Any drawbacks that my admittedly short sight missed? Can individuals join to avoid getting sued? Do groups need to have patents to join? I assuem they're still allowed to sue non-members, otherwise there would be no incentive for outsiders to join.
But how did Sony's actions prevent people from suing? Was there a clause in the EULA that prohibited it? Since they're getting their asses sued off anyway, can't the judge throw this one right out?

The ROKR won't play any songs encoded at higher than 128kbps? I'll admit that I'm very unfamiliar with this phone, so bear with me. Is this 128kbps MP3s or the iTunes format (aac?), and if the latter, is the sound quality better at 128 kbps than an MP3 at the same bitrate? I'll only keep 128kbps if it's a rare track, for regular listening I prefer an absolute minimum of 192. Anyone care to enlighten me?
I don't have the quote, but one Motorola exec (CEO?) made a statement along the lines of "Who need more than 100 songs anyway?" It's exactly this kind of short-sighted should-be-good-enough-for-anyone crap that causes products to fail, and the companies that continue to put these kinds of products out continue to not get it. Meanwhile, mp3 players with massive multi-gig drives are rocketing off the shelves like chairs in Redmond.

Don't have a Tivo, but wondered, does it require a separate internet connection or does it get the listings through the cable, like digital cable does? Either way, how long until there's some exploit and everyone has to start patching their Tivo on a weekly basis? Tivo antivirus, Tivo firewall. Surely there's enough storage and processing power inside one to be useful to someone who controls a couple thousand of them...

I don't have (and don't plan to buy) one of these CDs, but I would think that any external communication or use of your net connection would have to be disclosed in the EULA. It could be covered in some legalese catch-all such as "as necessary to provide enhanced services", etc. This is the kind of reason I'm immediately suspicious of anything that begins, "For your convenience"... It rarely is.
Although I've never owned an Apple Computer myself (just an iPod), I remember playing on a friend's Mac when I was younger and felt sad to see the company in trouble. It's nice to see a company turn around and become profitable again. Probably human nature to root for the underdog, but anything that stimulates competition and consumer choice can't be all bad either.
I grew up in one of those labs, on a Vax. Today I'm a professional software engineer, and I credit it all to the seeds planted in my youth trying to extend the capabilities of DCL batch files to do everything from games to utilites to public message boards. Never underestimate the power of a push in the right direction, especially at a young age.
