I too, as a 1L trying to make it in "CyberLaw" am interested in your take on this. The IP career field now seems preoccupied with patents, almost to the detriment of everything else. As someone who wants to be involved in CyberLaw but doesn't want anything to do with this very tiny old-boys club (patent law), I'm finding it very hard to find positions anywhere. Is there hope for an IP lawyer who doesn't want to do patents and has no technical degree?
USF Law school 1L, Dean's scholar, started CyberLaw group here and very interested in the type of IP work you do. Let me know if you're in need of any volunteer (or pay!) help for the summer, as i'm looking to use my legal skills.
Sounds like a nice idea, but I wouldn't buy a Motorolla phone unless it was the last phone left on earth. American cell phones are...blech... A Nokia or Erickson, or even a Japanese phone with these features would get snapped up by a lot more people who trust these phones way more than a product designed in Texas......
First thing that needs to be done is have him checked out by a psychologist. Likely he has some mental issues like NLD/Asburgers, mild autism, etc.. He should be getting treatment for these. What you described clearly is beyond just normal geekness.
Epicurious is really a classic (and classy) site, with some of the best gourmet recipes out there. It indexes recipes from the last 10 years of Gourmet and Bon Appetit magazines, two of the best in the industry. My mother, a pastry chef, gets most of her recipes from these magazines and Epicurious.
I personally love it for their great Mediterranean recipes. Also the reviewing system is great so you can see actual chefs who have tried it and what they think about it before you take the plunge.
You'd think so, because if they actually won the IBM case they could basically use the ruling to collaterally estopp any opponent from claiming linux isn't owned by SCO...
On the other hand, there's always something for sowing a little FUD and then trying to get a company to settle out of fear.....
Most contracts have a clause saying something like "If any section of this contract is not enforceable, the rest remains in force". So wouldn't you be, at most, only rejecting that one section?
That kind of clause only applies to a contract which has already been accepted. Making a counter-offer KILLS an acceptance, meaning the contract itself never existed...
IANAL (but I am a Law student), and it seems to me that this would indeed by an enforceable contract. I agree that making the changes IS a rejection and counter-offer.. However, the acceptance comes when the HR gets back the signed contract (counter-offer), keeps it, and allows you to work for a significant amount of time. They have "accepted" by their silence and, if nothing else, it seems they could be collaterally estopped from denying acceptance by the employee's reliance on the contract.
Is there something i'm missing here??

Have you been to Finland? Just got back home (California) from there a week ago, and I can say I can't blame him for living here in the Bay Area. Goddamn it was cold there. About as expensive as the Bay Area though with those really high taxes.
Apparently "unlimited" has been redefined w/o our knowledge. I wouldn't mind paying extra to have really "unlimited" access if that's what it took to not have to worry about this. I have "unlimited" newsgroup access which I pay extra for, and it is well-worth every penny.
Anyone know which hill this is on? Is it the one with the giant TV/Radio tower? IF so, i find it strange I have yet to pick up a signal while at school. My law school's library is on another hill directly across the panhandle from this hill -- direct line of sight w/ nothing blocking. I sit in that library everyday and stare at that godforsaken hill, and i've never picked up a signal.....
Not that it really matters, every single seat in our law library and classrooms has ethernet. Yay technology!

I'm a USF Law Student and the "tech" (if you can call them that, they are idiots!) department is very paranoid about bringing in WiFi. Funny thing is that on a clear day, I can sit in the Zief Library (law school) & get a signal from the undergrad campus library about 2 blocks away.
Actually first thing you learn in law school is that it's almost never right or wrong, but some shade of gray. We spend the vast majority of our law school classes discussing the gray. Its only Right vs. Wrong in the real world because Lawyers have a professional duty to represent their clients to the fullest, otherwise it is malpractice and they can be sued.
Sure is easy to blame the lawyers though -- they're so well educated and wealthy that they are easy targets for those who aren't.........
Nope, immediatetly thought of the good old BBS days. Strangely enough I still am friends with a few guys i met on the BBS's. We all ended up going to University of Minnesota together about 4-5 years after the BBS's finally died. Still remain friends today -- though I've moved to San Francisco...
Oh gee I can't wait to see what kind of quality products these great protectors of individual rights come out with next. It sure is great to see such companies as Microsoft & Macrovision working together, but it sure does make you wonder where the RIAA and the Taliban were during these meetings? Their invitations must have gotten lost in the mail.
Just go check out a deals site like Fatwallet or Anandtech... It's not hard and this should be a big "DUH" for all Slashdotters. I bought a couple of 40 gig Ipods for $430 apiece off Dell and resold them for $40 profit each. Happy seller, happy buyer.. Yippee... Not hard at all.
