Do you really think law and morality are so closely connected? For example, US copyright law allows civil lawsuits to recoup damages for copyright infringement. Does that make the RIAA's legal campaign moral? The gap that sometimes exists between laws and morality is the reason for things like Civil Disobedience.

Don't get me wrong. I agree that both laws and morality are informed by the culture in which one lives, and can be limited in scope geographically. But with globalization and the internet, allofmp3.com was crossing those geographic boundaries, and effectively becoming a loophole for countries where a service like theirs could not legally exist.

I don't like waiting in line to spend money. So I decided to call ahead the day before and find out how the stores were handling the launch. My local Target (Northwest Denver) said they were doing a lottery on Sunday morning, and handing out tickets at 7am. That worked for me, so I went up there at about 6:45, stopping for breakfast on the way. I waited in line about 15 minutes, behind 22 groups of people buying consoles. The Target employees came out with 24 tickets. Everyone in line at the time who wanted to buy a console got one. Some people continued to wait in the cold for one of 14 copies of Zelda. (I sat in the car and watched the line count.) The store opened an hour later and everyone bought their consoles. A few people showed up between 7 and 8 describing the lines at Best Buy and other stores. I guess I got pretty lucky.

There was a shortage of extra controllers, so I only have one. This is a bit of a bummer because even on turn-based multiplayer minigames on Super Monkey Ball, I can't seem to play 2 players without more than one wiimote. Anyone know how?

  12. Wi-Fi 3 day song sharing? Harder to sue customers? on Zune Profits Go To Record Label · · Score: 3, Interesting

Actually, the Zune is designed to store "unpaid-for material..."

We haven't already forgot about the "feature" that allows you to send your songs to your friend's Zune, which stores them for 3 days (even if it's stored in a DRM lockbox), have we? I think that case may be harder to make with an iPod.

Also, the author's logic is a bit flawed. To say that because Apple did not sell me every song on my iPod means that the rest were either stolen or ripped from CDs is not a valid argument. For example, much of the music on my iPod was purchased through other services, such as eMusic.

I'm also wondering if taxing devices will help to invalidate the consumer lawsuits that labels such as Geffen, through the RIAA, have been launching for the last few years. Or maybe the labels / RIAA have figured out that they can't get away with extorting their customers too much longer.

I wouldn't necessarily consider the need to learn new technologies a negative when comparing the options. Technologies are always changing, regardless of the languages you use. And in my experience, the need to learn new things is much stronger in smaller companies, who have less people, than larger. I've worked with a number of people who have technical positions in large companies who aren't even familiar with the current (non-MS) technologies used by their companies. They've supported the same applications for 20 - 30 years, and they get comfortable. Then they complain about not getting raises and/or new jobs.

If you're not driven to learn, you probably are irrelevant. You're definitely in the wrong business.

  14. Does this really invalidate TOS? on Login Code of Conduct Found Not Binding · · Score: 1

If you RTFA, there are a couple of factors that affected the ruling (which was made by a NSW Industrial Relations Commissioner, not any kind of judge). In addition to the "air of automaticity", there was not evidence of a zero tolerance policy against pornography.

The corporation for which I work recently started requiring that all contract employees agree to a "Terms and Conditions of Use Agreement" every time they authenticate to a web application on the corporate intranet. The agreement is currently a 5 page document. If I took the time to read the document every time I agree that I know what it says, I wouldn't have time to do any other work. But, there must be lawyers in the US who are itching to argue that "automaticity" does not invalidate the agreement. I mean, someone convinced management that this was a better way to handle computer usage policies than providing a written document in the employee handbook.

While the article speaks well of the Australian government, I'm not convinced that we will see a widespread effect as a result of this ruling.

And yes, it is ridiculous to buy 2-3 different copies of the same game because there are extra levels or features in each of them. But it's also ridiculous to buy the same movie over and over again on DVD (think "special edition", "ultimate edition", "remastered").

The goal here is not to sell one or more consoles, it is to sell more than one copy of the same title per gamer.

Perhaps the big media corporations are moving on to other countries because they're failing here in the US. It is becoming more evident that the RIAA lawsuit targeting tactics (tracking IP addresses, subpoenaing, etc) do not provide sufficient evidence for a lawsuit. Considering they've never allowed a case to go to trial, you have to wonder how much confidence they have in their methods. Of course, they have managed to extort money from all kinds of people in the US for a number of years.

So why not go somewhere else, rinse, and repeat? Or at least spread out, and file as many lawsuits as possible before there is an actual judgment that may invalidate the rest of them?

I suspect this is just some anonymous flamebait, but still, you're not really making a proper comparison.

    You compare:
This amazing and free online network
    to
Needs to have 50 dollars every year to play online - add 200-250 dollars to the system over four to five years
As others have stated, the Xbox Live does have a free service as well, and I saw nothing in the article describing free online multiplayer gaming (which is mostly what you pay for on Live).

    You compare:
    1080p games
    to
no 1080p or high quality audio output
The Xbox 360 is supporting 1080p following the fall 2006 update, which I believe is scheduled to be distributed prior to the PS3 launch. If that's a result of the competition from the PS3, great. But it really isn't a selling point right now. Also, the Xbox 360 does support digital surround sound audio. You don't make it clear what is better about the PS3's audio.

    HDMI
    - You are correct that the Xbox 360 doesn't have an HDMI connector, but I believe it's $600 for a PS3 with one.

    You compare:
20 gig harddrive that can be upgraded to any size from any computer store
    to
    Can't upgrade the harddrive
The article doesn't say the hard drive is upgradeable. Are you making it up? I remember not putting my PS2 online because I had to pay $50 for a special 10/100 network adapter that fit the PS3, when a generic one cost $10. I'm not convinced there will be an easy way to upgrade the hard drive without buying proprietary hardware. This is Sony after all. (BetaMax, MiniDisc, MemoryStick, BluRay) etc. And are you sure opening the box won't void your warranty?

And let's not even go into the ridiculously marked-up 360 peripherals...
Are you claiming that the PS3's peripherals will be dirt cheap? (See comment above about $50 PS2 network adapter.)
