  1. Lacked legal authority... on FTC Approves Google-DoubleClick Deal · · Score: 4, Insightful

I'm not sure about the privacy implications, but I'm glad that a federal agency finally recognizes its own jurisdictional limits, unlike some other agency I can think of who is supposed to be regulating radio broadcast spectrum allocation, not content on said spectrum. Still though, I hope it's not an excuse to pander to big business, like some of what the EPA does when they say that the lack legal authority, even when judges rule that they do not lack such.

  3. Re:Bill Moyers piece on FCC Ignores Public, Relaxes Media Ownership · · Score: 3, Interesting

As much as I have issues with the current Executive Branch, it is an act of Congress that created the FCC, and Congress that ultimately has the responsibility to regulate things. Any laws they create take precident over the FCC. They are more to blame than the executive branch, who is at least consistent in it's views about most things (pro-big-business). Delegating the responsibility of regulating the airwaves to 5 people seems the ultimate in shirking responsibilities, in my opinion. I realize that it is not this congress that created the FCC, but maybe if we had fewer 3 letter agencies, and actually had Congress directly make policy, they would be busy enough to actually have to do work, instead of grandstand about trivial issues. It's a lot harder to bribe 250 people than 3. Nowhere in the constitution does it say anything about any government entity having the ability to delegate its authority to a smaller body.

Uhhh...has it ever occurred to you that the reason we have these huge mega media giants in the first place is because the FCC has been relaxing ownership rules for media for years, allowing there to be fewer and fewer owners of media? Requiring smaller media ownership provides diversity of viewpoint much more easily than not. My grandfather was upset about newspaper conglomeration back in the 70's, and he warned of a day when there would be two or three huge media companies. It's because of apathy that this has been allowed to happen. News of all things should not be oligarchical.

This whole thing seems to be a proxy war between the Legislative and Executive branches over the entire concept of FISA and illegality. It kind of puts the telco's in a bind. What do you do when first the Executive branch tells you to do something which is probably illegal, and which if you don't do you'll likely lose money (see QWEST), and if you do do you will face Congressional hearings, and possibly be punished for illegal activity. While I don't agree with what the telco's did, they are not the real law breakers here.
