-term Linux strategy (and they sure look like it), they could really boost confidence of businesses by identifying any such patents and granting a perpetual royalty-free license to (who? FSF, Linus?)

    So, yeah, IBM could kill Linux if it wanted to brush off some patent and take RedHat or someone to court. They way I read this (IANAL, duh), if IBM got a court order saying that Linux infringes some of its patents, people would have to stop distributing programs that cannot be used royalty-free, right?

    Seems unlikely they they would do that.

    According to forbes:

    IBM last year took in more than $1 billion in Linux-related revenue. In its 2002 annual report IBM claims it has 7,500 employees involved in developing, selling or supporting Linux, and that more than 15% of the mainframe capacity it shipped last year was for Linux workloads.

    IBM is pulling in some major cash from its Linux business (after having made an equally major investment, it seems). What motivation would they have to piss in their own cornflakes?

    Yeah, but IBM isn't using its patents against SCO's Linux distro?

    The infringing SCO software, IBM said, is its UnixWare and OpenServer operating systems, its SCO Manager remote administration tool and its Reliant HA package for letting one computer in a cluster take over if another fails.

    You know, I've never seen an ad for Bob (outside of blurbs on Nick itself).

    I have a 4-year old daughter. I TiVo Bob and a couple other shows for her and then *gasp* actually spend time with her engaging her interests like watching Dora the explorer and Bob the builder (and yes, plenty of non-tv activities like board games, reading, etc).

    Nick Jr is actually one of the few worthwhile couple of hours of tv around for pre-schoolers.

    Now, if you want to complain about "marketing the crap" out of things, I could mention Power Puff Girls or SpongeBob or the like.

    I thought I remembered it this way also, but searching for the story on /. came up with zero.

    I did find the story about a German court granting an injunction against sco:

    SCO Stands Defiant, German Court Grants Preliminary Injunction

    But it was not SuSe, but univention_ GmbH that went to court to get SCO to STFU.

    a German court in Bremen granted an injunction to Univention GmbH, a German Linux integrator, against SCO Group GmbH, SCO's German division. The injunction prevents SCO from saying that Linux contains illegally obtained SCO intellectual property, aka Unix source code. If SCO continues to hold this position, they would have to pay a fine of 250,000 Euros.

    If there was a similar action by SuSe, I couldn't find it.

    Yeah, it's down a bit today, but the 52-week low is $0.78 -- sorry to say, but this hustle seems to be working in their favor for the time being. It's going to take IBM coming down hard to put all this to an end, I'm afraid. I'm just not sure what they're waiting for.

    Well, they managed to push out a independent coffee store here where I live (Chicago burb).

    There was a cool little shop that had great coffee, great service and a nice little lounge. Starbucks came in and set up a location in Dominicks at the other end of the little shopping center. Within a month, the other shop was gone.

    Was it because people preferred the starbucks coffee and the other shop lost customers? no The shop had just as much business as before.

    Word is that Starbucks pressured the property management office to not renew the coffee shop's lease as part of the deal to set up shop next to Dominicks.

    I put a little bit of butter and salt along with the beer + onions.

    Some people say to poke the brat with a fork prior to boiling, but I never do. I also find that a pale brew like rolling rock imparts a lighter, sweeter flavor.

    Experimentation to find what suits your taste best is highly encouraged.

    I've heard of theft of services, usually used in the context of illegal cable hookups or the like -- I didn't know it could apply to something like watching a movie without paying.

    If you sneak into a movie theater and watch a movie without paying, have you committed theft? Piracy? No? (mebbe the theater can call the cops on you for trespassing?)

    Clearly you have done something wrong. You have gotten something without paying the asked price. Do they charge too much? Are they ripping off the Actors by controlling distribution of their work? Maybe.

    Does that give you the moral/legal right to not pay?

    I don't think so. Downloading music instead of buying the CD seems about the same. You aren't stealing. You aren't even a pirate. You are consuming a commercial good/service without paying the asked price. (disclaimer: I have downloaded music without paying)

    Occurs to me that this is more like peeking through the fence at the circus. You aren't going in and enjoying the show without paying, you aren't taking anything away from the circus owner since you probably wouldn't have paid anyway. You aren't even trespassing because you are on public property. But you are doing something wrong. You are getting something for free that the circus owner has spent money to put together to make a living from. He has a right to chase you away from the holes in the fence.

    Yah, and CNN was doing their best to help out this morning.

    They interviewed a guy this morning. (Can't find it on cnn.com, though)

    He says he is being investigated for the 300 files on his PC that he downloaded a year ago. He says his grandson used his machine a few weeks ago to download a couple songs and he thinks that is why the RIAA is getting ready to send him a subpoena.

    This guy didn't have a lawyer and was worried about how much it was going to cost him to defend himself. He said he thought they were just making an example of him to scare others.
