Great, i can get my fill of propoganda FASTER now.
Who do these fucks think they are kidding. Just like SARS was under control and the bridge over the river that was DAMMED, this is in line with everything else. The only music download that does not include your closest relative paying for the bullet is "Dance Like Mao".
Just wait, they will get close, then fall away like every other US wannabe. Maybe they can have a cross between commie and rep, get everyone included, stop acting like the barbarians they are, and get with the program.
Oh, I know, I cannot talkk to Poeple's Republic like that.
Yeah, I want to log a date stamp issue against this article. It says for my Friday enjoyment...but it is now Saturday... then again the fact I reading/. on a Saturday this early explains alot...
Can you really remember the last time there was a virus that did not take an action by a stupid user. I am talking about viruses in the classic séance, not the ones that rely heavily on social engineering as most of today's do.
The last one I remember that was not totally reliant on social engineering was the CIH virus, something the spread over time, then hammered everything in it's path.
OT I know, but my take is that if a company creates a user account that is balanced between usability while limiting the ability to do something stupid, then Linux will be fine. Windows does not do this, ergo you get stupid people with ability to do incredibly powerful action through sheer ignorance.
But perception is going to be the name of the game. This is the very reason that SCO gets as much press as it does. it would be far beeter to have five to ten big projects get together and pull the license then to declare open warfare.
If OSS acts in coordination and is organized about this, then it would work, otherwise it has that angry mob feel that we need to avoid.
In the SCO UNIX(R) is Legally Unencumbered section they refrence the rant Darl came out with about copyrights. It was bad enough that when Darl printed the who copyright letter that it was blasted to hell and back. Now they are using it in a PR push?
Truely, this smacks of desperation. The only case studies that are mentioned are POS situations, where SCO Unix could interface with what is more then likely some old ass mainframe. Translation, a stop-gap measure to get functionality now. You know these companies will not be using SCO as a perm solution.
As far as the case goes, the two are one. SCO screwed up by fileing the Slander of Title case, as they gain NOTHING if they win. It should have been breech of contract, in that way with one win they could sweep away Novell and boost the IBM case.
SCO is a bunch of big fish from a little pond getting their asses kicked. These guys think they can whine and threaten and get what they want, as most of Utah is a bunch of pushovers. Don't make waves!!! They figured the rest of the world was like that, and they could push over IBM. Well, they are getting the kametic payback of a lifetime of being bullies.
I am late to this discussion...in middle of a recovery...
Look, this is areally starting to come together for me. Now I am not the tinfoil hat type, but this is really starting look like a MS ploy. SCO is sueing anyone that moves, making noises to politicos, and basically, it seems to me, laying the groundwork for the real assult later.
This will be in the form of another IP landgrab, this time by MS. They will use all laws available to have Linux transfered to them in the name of "national security."
Think that is nuts? So do I, but look closely. We have a government in place that loves to do interdiction in the name of PR. What better PR then grabbing the Os used by terrorists, nukers and evil-doers and handing it to the largest, most stable tech firm in the US, thereby solidifying it the concrete of control. The US will use it's influence to get all US bound patents in Linux recognized globally, leaving those who try to work on Linux behind the pale to be classified and America's enimies.
Maybe this is a bit extreame, but...really, the laws are currently in place and political will is there for something like this to occur.
On Tuesday, McBride said that lack of indemnification proved that companies knew there was something wrong with Linux. On Wednesday, he said that indemnification programs proved that companies knew there was something wrong with Linux. Darl is obviously showing signs of short-term memory loss.
This whole thing is just starting to piss me off, as they want it both ways, want everyone to lay down and pay them money for just sitting on their asses and thinking about ways to rule the world. They keep making these threats, but with the resulting 60 pages of docs they handed over, it is now being widely assumed that these guys are smoking some of the local meth (Utah has a HUGE meth industry).
One other note is that Sontag backtracked and said that this case is not a copyright case, but a breech of contract case. If that is true (who knows) then the ONLY entity that they could get money out of is IBM. They cannot go after an end-user using a contractual basis for their case, as the end user has no contract with SCO, much less any implied of such. They could go after under the basis of the copyrights, but then any end user could defer the case until after the Novell v. SCO copyright fight is over.
This sounds like a last gasp of desperation from SCO. They had to put out something to pump the stock, and what better way to say they going to get money from the whole world! What they do not realize is, just like a TV show killing off a main character to garner interest, this latest tact will prove to be opening act of their permanent cancellation.
The question is why are they so pissed about this and keep asking for indemnification? Easy answer. First, it means that they cannot go after small time users. This kicks the legs out from under them, as they cannot build up case history by suing end-users and getting them to surrender (like the RIAA). This means the only thing they can do is go after companies in a vulnerable position, like Google (who in the midst of an IPO would HATE to have the pub of a SCO lawsuit) Secondly, when a company indemnifies, all of the claims are paid out (most of the time) by it's insurance company. This would give SCO the ability to get money to eternity by suing end-users, have them spin to the company, and the company would pay via it's insurer. This is a brilliant move on OSDL's part. SCO was baiting them to push for the indemnification, but by NOT pushing for it and then getting the ability for end users to defend themselves, they have effectively castrated SCO in at least three strategies.
The initial reaction I always see from the zealots is "Don't hire any of them!" and that always makes me a bit sad to know that this will be the first thing that a person that has worked for a company like SCO will more then likely have to overcome. Having been in a bit of this position, I can say that the best approach is to put things in the context of doing the job that is given to you to the best of your ability. While your job may not be popular par se (imagine trying to land something after having the tile of Asset Reclaimer at SCO), if show that you are doing it within the best of your ability in line with what the company is trying to do, then you will show that are willing to things that, while contrary to your nature (one would hope), you are willing to do the things that are necessary in a very ugly world to get the cash on the table. And yes, I realize that in some cases these folk are evil and deserve to be shut out, and I agree with that, but for example I know a good man at SCO in a high position. He hates what is happening there, but was there before the shift to this current strategy last year, and so is doing the job. His job is of a nature that finding a new one and getting out in the name of being on the "side of righteousness" is a difficult item to do with many considerations, not least of which are small things like his house, cars, kids schooling and the like. I can see why he stays, and why he would try to keep everything on the downlow. He is also hella good at what he does, and shold SCO decides to redundant him, or they go the way of all good trash, then I would hate to see that a name on his resume would get in way of the fact that he is very competent and good at what he does. Flame away boys!

SCO is suing for damages based on suing for patents. Seems they have a patent on the patent and claim all other patents are derivative works...
Also, suing for use of a patent when you don't have a patent is a business model patent that they have had since acquiring the rights to said patent from a French/American farmer in 1957...
