I'd say the biggest problem facing MSFT is NOT WinRT, its the fact that the PHBs have placed metro on notebooks and desktops where it makes about as much sense as having handlebars on a pickup truck.

I was a patent examiner a number of years ago. I knew (and occasionally still keep up with) the promary examiner on this patent. He does good work, and seems to have done alright here. (He actually has an interesting hobby, documented at http://www.bigsteel.iwarp.com/.)

A quick reading of independent claim 1 pretty much eliminates any question of infringment, i.e., there is none. It reads:

"1. A computer user interface menu selection process for allowing the user to select music to be played on a music device controlled by a computer ..." including "e) playing the selected song item ... on the computer responsive music device."

When last I checked, the iPod was not controlled, i.e., told to play a song, by the computer hosting the iTunes software. Without that step, the patent is not infringed. Period.

I want to point out one more thing. The patent in question is not a design patent, but a utility patent. Design patents have identifiers that always begin with "D" and they pertain only to the appearance of something, not to what the patented thing does.

I thought we were supposed to like the command line around here.

So, if M$ patents everything it can get its hands on, what innovations would it stop?

Well, considering (1) what the patent office is willing to allow and (2) what Microsoft can buy... a hell of a lot.

Big difference: he's using mechanical linkages and hydraulics to operate it--not electronically controlled motors.

Have you ever watched a backhoe operator working? Or, for that matter, driven a car? It's a matter of relying on muscle memory to adjust for slop in the mechanism.

I don't think his project is much different than other machines on the monster-truck circuit (read center paragraph for a riveting description of two giant battling robots). This guy's design is most notable in that it departs from the traditional transforming metal dino-sar theme.

The point is it's not rocket science to design a "control system" for what are basically jerry rigged front-end loaders. In fact, it's demolition derby science: rocket science's archnemesis.

Granted, it would be a bit more tricky to get it to actually walk, but I imagine the operators will just wheel the thing out on a flatbed and wave it's arms around a bit and shoot flames. All his talk of military and forest fighting capabilities is just successful buzz to get rednecks like me out at the local speedway.

And Optimus Prime! Oh wait...

Since it only requires a name, I guess you could give them a fake one and they'd never know. Just don't go with a famous name, becasue they'd want to see some ID then - I mean how many people out there are named Optimus Prime. You might also want to stay away from professional athlete names also, since too many seem to be having legal problems. On the griping hand it does seem that some people really want Amiga to just go away. Sorry guys, we are not going away. The Amiga is still my preferred working platform, and like the old car commercial; This is not your Father's Amiga either. Amigastine, built for the ruins of three Amiga 4000 computers is my drug of choice. I run high color high resolution screens. I spend more time working with the computer than working on the computer. Lastly, I take any list of "Top Ten" anythings with a grain of salt.

I remember my first Voodoo cardie. I was playing TWCTF alot with my buds, and many of them had fast systems (at the time) running glquake/glqw. Finally after being a software user for so long, getting decent lag-frags, I did the unthinkable and ditched the software client for some better visuals with my very own piggybacked Voodoo card, from 3dfx. Gaming has changed quite a bit since then, but you have to understand how much fun it was playing Quake in software mode. The mods were cool too, but everything about that experience was killer fast. Now since then, games have mostly slowed down on PC. Quake 2 and Quake 3 were much slower. The speed of play for TW back with software, was intense. You had to hold your adrenaline rush to the bitter end of any match. By the time I was playing for ZFA, everyone had a 3d card. I can remember the Q2 LAN parties when guys would show up with their configs all set for zero textures and no coloured lighting. The levels would all be just plain white, and guys would be saying how awesome it was they could get 100fps doing this. To me, it always took something away from the game to run configs like that, even if it could give you an edge in matches.

When I saw Quake 2 CTF for the first time at the Respawn LAN party, Zoid showed us on this decked out system, how totally amazing it was. I remember how georgeous q2ctf1 looked for the first time my eyes caught it. It was magic. I even wrote about it. You could never have seen it if it wasn't for the people at 3dfx, who pretty much paved the way for all the gaming rigs we've got now. It's a shame that the same people who built this dream had to shut their business down.

I guess, that's how we award our innovators today... with steady, constant competition, or you're out. Seems cold, doesn't it?

If there is a need, the technology will be built. The trick is to get some benefit out of being the inventor.

Until I read this post, I thought that I was doing OSS for entirely selfish reasons... for example, writing a DOS/UNIX/Mac text converter simply to have a small, fast program.

It bears mention here that none of the websites linked to here at /. point to an area with my OSS stuff on it. That would be here, mirrored here.

Anyway, I now realize that "selfishness" isn't the correct term. I write OSS because:

1. I don't have the skills for a real programming job. I haven't even earned my Associate's degree in CS yet.
2. OSS is educational, and other people can learn from me (preferably how to comment and how to document ;-) For instance, to make sure I really understand partitioning, bootblocks, and code relocation, I'm writing (in NASM) a program to load/run drive C's bootsector. It'd be nice if MS did this; I'm sick of not being able to boot with a floppy in A:. Once I'm finished, I can release it as OSS, and other people can learn about FAT12's boot record, HDD partition tables, etc. an easier way.
3. My code doesn't necessarily die with me.
4. I can modify OSS to suit. If I want a particular UI, I can write it. If I want stuff to read from stdin when not given an input, I can code it that way (unlike certain DOS commands).
5. It's a way of getting useful software on a dead platform. If you can take someone's C code, and port the system-specific parts, you can recompile under Storm C and get an Amiga program. (I can't do this, as the A1200/WB3.0 didn't run some A500/WB1.3 stuff, so we still use the 500. But someone could.)

Take #3. That is very unselfish, as the reason it's there is because it annoys me when I come across a project that was top-of-the-line in 1996, but only disassembles, say, Java 1.1 stuff. With no source, it's pretty much stuck there. But useful enough software may be perpetually improved.

There are alot more things on IRC that AI can help with other than trying to chat as if it were a human.

With a sufficient database, a darkbot can be made to respond to various text, and even randomly initiate "conversation" if set up that way. This could be called a simple reflex AI. This happens, do that.

But what's more interresting is to use AI on bots that keep track of alot of information on users on the channels they help protect, and use that information "intelligently" to perform their tasks better (e.g., using this information to determine someone just evaded a channel ban, and that action A should be taken). If made properly, the bot could end up acting like a watchful human channel op, doing whois' on users, recognizing floodnets for what they are, etc.

I have a bot in progress which I intend on builing that kind of stuff into when it gets more mature. It's basically useless right now, but anyways it's available from the tiBot project homepage. Anyone interrested in giving a hand is welcome, the bot is GPL'd.

Temporary restraining order DENIED!

Thanks to the efforts of the Electronic Frontier Foundation and the organization and support provided by a few of our fellow defendants we are still here! Another hearing is scheduled for January 14th.

We would like to point out to all of the mirror sites with things like "fuck the lawyers" on them that it is because of a generous group of lawyers that we are still here. These lawyers are working for free (or much less than they could get by going over to the Dark Side) and don't deserve this kind of abuse.

We have just been informed that the DVD Copy Control Association is seeking a restraining order against us (named as "Doe 28") for distributing DeCSS and linking to pages that distribute it and linking to pages that link to pages that distribute it.

Section 48 of this request states that we supposedly "have received notice through the MPA and refused to remove the information at issue". This is absolutely false! We have never received any such request (from the MPA or anybody else for that matter) and we obviously were not given the opportunity to refuse! Either Jared Bobrow needs to go back to law school or the DVD CCA needs to get a new firm. This is the kind of sloppy work that could get an important document thrown out.

Explanation on legality of this information

The software (source as well as binaries) offered on this site can be freely redistributed because it was published under the GNU General Public License. The purpose of this software is not illegal copying of DVD disks. It is meant to provide information necessary to be able to program a DVD player for Linux. To do this, the CSS system needs to be incorporated in the player. Recently the (very weak) DVD content scrambling system was deciphered, freeing the way for a Linux DVD player. The CSS system is not a copy protection system, since it does not prevent copying of the disk. Writing information about the way an encryption scheme functions is completely legal. The source code and binaries on this site are completely legal too, since they contain no code from the DVD consortium or its members. The sources and programs on this site were written by third parties using clean-room reverse engineering methods which are (ready?) completly legal.

Attention www.rhythm.cx was hosting a list of mirrors for these files. That list of mirrors has been replaced with a page reading "This site has been taken down for legal reasons." Here's what the maintainer put on the site the day it was shut down:

NOTE (Thu, Nov 11, 12:17pm EST): I've recently been informed that a law firm which is likely to be one that would try get these mirrors taken down has been visiting this mirror site as well as others. With that said, there is a possibility that I may have to remove this site in the near future because like everyone else, I can't afford to go to court to fight it. Luckly, it seems fairly unlikely that any law firm will ever be able to get rid of all these mirrors at this point (there are currently 41 in 8 different countries and this list is growing every day). However, I have only seen very few mirror _lists_ like this one anyplace. If anyone has the resources, it might be wise to mirror this list of mirrors as well so that the right people will still know that these mirrors exist.

Temporary restraining order DENIED!

Thanks to the efforts of the Electronic Frontier Foundation and the organization and support provided by a few of our fellow defendants we are still here! Another hearing is scheduled for January 14th.

We would like to point out to all of the mirror sites with things like "fuck the lawyers" on them that it is because of a generous group of lawyers that we are still here. These lawyers are working for free (or much less than they could get by going over to the Dark Side) and don't deserve this kind of abuse.

We have just been informed that the DVD Copy Control Association is seeking a restraining order against us (named as "Doe 28") for distributing DeCSS and linking to pages that distribute it and linking to pages that link to pages that distribute it.

Section 48 of this request states that we supposedly "have received notice through the MPA and refused to remove the information at issue". This is absolutely false! We have never received any such request (from the MPA or anybody else for that matter) and we obviously were not given the opportunity to refuse! Either Jared Bobrow needs to go back to law school or the DVD CCA needs to get a new firm. This is the kind of sloppy work that could get an important document thrown out.

Explanation on legality of this information

The software (source as well as binaries) offered on this site can be freely redistributed because it was published under the GNU General Public License. The purpose of this software is not illegal copying of DVD disks. It is meant to provide information necessary to be able to program a DVD player for Linux. To do this, the CSS system needs to be incorporated in the player. Recently the (very weak) DVD content scrambling system was deciphered, freeing the way for a Linux DVD player. The CSS system is not a copy protection system, since it does not prevent copying of the disk. Writing information about the way an encryption scheme functions is completely legal. The source code and binaries on this site are completely legal too, since they contain no code from the DVD consortium or its members. The sources and programs on this site were written by third parties using clean-room reverse engineering methods which are (ready?) completly legal.

Attention www.rhythm.cx was hosting a list of mirrors for these files. That list of mirrors has been replaced with a page reading "This site has been taken down for legal reasons." Here's what the maintainer put on the site the day it was shut down:

NOTE (Thu, Nov 11, 12:17pm EST): I've recently been informed that a law firm which is likely to be one that would try get these mirrors taken down has been visiting this mirror site as well as others. With that said, there is a possibility that I may have to remove this site in the near future because like everyone else, I can't afford to go to court to fight it. Luckly, it seems fairly unlikely that any law firm will ever be able to get rid of all these mirrors at this point (there are currently 41 in 8 different countries and this list is growing every day). However, I have only seen very few mirror _lists_ like this one anyplace. If anyone has the resources, it might be wise to mirror this list of mirrors as well so that the right people will still know that these mirrors exist.

Thanks to the efforts of the Electronic Frontier Foundation and the organization and support provided by a few of our fellow defendants we are still here! Another hearing is scheduled for January 14th.

We would like to point out to all of the mirror sites with things like "fuck the lawyers" on them that it is because of a generous group of lawyers that we are still here. These lawyers are working for free (or much less than they could get by going over to the Dark Side) and don't deserve this kind of abuse.

We have just been informed that the DVD Copy Control Association is seeking a restraining order against us (named as "Doe 28") for distributing DeCSS and linking to pages that distribute it and linking to pages that link to pages that distribute it.

Section 48 of this request states that we supposedly "have received notice through the MPA and refused to remove the information at issue". This is absolutely false! We have never received any such request (from the MPA or anybody else for that matter) and we obviously were not given the opportunity to refuse! Either Jared Bobrow needs to go back to law school or the DVD CCA needs to get a new firm. This is the kind of sloppy work that could get an important document thrown out.

Explanation on legality of this information

The software (source as well as binaries) offered on this site can be freely redistributed because it was published under the GNU General Public License. The purpose of this software is not illegal copying of DVD disks. It is meant to provide information necessary to be able to program a DVD player for Linux. To do this, the CSS system needs to be incorporated in the player. Recently the (very weak) DVD content scrambling system was deciphered, freeing the way for a Linux DVD player. The CSS system is not a copy protection system, since it does not prevent copying of the disk. Writing information about the way an encryption scheme functions is completely legal. The source code and binaries on this site are completely legal too, since they contain no code from the DVD consortium or its members. The sources and programs on this site were written by third parties using clean-room reverse engineering methods which are (ready?) completly legal.

Attention www.rhythm.cx was hosting a list of mirrors for these files. That list of mirrors has been replaced with a page reading "This site has been taken down for legal reasons." Here's what the maintainer put on the site the day it was shut down:

NOTE (Thu, Nov 11, 12:17pm EST): I've recently been informed that a law firm which is likely to be one that would try get these mirrors taken down has been visiting this mirror site as well as others. With that said, there is a possibility that I may have to remove this site in the near future because like everyone else, I can't afford to go to court to fight it. Luckly, it seems fairly unlikely that any law firm will ever be able to get rid of all these mirrors at this point (there are currently 41 in 8 different countries and this list is growing every day). However, I have only seen very few mirror _lists_ like this one anyplace. If anyone has the resources, it might be wise to mirror this list of mirrors as well so that the right people will still know that these mirrors exist.
