    Wasn't trying to troll, honestly with the last update...I was fine before the update and after it was available, before even thinking of updating, iTunes continuously crashed on start with a library error. That is until I updated with the iTunes updater.

    Regardless of how much is spent on R&D for the device, you are missing the fact that that cost is covered in the price of the item. What does it matter how much they spent developing it? Did they invent the plastic that it contains? No? But wait, what about all the R&D that GE Plastics or whoever put into years ago to fabricate the process used to create the plastic, did they get a signed contract stating they can use it for the DS? Oh right... they paid for that plastic so they get to use it how they see fit. So to answer your question, he paid whatever percentage of profit they made off of the sale that was allocated to cover the R&D cost.

    In truth, each defendant's claims will be evaluated by the judge/jury in question and the cases will proceed or not as they will. However, both are making the same claim, which was my original point that you couldn't see.
    Thank you for pointing it out. I don't disagree with you there. In fact, lacking any proper evidence to the contrary, I would indeed dismiss both cases. However, as far as the bias a typical slashdot reader would slant, as you mention in GP, would not be because they are differentiating by severity, but by legality. Civil vs. Criminal


    I made up the speeding violation analogy to compare with Vick's dog brewhah to at least put them on the same field. If he was not the one driving the vehicle, Vick would not get a ticket, the driver would. Just as if a drug dealer gets busted for selling out of a hotel, the owner of the hotel does not get arrested. Unless that is, evidence shows he was complicit.

    ...and who knows. Perhaps it is just as easy to hide a kennel of death at Vick's house than it is to hide a zombie on someone's computer or for the Sergeant's friends to access his. We will have to wait and see.

    speeding is illegal too. Are you saying we shouldn't differentiate between that and Vick's dog fighting? I don't see your point here, you yourself acknowledge that the difference is criminal compared to civil...so it is not "illegal" in the eyes of the law, but copyright infringement. A better comparison would be someone borrowing Vick's ferrari and getting pulled over for speeding. Guess who gets the ticket?

    Aye, much agreed. Was just saying... I'm not sure where the limitation was, but I know that it occurred lil more than a year ago. I remember being around as my friend went through the whole process. I do recall they were sticklers about being able to prove you had another bluetooth device at time of purchase of the phone (not sure either exactly which phones it was in regards too, sorry), but the settlement was good for those who got screwed, well everyone's constantly getting screwed by them, for those with particular phones and who were aware of the problem that is.

    Verizon lost a class action lawsuit in regards to their bluetooth bullshit. If you could prove you had another bluetooth capable device at the time of purchase of the crippled bluetooth phone, they gave you a new phone and reimbursed you for the previous piece of shit.

    I never ment to stress that the right thing is to do nothing. Only that the right thing is not vigilante actions by ISPs, do to harm that may come to infected hosts, not even to mention the effect on Efnet and legit users who's DNS was hijacked. ISPs are actually the only ones in a unique position to identify their users who have been infected and contact them... something I also would suggest they do through more legitimite means.

    Botnets are a scourge of the net to be sure, however attacking the problem instead of the underlying cause is not the answer in my mind. We want to stop the spread of HIV, we do not gather all those infected and shoot them. We educate the populace in means of prevention as we look for a cure...

    Ok maybe a little bit of a dramatic analogy... but still. To be honest, my only cause for alarm is the means they used to an end. If anyone else was hijacking DNS, we would not be having this discussion as to whether they were right or wrong.

    Without knowing the exact innards of the sowftware they are "disabling", who's to say that these bots aren't disigned to do the most damage as soon as they are are discovered, i.e. someone begins to kill their processes? Or enter incorrect command codes? Cox could be causing irreversible damage to boxes based on the reactions of some infections. I know I would include a self-destruct in any malicious code I happened to write (thankfully I do not write any). What ev1l hax0r wants their bread and butter software analyzed?

    While forced is a bit off...I recently bought a new laptop for Pa Dukes. A few years ago he refused to have XP on his Desktop because it was "too new" and probably "full of bugs", he's an old mainframe or micro kinda guy, so no way was I going to get him one with Vista. We had settled with Win2k on his desktop, but I convinced him XP would be great for the new laptop. It actually cost me more to get the same exact hardware specs with XP than it would have with Vista, and wasn't as easy as I thought it should be...also, it was XP Home (shudder, without spending even more) not Pro that it shipped with, but the differences there are another rant, though transparent for a user such as him. In the end I was going to just get the Vista one, like I did for my friends new one (love those ultra-bright screens) and just blow out Vista with a copy of XP (Don't for get that Dell Hardware DVD to Load before XP First!) but I wanted something that would work out of the box for him with only some decrapafying and teatiming for me.

    what is also interesting is that MS *must have* caved in sometime in the past (from their refusal to answer), and Vista's inbuilt spyware/malware detection makes it more likely to snoop on its users.. privacy concerns explode!

    the scary part is if "MS *must have* caved", who's to say what these spyware/malware companies do even matters. You will notice that they all say what they can detect, they will report. If MS caved, then a back door could be structured for an agency with the right credentials, that could plausibly deny that detection from occurring.

    I'm curious to know how long it took and how many spyware/malware detectors found Sony's rootkit?

Get people interested in the iPhone, sells millions of copies, then when the hype starts to fade, during the holiday season, release a new EDGE capable iPhone, and start lowering the price of the current models a bit to capture more market.

    Let the chiseling motherfuckers train more than one person in the organization for each job.     Yes, more trained and adept co-workers is a blessing, no doubt. For most anyones everyday job functions, there is someone to cover should the need arise I am sure. However, some people are hired because not many people can do what they do very well, regardless of the amount of training. Or how about programs personally managed or developed, or things you just don't want anyone else fscking with (job security anyone?). In the case of finance, deals you've brokered, trades you need to make, or clients you need to talk too ASAP...I won't even defend executive use of an on-access everywhere system, since they are the devil incarnate for you. Get burned on the bust much? Don't forget it, but time to get over it.

    The last place I worked, some of the fat cats were cashing in thousands of shares of company stock per week. When asked why this shouldn't be taken as a sign of lack of confidence in the company, they consistently defended the practice as "prudent financial management, just diversifying their portfolio" or as "graduation or wedding gifts to close relatives". Horseshit.


    Horseshit indeed...although, is someone holding a gun to your head making you keep your shares? I got news for you pal, perhaps that previous company of yours sucked. Plain and simple, its sink or swim, perhaps it was taking a long walk off a short dock to begin with. I'm not saying that corporate corruption does not occur, but if it upsets you so much, quit whinning and do something about it, take a stand.

    The point of these expenditures is pork barrel corporate welfare. Everything after that is a product of the question, "How do we pitch this to the taxpayers such that there will be no significant backlash over the expenditure amount?"

    At the federal level, I agree you might have to stretch for the usefulness of the technology, but at a state, or hell professional level, the technology could fit. Integral infrastructure and emergency response comes to mind.

    It's also different when the employee might WANT to be tracked and integrated into a "Presence" environment. I for one would not mind. I'd be able to leave my station more often. Critical IT techs, or hell; execs, finance dudes, secretaries, agents, admins, doctors too name a few would salivate at that availability. Noone would invest in a system like this to see if the janitor is sleeping in the closet... Well initially at least.
