Murder is illegal even if the person being murdered consents. The logic is fine.

Sorry, I don't see how that makes the example fit the discussion. Comparing something where both parties have to consent to one where they don't doesn't work. The issue is that a transaction is legal for one party, and not for the other. The legality of murder is irrelevant to the person being murdered unless they consent. If they do consent, it is illegal for both parties. There is no point where it is legal for one and illegal for the other. Being murdered doesn't require making a choice or taking action.

I would gladly accept an example where a legal action of one party requires the illegal action of another party.

Your logic is flawed. What you're saying is akin to, "murder must be legal, since being murdered is legal, and for somebody to be murdered, somebody must be doing the murdering".

It isn't really the same. Being murdered makes you a victim. You aren't being victimised by downloading or uploading, you are participating. You might have an actual point if the person being murdered chose to participate.

    Your logic is flawed.

Cambridge is definitely in Boston. Greater Boston & Boston City are 2 different things. I think most people mean Greater Boston or Metro Boston when they say Boston. If I can get drunk in downtown Boston, anywhere I can stumble to is still Boston. My opinion, Cambridge is one of the nicer parts of Boston. I would live there if it wasn't so cramped, had better parking, and if I could afford it. It is also a great place to work, but BU's porn mag is way better than Harvard's porn mag. Cambridge isn't always better than Boston.

IMHO, Cambridge would not be Cambridge if it wasn't right next to the city of Boston. It is pretty dependent on the entire area, just as any other city or area in/near Boston is. This is all beside the point though. The real point is that anyone in Cambridge, Boston, Brookline, Dorchester, you name any city near Boston, are all watching & reading the same news. If there is an alcohol related death, or changes in policy at MIT, we are all as likely to hear about it. You pointing out that he is technically not in the same city does not discredit his opinion on the past and/or present alcohol & drug problem at MIT.

Wouldn't that be an issue for AFP and the newspapers that they deal with to work out? If these newspapers are redistributing that content, they are the ones who AFP should be telling to adjust their policies on. There issues with Google should only be an issue concerning information taken from the actual AFP site. Either way, I think that AFP is SOL.

You can't get the whole story from news.google.com. You have to follow the link to the news site to get that. You can get the same info from searching for articles in any search engine. If google was using the full stories, this would have some merit. If google was using password protected content, this would have some merit.

The entire internet is a collection of links. I don't see how people can try to use a lawsuit to restrict what you can link to if the information is from a freely available source. If they don't want that information to be linked by bots, they should use a robots.txt to block the bots and stipulate that those who pay to use their FULL news stories must do the same. That would solve their problem without adding to the lawsuit frenzy that the world is in.
