Can you believe it, they rejected the game due to "52 design errors"! But Mr. Darrow wasn't daunted. Like many other Americans, he was unemployed at the time, and the game's exciting promise of fame and fortune inspired him to produce it on his own.

Fair Use is not defined as a list of things which are acceptable. The US Copyright Office explains this here, and the relevant section of the copyright law which I believe you are referring to reads:
"the fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright."
If this ever got to court (which I doubt would happen if they respond quickly to requests to expunge) then they could probably argue that they fall under scholarship or research, but they don't even need to. Other purposes may be considered as well.
The performance of the new machines sucked for quite a while. That was when we went from a 68k running at 66MHZ going to a 100Mhz PPC 601 chip. To be honest a 33Mhz 68k "seemed" faster than a 100Mhz PPC chip.
Moving Mac OS 7 from 68K to PPC was not a simple recompile. Much of the Mac Toolbox and System 7 itself was 68K native. By contrast, I don't think as much of Mac OS X on x86 will be running as emulated PPC instructions.
One thing? Which would that be? IBM makes hardware from servers down to semiconductors. Their software line spans PC development tools, RDBMSs, operating systems, and groupware.

I don't think Apple would be keen on that. They already have numerous manufacturers of other PCs building their systems, which are then rebranded as Apple with no trace of Asus or whoever it is.
Unlike the switch to Intel, which is simply moving their brand in a different direction, letting Dell sell computers featuring OSX would actual water down their brand, which I don't think they are willing to do.
Maybe. I certainly don't believe that both organizations could ever see eye-to-eye on such a deal, period.

Apple contracts Dell to build the new x86 Macs, and licenses Dell as a Mac reseller. Everything still has the Apple logo, but Dell gets a cut.

One of the things that really soured me on BeOS was that they advertised compatibility with Java and Unicode support throughout the OS.
There was barely any Unicode support and the OS shipped without any Java VM.
