    Does he get a 'rebate' on the "phantom damages" for all the $$$ made by the sweep and clean operations, antivirus companies, and independent techs?

    Who is really to blame for this? People who run unsecured Windows installs, or the original worm writer? Is cyber-punk really getting a fair shake, when authorities have made it clear they are making an example out of him?

    What lawyer is going to let their client walk in to a courtroom dressed the way he was, and expect to sway the judge?

    Why is Microsoft not held liable for an OS full of exploits?

    Why are /.ers so angry at dumb cyber-dork and not angry at the company that makes the OS that makes these worms possible, or people that continue to use Outlook Express - when there are alternatives for both?

    Is it a /. thing that everyone who goes to prison should be raped? Is anal rape rehabilitation to /.ers?

    I seem to remember reading that green was the brain's natural signal to stop, so traffic lights were reversed - green made people want to stop, and red to go.

    I tried the tester with reds, and couldn't get better than .3xx times - I tried with green, and got more than a couple .2xx times.

    Hmm.

    Why, when DRM gets here, we won't have any of these Fair Use or copyright infringement discussions because there won't be fair use, and there won't be infringement. If something slips past the Analog Hole, unjust and misused laws like the DMCA and anything Senawhore Hollings has a filthy hand in will carry the day.

    When corporations can absolutely control what you can archive, reuse, or replay - that will be the day that free speech is reduced to what an individual can mimeograph and hand distribute. And there are already laws that chill that speech, such as vandalism, loitering, disturbing the peace, unlawful assembly, and thousands more. Don't worry, one applies to you. Right now.

    So violate copyright every chance you get. Copyright has been abused to the point where it is useless, unjust, and no longer represents the intentions of the framers of the Constitution. Civil Disobedience, kids - 1 in 6 Americans can't be wrong...or can they?

    I agree with your estimation that Apple would have been seriously hurt by clones had they let them continue. How could Apple compete against those who didn't have to do the initial R&D?

    Macs seem too expensive to those who don't do the research. If repairing and preventing viruses, spyware, trojans and exploits don't cost you anything, and your time is worth nothing, then w00t! what a deal a Windows PC is!

    Software base small? I can compile and run Linux and BSD software, run any os 9 or previous mac os software, and run most any Windows software via VPC. I can also dual boot my mac.

    Finally, your troll is just dumb. VW has offered vases for their beetles since the 40s. They were popular with people because it was a way to add a personal and tasteful touch to their car. These were people who eschewed the overhyped Detroit automobiles.

    The only difference now is that VW continues to use their 'people's car' marketing, but doesn't sell a 'cheap' car anymore. This has nothing to do with Apple, Macintosh, or pretention.

    Macs are for people who want to work with their data, not wrestle with an OS written for the lowest common denominator.

    To Discover, Invent. We discover what existed before, but remained unknown; we invent by forming combinations which are either entirely new, or which attain their end by means unknown before. Columbus discovered America; Newton discovered the law of gravitation; Whitney invented the cotton gin; Galileo invented the telescope.

    Discover and Invent Although they are synonyms (according to the site), there is a subtle difference.

    But what do I know? I just post stupid things to Slashdot.

    Ms. Quinn describes him as the inventor "who arguably discovered the first internal combustion engine." You'd think that someone who is the spokeperson for the Patent Office would know the difference between discovered and invented. Or maybe not.

    Perhaps I'm wrong - maybe the internal combustion engine *was* discovered.

    Well, if you're a musician you hate them because they will only give you a contract on their terms, they promise to distribute and market your record and don't, they will cheat you out of every cent you make and send you a bill for it, they will put you in a holding pattern for as long as they can if they want to keep you away from other labels yet not release your record.

    They assume ownership of music that is not theirs, yet blast you with lawyers if you desire to sample music of theirs. They encourage the flavor of the month, but will not invest in the long term career of an artist. They pay radio stations to play what they want you to buy, leaving less or no room for music not controlled by them.

    (Hours later)

    If you're a customer, you hate them because they treat you like a thief, they only admit the right of Fair Use when backed into a corner, they lobby incessantly for backwards technologies that make the act of listening, using, and enjoying music difficult if not impossible. They push format after format yet say the new format hurts sales. They preach that you can't own a CD - only license it from them, yet won't replace a scratched CD because you own it.

    (yet more hours later)

    If you're a /.er, you hate them for their fake statistics, their inflation of CD burner speeds to number of burners to make piracy sound like a larger problem than it is. You hate them because they fail to address the issues at hand, and attack 'straw men' of their choosing. You hate them because your favorite band broke up after being dicked around by some A&R guy. You hate them because they make backing up your CD collection annoying, difficult, illegal and tainted with 'cracker' spin. You hate them because they lie, they cheat, they steal, they are a monopoly and they use their power to keep others from competing on a equal footing. They have the ear of congress, and use it to make you a criminal - whether you are 'stealing' or not.

    There you have it Bill. Consider yourself enlightened. There are more stories out there, and not that hard to find. Enlighten yourself, and see what happens when people sell other people art.

    As the job market gains strength, what are companies willing to do in order to attract the best talent?
    Not much more than when the job market sucked. Wait. That's now.

    Are we about to enter another era where employers are willing to make work fun again, in order to attract and keep talent?
    No.

    Will this have any effect on other employers, forcing them to again offer benefits to keep pace and talent?
    No.

    How important are these kinds of perks to the average employee anyway?
    When you've never seen a perk, or had them all taken away with the knowledge that they aren't coming back, probably not very.

    What kind of perks would you have to have to switch to a job that pay the same?
    My perk would be to not have to go into work. I would happily switch to a job that paid the same, but wouldn't require me to work. Is Slashdot hiring?

    Yes. Lawyers are very precise in wording, which is why one must read things written by them very carefully. Which is why I'm confused by your post.

    But let's not be blind. There are those who use these networks for terrorist activities and other activities which many (if not most) on this board would disagree with. It is worthwhile spending time to weed out the bad uses of these technologies so that we can still use the technology for good uses, instead of throwing the baby out with the bathwater.

    I'm sure you meant 'users', right? Because we already have laws that make many of these "uses" illegal, and we should enforce these laws on the illicit 'users'.*

    * Laws not necessarily just, or fair. Not applicable in all states. Void where prohibited by common sense.

    This 'letter' is worded to prey upon the same people who would 'unwittingly share files, even when their computer is "off".

    The more I read it, the more pissed I get - not at the people who wrote it, but the supposed 'smarties' that signed it. You guys and gals do have assistants, right? Run things past them, first.

    We need people who actually know how to turn computers 'off' to weigh in on these issues.

    And I thought it might be challenging to be a lawyer. Apparently, it just takes a good pen and a lack of personal responsibility.

    p4 1.8 oc'd to 2.16 @ 120mhz
    512 ram (2100, i think)
    32 meg Gfarce MX200 (I know, I know)
    5200rpm 40gig HD

    Performance is on the high end of unplayable, or the very low end of playable. (compared to UT2003 which was pretty good)

    On the lowest setting @ 640x480 it's somewhat better than quake 1 on a 4 meg S3. Playable until you have to kill things. I think. I was freakin'. Scary. I'm not even sure if it was me or the poor 32 meg vid card. I quit after the monsters came.

    Speaking of video...wow. Eye f'ing candy. Even on the lowest setting, everything is sweet sweet eyecandy. Really. I had to try the high setting at 1024 - that was mindboggling. Everything was very render-y. The whole 'playing a cutscene' is no joke. However it plays like Myst at that point.

    I can see a videocard in my future. Maybe a new motherboard. Some more ram. A faster hard drive.

    Oh. And a money tree growing out of my ass.

    It seems odd that there is no mention of this in the FAQ, yet we have a 'YRO' section.

    Damn, I could use one for the times I'm on the road and need to call ahead, or get directions, or call mommy.

    But I can't make sense out of these godawful service plans. I was going to get a phone a couple of weeks ago, but the madness of hidden charges, extra service charges and everything else that interferes in me figuring out HOW MUCH A MONTH, and comparing to other companies just made me lose interest.

    I'm ready to pay for a phone and service, but I'm tired of the 'rebate economy' that cell phone providers hide behind.

    When I can: pay the same, reasonable amount that isn't padded with unadvertised charges, and talk as long as I want, when I want - I'll get a phone.

    Until then, phones are moot. Cameras, mp3 players, video games, internet access be damned - I'm not going to suddenly start paying to take pictures, listen to music, play games and surf 'per use'.

    Yup. Very Cold Day in Very Hot Hell. But it's what I want.

    You got me. :) That particular model was indeed a Danny, however, most of the hollow bodied acoustics and electrics were Harmony.

    And Samick does own Silvertone - I should have remembered, as I was just shaking my head at the Paul Stanley guitar on their site the other day.

    It's pretty well known in music instrument circles that Sears, Montgomery Wards, and several other big-box stores sold guitars and amps under several different brands, with one manufacturer. Airline and Silvertone guitars (Wards and Sears, respectively) were all made by Harmony guitars as early as the 1940s.

    These guitars were *exactly* the same from brand to brand, with the exception of colors, and some minor details (shape of pickguard, knobs, pickup covers).

    Harmony brand usually sold for more money, followed by Sears and Wards even though the guitars were exactly the same.

    When Japanese guitars started showing up for much less, there was much more 'spread' as many of the cheaper models were outsourced overseas. After some time, the industry shook itself out and the cycle began anew.

    Now many of the old names are owned by the Japanese, and it is a similar situation.
