That would be great if they would make it a patent issue, because the constitution was not intended to have one play off the other, creating a "super monopoly" The arrogance of the MPAA is stupefying though, because that's exactly what they are trying to do.

There was a discussion about this on openlaw. Not so much that they have patents (I'm sure somebody does, knowing how the PTO is patenting the time of day now), but that they are using their copyright in a patent like manner,

One aarguement for the new batch of software players is that software patents can't preempt mathematical algorithyms, which the new brute forcing dvd player does now. (In fact the DeCSS code doesn't work on new disks as the Xing key was revoked). See here.

In other less than stellar news Senator Leahy made this statement today:

Perhaps someone ought to let them know, then. With apologies for the tone of that response, I do think the concern about a legal ruling on linking isn't completely FUD.

My concern is that any law that is enforceable based on the intent of the offender can be abusively (selectively) enforced. I'm sure there are a number of people out there who would be happier if 2600 were silenced. This may be the case, but it should not be why 2600 is litigated for this violation, and others are not.

Linking itself, and hypertext, is the foundation of the web as we know it today. We're posting on the web now, and not gopher, because of the ease of navigation brought on by hypertext on the web. Free links propagated the web. Restricting links conceivably could irreparably damage it. Therefore, it is reasonable to be concerned about limitations on that ability to freely link, for reasons other than fear, uncertainty and doubt.

Lastly, it is interesting that the definition of a link is the href, and not the address.

So...

I guess it just depends on what the definition of link is.

The source audit is what makes the difference. There are various projects for secure Linux distros like Bastille, Nexus and Khaos. For the most part they only fix configuration errors, things like not enabling every service by default, correct file permissions, etc.

However, this will not catch coding errors. If there's a bug in the kernel or in a service that you happen to be running, you're still vulnerable. Only Kha0s has a goal of doing a source audit which seems to be going very slowly.

In fact, given what it produces, I'm not sure there is much difference to tell between his head and his ass.

Hey Judge! You just passed a ruling that might allow (to use a hypothetical example) "http://www.dumbfuckjudge.com", while forbidding "a href=http://www.dumbfuckjudge.com" in angle brackets. That's the only difference, you moron. Everybody who uses the web at all knows how to paste a text reference, so this doesn't stop anybody, and creates a new restriction that is completely unreasonable. Get off the damned bench! I disagree. Encryption, even non-hardware assisted, is easy to have setup.

Look at theTEA project (Transparent Encryption Agent), or look at the methods for transparent PGP of mail I outlined in Gnu Privacy Guard tutorial, part 2 towards the end of the document.

So, unlike your tank cars, this can be implemented easyily and quickly -- with no extra material cost. Replication of software and data through computers is essentially cost free, which how the GNU project can get away with giving away free [libre, beer] software :-)

I'd prefer constant, perversive encryption to having someone listen into even the most insignificant private conversation I hold any day.

There's a web site http://www.lemuria.org/Software/unpoison that calls this technique "URL Poisoning" and mentions that this could be considered a Bad Thing, because using this technique, people cannot easily "opt out" from being profiled, as you can by, say, disabling cookies in your browser.

Refer to the above link for an explanation of URL Poisoning, and for a pointer to a Squid redirector plugin that can be used to disable URL poisoning.

I personally don't have any opinion on this; I can see how it can be used, as well as how it could be abused. [shrug]

It's call Unpoison..

I believe that site was foreign in nature if that means anything at all.... (maybe that site uses PHP3's feature??)

Basically, the site Unpoison is made for assigns a unique umpteen-bit hexademcial number to you (and stores it somewhere) that is appended to their site's URL-- then they set up a program that decodes this information automagically (and retrieves all of your data).

The bad thing about how this company does it is you have no way to shut it off. With cookies, you do. That makes me sad.

As customer, you are paying, so that the company owning the web-pages can profile you. Not only is tracking the default, there also is no way out, no "I don't wanna be tracked" button.

With "paying" I do literally mean money and time. Location Poisoning disables proxy servers, DNS caching and other mechanisms that reduce the amount of net traffic. More traffic means waiting longer for pages to appear, and if you pay for your traffic (most small businesses do) it also means you are paying money that you shouldn't have to pay.

Location Poisoning also abuses HTTP and DNS standards. The reply to an initial request is a 302 error code, reserved for "Temporarily Moved" documents. Giving this reply is somewhat akin to a lie by the remote webserver.

Abusing standards for one-sided gains should not be endorsed. It undermines the standards and punishes those who try to respect them.

I read on Lemuria.org that the Windows version was "proof of concept" software. That means it was created as a test. I often do this when I'm designing complex programs. I'll design a piece of code and then put it into a prototype program so that I can run tests on it to make sure it will work, then I usually either try to integrate it into the main program I'm designing or work on the other parts of the program until it was ready to be integrated.

Since this code was meant to be tinkered with by anyone in the OS community, the appropriate thing to do was release the source code to the Web, where anyone can make it into whatever they want.

Incidentally, it is not illegal to copy DVD disks, by that logic, CD duplicators would be illegal. (I know I've seen one advertised on TV from Philips, so if it is they are going to get caught soon.)

So, the fact that DeCSS can be used in the ungainly and useless for piracy purposes task (currently) of copying huge VOB files to a hard drive does not make it illegal, per se.

2600 is calling for demonstrations against the MPAA, and I for one agree. We need to educate ordinary people on the fact that their right to free speech is in serious jeopardy thanks to the greed and stupidity of an organization (the MPAA) that fell for the DVD-security snake oil and can't admit that it's been had.

If you're not a member of EFF or the ACLU, join now.
If you are a member, or want to be more active, contact your local 2600 cell or Linux User's Group and help to organize a demonstration.
If you have a DVD player, and you're too sick to even look at it, consider donating it to a local Geeks with Guns outing, in exchange for plenty of photos. Post them on a website, and mail them to DVD CAA and the members of the MPAA (listed on the 2600 announcement of the injunction).
Consider buying a DeCSS source shirt; or if you're really radical, consider becoming a DOE (one of the 500+ anonyous people mentioned in the first injunction hearing).
Boycott movies and videos until the MPAA drops the lawsuit!
Most importantly: SPREAD THE WORD to other geeks and non-geeks. This is too important for us to keep silent!

This and the Etoy lawsuit are probably the most significant fights to hit our commmunity since the Clipper Chip fiasco. The lines are drawn, ladies and gentlemen; we need to fight with everything we've got to prevent Internet from becoming nothing but a huge, suburban shopping mall. Get involved in an historical fight and have something that you'll be proud to tell your kids and grandkids about, twenty years from now.

Section 48 of this request states that we supposedly "have received notice through the MPA and refused to remove the information at issue". This is absolutely false! We have never received any such request (from the MPA or anybody else for that matter) and we obviously were not given the opportunity to refuse! Either Jared Bobrow needs to go back to law school or the DVD CCA needs to get a new firm. This is the kind of sloppy work that could get an important document thrown out.

Explanation on legality of this information

The software (source as well as binaries) offered on this site can be freely redistributed because it was published under the GNU General Public License. The purpose of this software is not illegal copying of DVD disks. It is meant to provide information necessary to be able to program a DVD player for Linux. To do this, the CSS system needs to be incorporated in the player. Recently the (very weak) DVD content scrambling system was deciphered, freeing the way for a Linux DVD player. The CSS system is not a copy protection system, since it does not prevent copying of the disk. Writing information about the way an encryption scheme functions is completely legal. The source code and binaries on this site are completely legal too, since they contain no code from the DVD consortium or its members. The sources and programs on this site were written by third parties using clean-room reverse engineering methods which are (ready?) completly legal.

Attention www.rhythm.cx was hosting a list of mirrors for these files. That list of mirrors has been replaced with a page reading "This site has been taken down for legal reasons." Here's what the maintainer put on the site the day it was shut down:

With that said, there is a possibility that I may have to remove this site in the near future because like everyone else, I can't afford to go to court to fight it. Luckly, it seems fairly unlikely that any law firm will ever be able to get rid of all these mirrors at this point (there are currently 41 in 8 different countries and this list is growing every day). However, I have only seen very few mirror _lists_ like this one anyplace. If anyone has the resources, it might be wise to mirror this list of mirrors as well so that the right people will still know that these mirrors exist.

Come show your support of this cause. We want the judge to understand how much people/consumers care about this case. But dress appropriately.

We're trying to show the judge that we are not a bunch of copyright-infringing, trade-secret stealing hooligans.

Nice clothes go a long way to help prove this point.

We would like to point out to all of the mirror sites with things like "fuck the lawyers" on them that it is because of a generous group of lawyers that we are still here. These lawyers are working for free (or much less than they could get by going over to the Dark Side) and don't deserve this kind of abuse.

Either Jared Bobrow needs to go back to law school or the DVD CCA needs to get a new firm. This is the kind of sloppy work that could get an important document thrown out.

Explanation on legality of this information

The software (source as well as binaries) offered on this site can be freely redistributed because it was published under the GNU General Public License. The purpose of this software is not illegal copying of DVD disks. It is meant to provide information necessary to be able to program a DVD player for Linux. To do this, the CSS system needs to be incorporated in the player. Recently the (very weak) DVD content scrambling system was deciphered, freeing the way for a Linux DVD player. The CSS system is not a copy protection system, since it does not prevent copying of the disk. Writing information about the way an encryption scheme functions is completely legal. The source code and binaries on this site are completely legal too, since they contain no code from the DVD consortium or its members. The sources and programs on this site were written by third parties using clean-room reverse engineering methods which are (ready?) completly legal.

Attention www.rhythm.cx was hosting a list of mirrors for these files. That list of mirrors has been replaced with a page reading "This site has been taken down for legal reasons." Here's what the maintainer put on the site the day it was shut down:

NOTE (Thu, Nov 11, 12:17pm EST): I've recently been informed that a law firm which is likely to be one that would try get these mirrors taken down has been visiting this mirror site as well as others. With that said, there is a possibility that I may have to remove this site in the near future because like everyone else, I can't afford to go to court to fight it. Luckly, it seems fairly unlikely that any law firm will ever be able to get rid of all these mirrors at this point (there are currently 41 in 8 different countries and this list is growing every day). However, I have only seen very few mirror _lists_ like this one anyplace. If anyone has the resources, it might be wise to mirror this list of mirrors as well so that the right people will still know that these mirrors exist.

Earlier, on the advice of legal counsel, I was advised against giving my name while talking to Emmett, but I've come to realize that "duck and run" isn't the most effective course of action when being hit with suits like this. I've taken down my mirror temporarily, and I look forward to putting at back up as soon as I hear something about the decision (I am on the opposite side of the country). It'll be interesting to see how everything pans out this morning.

Actually I am looking forward to Oni (in fact it's the only game I'm looking forward to). I've been told Halo is cool but it's still an FPS to me. I'm sure it'll be a good one but that's kinda like a good Yugo.

I think a great way to develop game software would be to make a new game. Every game I've seen has been a rehashing of the same old crap over and over again (yeah yeah Halflife blah blah blah). I now hate 1st person shooters and am getting pretty damn sick of Command and Conquer clones too. I'm pretty sure I could get a quick turn around on a game if I were useing a cookie cutter too.
