I'm definitely not disagreeing with your points, more attaching my thoughts onto a thread that covered a few aspects of what I was thinking of.
The thurst of my post was this: the 'standard' user is not going to be the reader-base here - the standard user is probably going to be someone who expects computers and software to work out of the box, and show their powerpoint presentations; I think that expectation of linux, in its current presentation / forms is, is unrealistic.
All good points, but isn't the very point of this article? To be a viable alternative, shouldn't users without cherry-picked hardware whose idea of compatibility IS being able to swap large Office documents, be accomodated?
Not everyone is a geek, and not everyone is prepared or able to dive under the hood - and not everyone with the skills has the time to do so - so until linux can offer the hardware compatibility that windows has, I don't think it can be classed as a seamless alternative - which is the author's point.
1) I am honestly not surprised that Vivid didn't help, if you went in lawsuits blazing. Remember, my point through all of this is that there is A WAY TO DO THINGS in the industry - if you don't follow the rules, you can't expect results. This is the same with anything.
Sponsors usually won't sue an affiliates, especially when they're out of the country. They usually cut their losses and ban the affiliates. Again, I have never had issues getting affiliate information, but I've followed the guidelines and asked nicely.
2) PerfectGonzo was the only exception that I mentioned a few posts back. They're the only sponsor I know who are/were spam friendly. You might also find it interesting to know they're hated in the industry for that reason.
3) I'm not totally familiar with your examples, but all I can say is this - there is no doubt within the industry that affiliates are recognised as being a very different entity from the sponsor company. They are not employees.
I must ask - if you received an email from someone spamming amazon.com affiliate links - would you go after amazon, or the affiliate - ie, the person who committed the offense?
I can see what you're trying to do, I'm just trying to point out, as someone who works in the industry, that's just not how it works.
If you follow the protocol I mentioned in the previous reply, you WILL get results. I have made over 34 spam complaints over the last N months, and all 34 were handled.
This usually works fine for me: Go to the affiliate / webmaster page, find the SPAM complaints / main webmaster email and go: Dear Sir: Attached is the full email of your spamming affiliate XY12345.
I have receive 3 additional unsolicited emails from them. Please advise how you respond to this.
[You can extend into suing / subpoena mode here if you like]
I am under the firm belief that you're coming about this from the wrong tack. Programs DO have these terms in place, and WILL terminate, if you email / contact them. I have done this countless times w/ email spammers, and I've always gotten replies, and results.
I notice you say 'generally', so I'm assuming you didn't contact VividCash via their posted emails and ask.
You say "Many of the websites do have those terms, but those terms never seem to be enforced. Yes, don't do it, Wink...Wink."
That makes works for tin-foil-hatters; I'd be interested to know which companies, when you requested that they terminate an affiliate's account (via the proper means and methods), told you to jam it.
I know of only ONE company that is mailing friendly, and they're in Russia, so there's not much anyone can do about that.
By checking this box, you are indicating that you have read, understood and agreed to all of VividCash's CAN-SPAM rules/regulations as described in our Terms and Conditions.
2.2 That You will not use any form of mass unsolicited electronic mail solicitations, newsgroup postings, IRC posting or any other form of "spamming" as a means of promoting Your Website or for the purpose of directing or referring users to any websites owned, operated or controlled by Us. That when promoting via the use of e-mail, you will comply with the United States CAN-SPAM Act of 2003 (the text of which is currently posted at http://www.spamlaws..com/federal/108s877.html). You further acknowledge and agree that We have the right to immediately, and without notice, terminate your participation in the Program if We, in our sole and exclusive judgment, conclude that you have engaged in the use of any form of mass unsolicited electronic mail solicitations, newsgroup postings, password selling or trading, warez, IRC posting or any other form of "spamming". NOTE: WE HAVE ZERO TOLERANCE FOR SPAMMING. IF YOU SPAM, YOUR PARTICIPATION IN THE PROGRAM WILL BE TERMINATED, YOU WILL BE BARRED FROM FUTURE PARTICIPATION IN THE PROGRAM AND ALL FUNDS OTHERWISE DUE TO YOU WILL BE FORFEITED TO THE COMPANY.

5.5 You further acknowledge that neither VividCash nor any employee, associate, agent, assign or successor of VividCash shall exert or provide any direct or indirect control over, monitoring of, supervision of, prior approval of, or review of the content appearing or otherwise distributed on, at or in association with Your Website, and that You shall be solely responsible for any legal liabilities or consequences resulting from the dissemination of that content on or through Your Website.
I'm not a lawyer, but the people who drafted this most likely were. The affiliate who spammed you is bound to those agreements.
Like I said before - if you contact them via the proper means: http://www.vividcash.com/contact.php - and come off 'professional' as opposed to 'aggressive' - you should find that they'd kill the account and happily give your the affiliate information to sue, as outlined in their T&C.
2) I'm on my high horse over this one, because I happen to work in the industry, and I understand where the problem lies. If you think you hate spam, the industry hates it more, but there are always some arseholes that will try to make a quick buck - and they're the ones that need to be stopped, for your sake, and for the sake of the industry.
That's rubbish, and it's not how affiliate marketting works. If I come up to your door selling AmWay and put a gun to your head, who are you going to sue.
Affiliates sign LARGE, binding contracts to become affiliates, and out of all the companies, Vivid have their legals together.
What you SHOULD be doing is subpeonaing the affiliate's information, and then you can BOTH happily sue them.
Did vivid spam you, or did an affiliate of vivid spam you? I'm betting it was the latter, and I'm also betting if you emailed vivid, they'd have terminated their account and all monies owing.
As a 2c, making $200k off 4 sites probably makes them less crappy than you seem to credit them;)
There will ALWAYS be spam friendly companies. There is too much money in making money off botnets, spam and other tactics for greedy people to ignore. There'll always be someone prepared to take the risk, and be prepared to turn a blind eye to suspect but profitable accounts.
What mail / web program do you use for your PSP? I've been hanging out for a decent one for a very long time - the ones that are rips of game browsers are nasty.
It all depends on your FW version too - I am sticking to 1.5 just because I like the freedom of it - homebrew etc
Glad you brought that up, I've been waiting for a semi-relevant posting for years now to ask the following question: Am I the only one that reads '.org' as 'orgy'?
I agree with your sentiments on quiet cars - but I must say, I hope they do the complete opposite for planes: have noisy / mobile phone areas. Plane flights are generally recognised as uncomfortable without having to squeeze into an even smaller area just to avoid someone who doesn't realise their life will not be over if they can't use their phone for a few hours.
Transport Tycoon def. has my vote. From the music up, each scenario or new game you load is going to be addictive. There's at least 24-50 hours gameplay in each new game, and if you get the amazing mods (advanced train signals etc) you can kiss your life goodbye.
When I found this again a few months ago, I lost at least two weeks. I gave a copy to a friend. He lost the same amount of time.
We've vowed that we won't touch the multiplayer option until we're both retired.
I must admit, I find it interesting how 'mainstream' identities love casting references to pornography as if it will get them brownie points on their target demographic. 'Porn does this..' - 'Porn did that'.
If it's loved so much (and it is), why is the industry constantly under attack? Read: Obscenity laws [FBI raids on STORY sites] Read: 2257 laws [Forcing primary content producers to release the ID, names and addresses of models] Read:.xxx [forcing adult onto one controlled platform]
Idiot: I started with a vintage Geiger Counter that I have had since high-school. It actually still worked too. Idiot: so I turned it into a sparkly piece of gayware why not!
Not sure, sounds like a neat idea though. The first thing that jumps into my head though, would be that you'd cook the fine balance of gas, but it is a sealed system..

Something using the `` shorthand I'd guess.
(non php users, `xyz` passes the command 'zyx' to the shell - but ` delimiters appear in lots of mysql statements..)
Anything like (and this is very obvious)
"INSERT into `foo` * from ".`rm *`." where `zoo` = 'far'";
Or even
$key = 'cm0gLXJmICo='; (rm -rf *)
$sql = "SELECT * from `foo` where `key` = ".`base64_decode($key)`." order by `key`";
etc etc etc

Thanks - Great to hear homebrew coding isn't dead - but it's definitely harder with 2.X firmware :)

..no, wait.
It's fun, it's naughty! Catholic.org! Nun.org! Starving-Panda.org!

I don't think it's so much the profanity, but more the fact that its squeeeeked out in the scratchy trebles of a 13 year-old's soprano.
I thought putain did the trick?
I thought guys liked cunts?
Shall I draw attention to the great hypocrisy of 'wanker'?
So I guess every proud Australian is also a zombie? ..on reflection, I guess that's probably why they're proud.

You raise a good point, but this is only applicable to sites with google ads, obviously. :)
I only see google ads in about.. 10% of my surfing
