    MS owns a trademark on the word windows as the name of a piece of software

    Most likely they do not own this. The Lindowes suit brought by MS and later "settled" by MS paying Lindows $20M made this fairly clear. The court ruled that the suit would not be as of the understanding of the word Windows today but at the time they adopted this for Microsoft Windows.

    They would most likely have lost and once they understood this they Settled a suit they filed themselves.

    IBM is perfectly positioned to be the champion of new notably middleware standards.

    They can expand their R&D and with no real axe to grind they can secure that new and needed standards gets approvel quicker. Their interest is the quality of the standard that they can then offer their clients as a new service.

    Within the same architecture the clockspeed is almost directly linear with performance. IE 2.8 is 40% faster than 2.0

    To publish a complete API (without implementation code) would cost MS a decent amount of money to simply produce it in the first place.

    So let them pick what option they want to do, being expensive if not really a concern of the EU. Remember this is not because they are nice guys but imposed because they broke the law in EU.
