Here is the game plan, they will take legal action and make headlines up through Christmas time. Napster will be re-launched as a legal pay P2P service. The record companies will make it clear that this service is legal and has the blessing of the RIAA. If Napster (minus independant label content) is a hit they will back off of the legal action, they may even offer a blanket amensty for Napster customers.
This is a guess on my part and I think it is a strategy that may work if the Napster service is viewed as a fair one.

I rip DVDs to a Shuttle PC that I pump video-out to my DVD I also download flash animations and CG demo reals to watch, there is video on demand, Tivo (freevo), DVDs, etc. If you are still writing and thinking about VCRs than this may be the problem.
What if that High School teacher is using a program that uses port 135? He would know that the program doesn't work, he may not know why but his app still doesn't work. I guess you have to balance that against the exploits...
No in my case, I view the DVD as better value for my entertainment dollar than a CD. If a CD does look like a good value for instance the Matrix 2 CD set (two CDs for the same $14.98) I might pick it up. But I almost also opt for a computer game or DVD over CDs now.

Targeting kids is going to destroy the RIAA. I will tell you right now that Congress will not stand for it, you can already tell that with Senator Coleman gettting involved. It is all well and good to go after a few 'poster children' cases, but when you start blanket attacks you are in trouble big time. It is wrong to steal music and other peoples works but you also have to come to an acceptable agreement with your customers and throwing them in jail usually doesn't get the job done, it should be the last resort not the first.

1000 songs and 1 movie, that is about 90 CDs and 1 DVD, she easily could have bought all of these, if she has all of them in her collection she not only has a stronger case, but she was obviously a good customer. Are there any open-record labels or bands that distribute music via MP3 and encourage that the music be shared P2P? What are your favorites?

It is the fault of a "greedy IP company that is also not making a product" and the government for allowing it to go ahead. Also is there an open source problem here, for instance let us say that MSFT agrees to pay royalites to allow their web browser to continue to work correctly, then the company claims that browsers such as Mozillia must also pay royalities?
