The London Riots and Facial Recognition Technology
nonprofiteer writes "A bunch of vigilantes are organizing a Google Group dedicated to using recently revealed facial recognition tools to identify looters in the London riots. While Vancouver discussed doing something similar after the Stanley Cup riots, the city never actually moved forward on it. Ring of Steel London, though, is far more likely to incorporate FRT into its investigative work." A related article points out how development of face-recognition technology has been kept under wraps by some organizations, but we're getting to the point where it'll soon be ubiquitous. -
Seigniorage Hack Could Resolve Debt Limit Crisis
UltraOne writes "With the US Senate voting to table the Boehner debt limit bill, the US is only a few days away from running out of cash to pay for all its obligations. Slate is reporting on a fascinating legal hack that could come in handy, described by blogger 'beowulf' back in January 2011. Seigniorage is the extra value added when a government mints a coin with a face value greater than the value of the precious metal contained in the coin. The statute governing the minting of coins contains a section (31 USC 5112(k) ) that authorizes the Secretary of the Treasury to mint and issue platinum coins in any denomination or quantity. To keep the government from running out of money, Timothy Geithner could order a $5 trillion platinum coin struck and deposited at the Federal Reserve. The money could then be used to fund Federal Government operations (blog post contains legal details)." -
Fond Memories of Nerd Camp
Slate's "Summer Camp" issue has revived a piece from a few years back recounting author Meghan O'Rourke's experience as a student at "nerd camp." O'Rourke was a student at Johns Hopkin's CTY program (bias alert: so was I, and remain a fan), but I suspect there's a lot in common with the various Governor's Schools and programs like Duke's TIP. Cut Down On Nukes To Shave the Deficit
Hugh Pickens writes "Joe Cirincione writes in the Atlantic that the US government is set to spend almost $700 billion on nuclear weapons over the next 10 years, roughly as much as it spent on the war in Iraq over the last decade. Most of the money will be spent without any clear guidance on how many weapons we need and for what purpose. As long as nuclear weapons exist, we will need some to deter nuclear threats from others, but do we really need to duplicate the entire nuclear triad for another 50 years? 'The Pentagon budget includes funds to develop a new fleet of 12 nuclear-armed submarines with an estimated cost of $110 billion, according to the Congressional Budget Office. Also planned is $55 billion for 100 new bombers, and a new missile to replace the recently upgraded 450 Minutemen III intercontinental ballistic missiles. ... The consensus among military officials and bipartisan security experts is that nuclear reductions enhance US national security,' writes Cirincione. As the Nuclear Posture Review says, 'Our most pressing security challenge at present is preventing nuclear proliferation and nuclear terrorism, for which a nuclear force of thousands of weapons has little relevance.'" -
Slate: Amazon's Tax Stance Unfair and Unethical
theodp writes "We've talked before about Amazon's reluctance to collect sales tax, with Jeff Bezos going so far as to say it's unconstitutional. So it's not too surprising to see Amazon support a California referendum to repeal sales tax for online retailers. Slate's Farhad Manjoo loves buying from Amazon and would hate to pay higher prices, but says the e-tailer 'has no intellectually sound arguments against collecting taxes from residents — by all ethical and civic standards, its position is unsound.'" -
Court on Video Games: Less Cleavage, More Carnage
On Monday we discussed news of a Supreme Court ruling which held that violent video games deserved free speech protection under the First Amendment. Now, frequent Slashdot contributor Bennett Haselton writes with this followup that questions the Court's consistency in such matters. "I'm glad the Supreme Court struck down the California law against selling violent video games to minors, but reading over the decision, I had the odd feeling that the arguments by the dissenters made more sense than the majority — mainly because of the hypocrisy of continuing to ban sexuality while giving violence a pass." Read on for the rest of Bennett's thoughts.John Landis said, "R is when you bare a woman's breast, PG is when you cut it off." That is apparently now also the law of the land regarding video games, according to the Supreme Court's June 27th decision (PDF) overturning a California law that banned sales of violent video games to minors. I'm glad the Supreme Court struck down the law, but reading over the decision, I had the odd feeling that even though I agreed with the majority's conclusion, the actual arguments made by the dissenters made more sense, primarily because of the hypocrisy of the majority in treating sex as more taboo than violence.
The majority opinion, written by Scalia, has already been widely quoted as a ringing defense of free speech:
"Reading Dante is unquestionably more cultured and intellectually edifying than playing Mortal Kombat. But these cultural and intellectual differences are not constitutional ones. Crudely violent video games, tawdry TV shows, and cheap novels and magazines are no less forms of speech than The Divine Comedy, and restrictions upon them must survive strict scrutiny..."
But Scalia continues to believe that the government does have the right to ban the sale of nudity and sexuality to minors (as decided in the Supreme Court's 1968 Ginsberg v. New York decision), just not violence. So he kept qualifying statements like the one above by adding "except for pornography", like a judicial version of the fortune cookie "in bed" game:
"[A]s a general matter, . . . government has no power to restrict expression because of its message, its ideas, its subject matter, or its content... There are of course exceptions. These limited areas, such as obscenity... represent well-defined and narrowly limited classes of speech, the prevention and punishment of which have never been thought to raise any Constitutional problem."
...
"Speech that is neither obscene as to youths nor subject to some other legitimate proscription cannot be suppressed solely to protect the young from ideas or images that a legislative body thinks unsuitable for them."So he's continuing the Supreme Court's tradition of carving out of a First Amendment exception for sex, but won't make one for gratuitous violence. I would be against banning either type of content, but if I were forced to ban one of the two, I would definitely pick violence. Wouldn't you?
As Steven Breyer wrote in his dissent:
"But what sense does it make to forbid selling to a 13-year-old boy a magazine with an image of a nude woman, while protecting a sale to that 13-year-old of an interactive video game in which he actively, but virtually, binds and gags the woman, then tortures and kills her? What kind of First Amendment would permit the government to protect children by restricting sales of that extremely violent video game only when the woman -- bound, gagged, tortured, and killed -- is also topless?"
Well, he's right, isn't he? Except he misses the point that perhaps the remedy is not to ban violent video games, but to overturn the precedent that photos of topless women are harmful.
Alito seemed to agree with Breyer, when he wrote in a decision joined by Roberts:
"Victims by the dozens are killed with every imaginable implement, including machine guns, shotguns, clubs, hammers, axes, swords, and chainsaws. Victims are dismembered, decapitated, disemboweled, set on fire, and chopped into little pieces. They cry out in agony and beg for mercy... The objective of one game is to rape a mother and her daughters; in another, the goal is to rape Native American women."
(Alito was technically not dissenting, because he agreed that the current law was impermissibly vague, but filed a separate opinion because he was at pains to emphasize that he thought some future law against violent video games might be constitutional.) The implication seems clear: "If we can ban some things for minors — like pornography — then good God, can't we ban this stuff too?"
Scalia, in his majority opinion, responds to Alito's description of game violence: "Justice Alito recounts all these disgusting video games in order to disgust us — but disgust is not a valid basis for restricting expression." But this is just hypocritical — because Scalia, throughout his own decision, kept deferring to the Ginsberg Supreme Court ruling, which said that the government could ban porn sales to minors if it depicted sex acts in way that the "average person" would consider "patently offensive with respect to what is suitable for minors" (along with some other criteria). In other words, if it causes disgust.
Breyer and Alito also made similar arguments to each other on another reasonable-sounding point — that industry self-regulation might not last long, now that the law has been struck down. As Alito wrote:
"The Court does not mention the fact that the industry adopted this system in response to the threat of federal regulation, Brief for Activision Blizzard, Inc., as Amicus Curiae 7-10, a threat that the Court's opinion may now be seen as largely eliminating. Nor does the Court acknowledge that compliance with this system at the time of the enactment of the California law left much to be desired — or that future enforcement may decline if the video-game industry perceives that any threat of government regulation has vanished."
Breyer agreed:
"And the industry could easily revert back to the substantial noncompliance that existed in 2004, particularly after today's broad ruling reduces the industry's incentive to police itself."
This sounds more realistic than Scalia's recitation of the video game industry party line:
"The video-game industry has in place a voluntary rating system designed to inform consumers about the content of games... This system does much to ensure that minors cannot purchase seriously violent games on their own, and that parents who care about the matter can readily evaluate the games their children bring home."
What do you want to bet that Breyer and Alito are right, and enforcement of the rating system will decline now?
Compare this with another case, when Communications Decency Act of 1996 (essentially banning the "seven dirty words" on the Internet) was struck down in 1997 at least in part because a "less restrictive means" existed for censoring content in the home — parental blocking software. I didn't like blocking software much, but as a statement of fact, it existed, and was a less restrictive means than the law. The crucial difference there was that parents who used blocking software, weren't using it in response to a government threat of legislation, they were using it because they wanted to, and didn't stop using it after the law was struck down. There's no reason to think the same is true for industry self-applied video game ratings.
Finally, Breyer (but not Alito) rejected the argument that the California law should be struck down for vagueness, arguing that it was no more vague than laws against selling pornography minors, which the court had upheld:
"Comparing the language of California's statute (set forth supra, at 1-2) with the language of New York's statute (set forth immediately above), it is difficult to find any vagueness-related difference. Why are the words "kill," "maim," and "dismember" any more difficult to understand than the word "nudity?" ... California only departed from the Miller formulation [the Supreme Court case that defined obscenity] in two significant respects: It substituted the word "deviant" for the words "prurient" and "shameful," and it three times added the words "for minors." The word "deviant" differs from "prurient" and "shameful," but it would seem no less suited to defining and narrowing the reach of the statute."
Well, I think he's right. They're all just words, and they don't have crystal clear boundaries, but you pretty much know what they mean, and there's no reason why one group of words is more vague than the other. (In fact, in a 2008 article I argued that you could measure scientifically the vagueness of a law — just show the law to different test subjects, along with some made-up scenarios, and ask whether those scenarios violated the law or not. I'm quite confident that if you applied that test to these two different laws, you would measure about the same level of "vagueness".)
Again, I don't accept the justices' premise that the government has any business banning the sale of either sexual or violent content. But if you're going to grant the premise that they can and should, then Alito and/or Breyer seem to have made better arguments than the majority on at least those three points: That violence probably deserves less constitutional protection than sex, that the industry isn't likely to keep regulating itself if they no longer think they have to, and there's no reason that "kill" and "maim" are any more vague than "nudity".
(By the way, when I say the "dissenters sounded more reasonable", I am not including Clarence Thomas, whose entire solo dissent was devoted to research showing that the Founding Fathers did not believe people under 18 had First Amendment rights at all. If Clarence Thomas thought really hard, could he think of any other category of people who were denied full civil rights in the 1700s, and hence why we wouldn't want to apply that standard today?)
Fortunately, the majority did get the most important point right, which is that studies do not show a causal relationship between video game playing and real-life acts of violence. As Scalia wrote:
"The State's evidence is not compelling. California relies primarily on the research of Dr. Craig Anderson and a few other research psychologists whose studies purport to show a connection between exposure to violent video games and harmful effects on children. These studies have been rejected by every court to consider them, and with good reason: They do not prove that violent video games cause minors to act aggressively (which would at least be a beginning). Instead, "[n]early all of the research is based on correlation, not evidence of causation, and most of the studies suffer from significant, admitted flaws in methodology." Video Software Dealers Assn. 556 F. 3d, at 964. They show at best some correlation between exposure to violent entertainment and minuscule real-world effects, such as children's feeling more aggressive or making louder noises in the few minutes after playing a violent game than after playing a nonviolent game."
Unfortunately, Scalia lacked the nerve to say that this point should have been the only point that mattered, in a society where freedom is the default unless there's a good reason to the contrary. Because the logical consequence of that, would have been that since the "evidence" for the harmful effects of pornography is even weaker, then the government has no business banning that, either.
The problem constraining all nine justices is that they felt bound by the prior Ginsberg ruling making it permissible to ban sales of pornography to minors, so their options were limited to (a) striking down the video game law while ignoring the hypocrisy of continuing to ban pornography, or (b) pointing out that violent video games are probably at least as distasteful. This ignores the possibility that they could have just (c) overturned their prior ruling, as they have done many times before.
If I were a justice writing for the majority, my whole opinion would be:
Well, we can only make an exception to the First Amendment if there's solid evidence of real harm, and there is no scientifically valid evidence of harm here, so the law violates the First Amendment and is struck down. Oh, and that goes for Ginsberg too, next time it comes up. How much did you guys pay for law school again?
Unfortunately, Obama has said that he's looking for Supreme Court candidates that display "empathy", and what I said would probably hurt the other justices' feelings, so don't hold your breath for my being nominated.

He plans on using sonar, and a remotely operated submersible. If he finds the remains, he'll photograph them to confirm Bin Laden's death to the world. Warren says, 'There is still a $25 million reward that no one has collected, and the reward says dead or alive, well, if -- in fact -- he is dead, then I could collect the $25 million reward. Why not?'" -
Why Doesn't 'Google Kids' Exist?
theodp writes "Slate's Michael Agger wishes there was a website his 6-year-old son could visit on his own to watch amateur Star Wars Lego movies and other stuff he's curious about. 'But I don't leave him alone on YouTube,' he laments, 'because I never know if some strange-ass video will appear in the 'Related Videos' section.' Agger suggests that Google should create Google Kids, a search engine that filters the Web for children. 'Think back to when you were a kid and your parents dropped you off at the library,' explains Agger. 'In the children's section, the only "inappropriate" stuff to be found was Judy Blume's Forever, which someone's older sister had usually already checked out anyway. Similarly, Google Kids would be a sort of children's section of the Web, focused on providing high-quality results based on age.'" -

Gamification — How Much of It Is Really New?

NASA's 'Arsenic Microbe' Science Under Fire
radioweather writes "The cryptic press release NASA made last week that set the blogosphere afire with conjecture, which announced: 'NASA will hold a news conference at 2 p.m. EST on Thursday, Dec. 2, to discuss an astrobiology finding that will impact the search for evidence of extraterrestrial life.' may be a case of 'go fever' science pushed too quickly by press release. A scathing article in Slate.com lists some very prominent microbiologists who say the NASA-backed study is seriously flawed and that the finding may be based on something as simple as poor sample washing to remove phosphate contamination. One of the scientists, Shelley Copley of the University of Colorado said 'This paper should not have been published,' while another, John Roth of UC-Davis says: 'I suspect that NASA may be so desperate for a positive story that they didn't look for any serious advice from DNA or even microbiology people,' The experience reminded some of another press conference NASA held in 1996. Scientists unveiled a meteorite from Mars in which they said there were microscopic fossils. A number of critics condemned the report (also published in Science) for making claims it couldn't back up." -
Every Day's a Tax Holiday At Amazon

Unless you live in KS, KY, NY, ND, or WA, you'll pay no sales tax on many purchases from Amazon, giving Amazon a huge — and largely hidden — price advantage over most other national retailers. Amazon CEO Jeff Bezos is certainly no fan of taxes — he explored founding Amazon on an Indian reservation, and recently ponied up $100,000 to defeat a proposed WA state income tax, a good investment for someone who's cashed in close to $800,000,000 in Amazon stock this year alone. So, is Amazon's tax-free status unfair? Of course it is, says Manjoo. Amazon has physical operations in 17 states in which the company and its employees enjoy the fruits of local taxes — police and fire protection, roads, hospitals, and other infrastructure that make its operations possible. Yet Amazon skirts tax collection in most of these places through clever legal tricks." -

British Airways Chief Slams US Security Requests
Ponca City writes "Reflecting a growing frustration among airport and airline owners with the steady build-up of rules covering everything from footwear to liquids, Martin Broughton, chairman of British Airways, has launched a scathing attack on the 'completely redundant' airport checks requested by the TSA and urged the UK to stop 'kowtowing' to American demands for ever more security. Speaking at the annual conference of the UK Airport Operators Association, Broughton lambasted the TSA for demanding that foreign airports increase checks on US-bound planes, while not applying those regulations to their own domestic services. 'America does not do internally a lot of the things they demand that we do,' says Broughton. 'We shouldn't stand for that. We should say, "We'll only do things which we consider to be essential and that you Americans also consider essential.''' For example, Broughton noted that cutting-edge technology recently installed at airports can scan laptops inside hand luggage for explosives but despite this breakthrough the British government still demands computers be examined separately. How to Heartlessly Arbitrage Used Books With a PDA
Pickens writes "Michael Savitz writes at Salon how he makes a living armed with a laser bar-code scanner fitted to a Dell PDA. Savitz haunts thrift stores and library book sales to scan hundreds of used books a day and instantly identify those that will get a good price on Amazon Marketplace. 'My PDA shows the range of prices that other Amazon sellers are asking for the book in question,' writes Savitz. 'Those listings offer me guidance on what price to set when I post the book myself and how much I'm likely to earn when the sale goes through.' Savitz writes that on average, only one book in 30 will have a resale value that makes it a "BUY" but that he goes through enough books to average about 30 books sold per day. 'If I can tell from a book's Amazon sales rank that I'll be able to sell it in one day, I might accept a projected profit of as little as a dollar. The more difficult a book will be to sell, the more money the sale needs to promise.' Savitz writes that people scanning books sometimes get kicked out of thrift stores and retail shops and that libraries are beginning to advertise that no electronic devices are allowed at their sales. 'If it's possible to make a decent living selling books online, then why does it feel so shameful to do this work?' concludes Savitz." -
Technological Genius Is Timeliness, Not Inspiration
Hugh Pickens writes "Ezra Klein has an interesting essay in the Washington Post about 'simultaneous invention,' where technology advances to the point that the next step is obvious to multiple people at once, and so they all push forward with the same or similar inventions. While the natural capabilities of human beings don't change much from year to year, their environments do, and so does the technology and store of knowledge they can access. 'The idea of the lone genius who has the eureka moment where they suddenly get a great idea that changes the world is not just the exception,' says Steven Johnson, author of Where Good Ideas Come From: The Natural History of Innovation, 'but almost nonexistent.' Consider Adam Goldberg's CU Community, created in 2003 at Columbia University, a social network that launched first and had cooler features than Facebook, with options for pictures and integrated blogging software. Klein writes, 'Zuckerberg's dominance can be attributed partly to the clean interface of his site, partly to the cachet of the Harvard name and partly to luck. But the difference between Mark Zuckerberg and Adam Goldberg was very small, while the difference between what Mark Zuckerberg could do and what the smartest college kid in 1999 could do was huge. It was the commons supporting them both that really mattered.'" -

Wikipedia Entry Turned Into Actual Encyclopedia

Time Magazine reports that technology writer James Bridle has created a 12-volume compendium of every edit made to the Wikipedia entry for the Iraq War between December 2004 and November 2009. 'It contains arguments over numbers, differences of opinion on relevance and political standpoints, and frequent moments when someone erases the whole thing and just writes "Saddam Hussein was a dickhead.,"' writes Bridle. 'This is historiography. This is what culture actually looks like: a process of argument, of dissenting and accreting opinion, of gradual and not always correct codification.' The books presumably only exist in one copy, so they are not for sale." -
Rackspace Shuts Down Quran-Burning Church's Sites
theodp writes "In response to a complaint, Rackspace has shut down the websites of the Dove World Outreach Center, a small 50-member church which has received national and international criticism for a planned book burning of the Quran on the anniversary of the 9-11 attacks. The center 'violated the hate-speech provision of our acceptable-use policy,' explained Rackspace spokesman Dan Goodgame. 'This is not a constitutional issue. This is a contract issue,' said Goodgame, who added he did not know how long it had hosted the church's sites. Take database technology startup RethinkDB, whose old-school recruiting effort — job boards, external recruiters — yielded hundreds of resumes, dozens of phone screens, and numerous four-hour meetings with viable candidates, but no one who fit their criteria. 'They [recruiters] can't tell the difference between the competent ones and the stars,' complained Y Combinator's Paul Graham. Should Cities Install Moving Sidewalks?

'They can travel fast over long distances with the TGV (high-speed train) or airplanes, but not over short distances (under 1 km).' Slate's Tom Vanderbilt explores whether moving walkways might be viable for urban transportation. The first moving sidewalks were unveiled at Chicago's 1893 Columbian Exposition, and at one point seemed destined to supplant some subways, but never took root in cities for a variety of reasons. Vanderbilt turns to science fiction for inspiration, where 30 mph walkways put today's tortoise-like speed ranges of .5-.83 m/s to shame. In the meantime, Jerry Seinfeld will just have to learn to live with 'the people who get onto the moving walkway and just stand there. Like it's a ride.'" -
Parasite Correlated With World Cup Success

Toxo can be found in almost every type of mammal, from rats to humans. The overall goal of the parasite is to end up in a feline stomach, which is the only place it can reproduce. In other mammals, humans for example, the parasite heads for the brain. It is estimated that nearly 1/3 of the human population has a latent Toxo infection, with individual countries having infection rates varying from 6% (Korea) to 92% (Ghana). Countries with greater incidence of this parasitic infection in their populations tend to win more World Cups than those without. The article, written by a Stanford University neuroscientist, goes on to try out various rationales for such a correlation, ranging from increased testosterone to increased dissent of authority — all symptoms of a Toxo infection. Now we just need to find a parasite that causes an inability to referee properly, and we'll have this whole World Cup business all sorted out." -

Apple's origins were pure Woz, but the Mac, the iPod, the iPhone, and the iPad are the products of the company's other Steve. Jobs' ideas have always been in tension with Woz's brand of idealism and openness. Crazy as it seems, Apple Inc. — the creator of the personal computer — is leading the effort to exterminate it. US Government Poisoned Alcohol During Prohibition
Hugh Pickens writes "Pulitzer Prize-winning science journalist Deborah Blum has an article in Slate about the US government's mostly forgotten policy in the 1920s and 1930s of poisoning industrial alcohols manufactured in the US to scare people into giving up illicit drinking during Prohibition. Known as the 'chemist's war of Prohibition,' the federal poisoning program, by some estimates, killed at least 10,000 people between 1926 and 1933. The story begins with ratification of the 18th Amendment in 1919, which banned sale and consumption of alcoholic beverages in the US. By the mid-1920s, when the government saw that its 'noble experiment' was in danger of failing, it decided that the problem was that readily available methyl (industrial) alcohol — itself a poison — didn't taste nasty enough. The government put its chemists to work designing ever more unpalatable toxins — adding such chemicals as kerosene, brucine (a plant alkaloid closely related to strychnine), gasoline, benzene, cadmium, iodine, zinc, mercury salts, nicotine, ether, formaldehyde, chloroform, camphor, carbolic acid, quinine, and acetone. In 1926, in New York City, 1,200 were sickened by poisonous alcohol; 400 died. The following year, deaths climbed to 700. These numbers were repeated in cities around the country as public-health officials nationwide joined in the angry clamor to stop the poisoning program. But an official sense of higher purpose kept it in place, while lawmakers opposed to the plan were accused of being in cahoots with criminals and bootleggers. The chief medical examiner of New York City during the 1920s, one of the poisoning program's most outspoken opponents, liked to call it 'our national experiment in extermination.'" -

'A respected Swiss scientist, Conrad Gessner, might have been the first to raise the alarm about the effects of information overload. In a landmark book, he described how the modern world overwhelmed people with data and that this overabundance was both "confusing and harmful" to the mind. The media now echo his concerns with reports on the unprecedented risks of living in an "always on" digital environment. It's worth noting that Gessner, for his part, never once used e-mail and was completely ignorant about computers. That's not because he was a technophobe but because he died in 1565.' The best line comes near then end: 'The writer Douglas Adams observed how technology that existed when we were born seems normal, anything that is developed before we turn 35 is exciting, and whatever comes after that is treated with suspicion.'" -

The promo prompted a threatening cease-and-desist letter from Apple's lawyers, which Valleywag deemed the most concrete evidence yet that there may indeed be a tablet in the works. But is the Scavenger Hunt really illegal, as the attorney claimed? The jury's still out, but Slate concludes Apple's got a pretty good case, although it notes that Valleywag's unconventional Scavenger Hunt 'stunt' may not really be all that different from 'reporting' practiced by mainstream publications like the WSJ." -

Jaron Lanier Rants Against the World of Web 2.0

'It's early in the twenty-first century, and that means that these words will mostly be read by nonpersons,' it begins. The words will be 'minced into anatomized search engine keywords,' then 'copied millions of times by some algorithm somewhere designed to send an advertisement,' and then, in a final insult, 'scanned, rehashed, and misrepresented by crowds of quick and sloppy readers.' Why Do So Many Terrorists Have Engineering Degrees

Program To Detect Smuggled Nuclear Bombs Stalls
Pickens writes "The NY Times reports that a program to detect plutonium or uranium in shipping containers has stalled because the United States has run out of helium 3, a crucial raw material needed to build the 1,300 to 1,400 machines to be deployed in ports around the world to thwart terrorists who might try to deliver a nuclear bomb to a big city by stashing it in one of the millions of containers that enter the United States every year. Helium 3 is an unusual form of the element that is formed when tritium, an ingredient of hydrogen bombs, decays — but the government mostly stopped making tritium in 1989 after accumulating a substantial stockpile of Helium 3 as a byproduct of maintaining nuclear weapons. 'I have not heard any explanation of why this was not entirely foreseeable,' says Representative Brad Miller, chairman of a House subcommittee that is investigating the problem. Helium 3 is not hazardous or even chemically reactive, and it is not the only material that can be used for neutron detection. The Homeland Security Department has older equipment that can look for radioactivity, but it does not differentiate well between bomb fuel and innocuous materials that naturally emit radiation like cat litter, ceramic tiles and bananas — and sounds false alarms more often. In a letter to President Obama, Miller called the shortage 'a national crisis' and said the price had jumped to $2,000 a liter from $100 in the last few years. With continuing concern that Al Qaida or other terrorists will try to smuggle a nuclear weapon into the United States, Congress has mandated that, by 2012, all containers bound for the US be inspected overseas." -

Frequent Slashdot contributor Bennett Haselton changes things up today by reviewing The Big Questions: Tackling the Problems of Philosophy with Ideas from Mathematics, Economics and Physics. The Big Questions: Tackling the Problems of Philosophy with Ideas from Mathematics, Economics and Physics author Steven E. Landsburg pages 288 pages publisher Free Press rating 8/10 reviewer Bennett Haselton ISBN 978-1439148211 summary Steven Landsburg uses concepts from mathematics, economics, and physics to address the big questions in philosophy The first thing that I have to admit as a reviewer is that I enjoyed the book -- not just reading it, but scribbling out pages of scratch paper working on the puzzles inspired by the book -- that I probably would have paid up to about $200 for it (despite the fact that I disagreed with many of the conclusions, and even thought some of the arguments were pretty weak). I certainly don't mean that it's better than books by Richard Dawkins, Daniel Dennett, Steven Pinker, Malcolm Gladwell, or Steven Levitt and Steven Dubner (the Freakonomics and SuperFreakonomics team), but it will appeal to many of the same people.
Those authors' books typically marshall a large amount of research data and evidence in support of a thesis that seems contrarian but turns out to be probably true. The Big Questions (released November 3rd with a companion website and blog doesn't do that. The book is divided into many self-contained vignettes and side topics and independent arguments, which are based more on logic and reasoning than externally gathered evidence, and the arguments don't always convince you of the conclusions. But that's part of the fun: many of the arguments in the book are structured so rigorously, almost like mathematical proofs, that if you disagree the conclusion, the challenge is to figure out why you think the conclusion is wrong. (Nobody ever scribbled equations in the margins of Malcolm Gladwell's books trying to figure out if he was "right".)
You'll probably enjoy the book the most if the following are true for you:- You enjoyed math all the way through high school, especially the paradoxes that seemed to grow out of elementary rules of logic or probability. Sometimes the paradoxes resulted from a flaw in one of the reasoning steps, so that identifying the flaw led to a deeper understanding of how to conduct those steps. And sometimes there really is no flaw in the reasoning, so that the conclusion, no matter how counterintuitive, must be true.
- Eventually, though, you ran out of "paradoxes" that could be described in the language of intermediate mathematics. There are other paradoxes lurking in mathematics, of course (like the celebrated Banach-Tarski paradox), but most of them require you to learn so much mathematics just to understand the paradox, that there aren't enough hours in the day.
- So, you'd be delighted to discover paradoxes in an entirely new field, where arguments built from elementary rules of logic, lead to a conclusion that seems at first to make no sense, but leads to a deeper understanding the more you think about it.
The core philosophy of The Big Questions -- not embodying any of the conclusions, but rather the rules of the game by which those conclusions should be reached -- is expressed in two lines near the end:
If you're objecting to a logical argument, try asking yourself exactly which line in that argument you're objecting to. If you can't identify the locus of your disagreement, you're probably just blathering.
(This quote makes Landsburg sound grumpier than he is; at this point in the book, he's just coming off of describing an exhausting round of e-mail argument with another professor who he felt was not playing by these rules.) I've believed this passionately for a long time, and to me it seems trivially true anyway: If an argument is organized into a series of steps, and you disagree with the conclusion, then some step in the argument must be the first step you disagree with, and if the author feels like each step in their argument follows by airtight logic from the previous step, then that's the point at which one of the two players is wrong. There's nothing more exasperating to me than writing what I think is a well-reasoned logical argument, sending it to the intended audience, and getting back a reply which makes it obvious that the recipient simply read my conclusion, disagreed with it, cleared their throat, and started typing out paragraphs describing their own view. Which they're entitled to, but they missed the point -- I was hoping that if they disagreed with my argument, they could pinpoint exactly what part they disagreed with. (If they had replied with their own argument structured like a sequence of logical steps, then that would at least be a tit-for-tat exchange, but that rarely happens -- people who believe in forming their arguments like rigorous proofs, usually also like to find the error in logical arguments that lead to the opposite conclusion.)
To give you some of the flavor: One chapter in The Big Questions contains an elegant argument against protectionist tariffs: Suppose that an American sells cameras for $80 but a foreigner wants to sell cameras in America for $60 apiece. An American who would have bought the $80 camera will now buy the $60 camera and hence is better off by $20. The seller now has to sell their own cameras for $60 to stay competitive, so they are worse off by at most $20 -- however, if they voluntarily switch to some other business, then they'll be better off than they were when they were selling cameras for $60, and therefore worse off by some amount less than $20 from their original position. So on balance, abolishing protectionist tariffs would be good for Americans. "Therefore," writes Landsburg, "it seems to me that the protectionist's position is even less respectable than the creationist's. If you're convinced that most scientists are liars -- that everything they say about fossils, for example, is false -- then you can be a logically consistent creationist. But you can't be a logically consistent protectionist."
But the best part of reading an argument like that is to try and come up with a counter-argument that is equally rigorous. I think Landsburg is right, but only insofar as it applies to benefits to Americans. That leaves out another part of the equation: whether the production of cheaper foreign goods is harmful to foreigners providing the cheap labor. The textbook answer from economic theory is that the factory jobs must make workers better off (or at least no worse off) than they were before, otherwise they wouldn't have taken the jobs voluntarily. On the other hand, conditions in overseas sweatshops are so notoriously dangerous and unpleasant that it seems hard to believe the opportunities leave workers better off on balance. So you could be a logically consistent protectionist if you believe that: (a) sweatshop workers systematically underestimate how much the factory jobs are harming them; and (b) the harm done to the workers outweighs the benefits of lower prices for Americans. I'm not sure if these statements are true, but they are logically consistent. Still, Landsburg's argument is about as concise as possible and seems to refute any argument that protectionism makes
Americans better off on average.
In another chapter, Landsburg discusses the recent atheist bestsellers such as Richard Dawkins's The God Delusion and suggests that these books are really directed against a non-existent enemy, because the evidence is quite strong that most adults do not really believe the tenets of any major religion anyway. There is the argument that "interfaith dialog" makes no sense if you really believe (as many major religions teach) that your own religion's tenets are settled beyond discussion. There is the argument that since economic theory consistently shows that people respond to threat of punishment, virtually no one behaves as if they actually believe in everlasting damnation after death as punishment for sin. And the fact that the voluntary martyrdom of suicide bombers is vastly more rare than most people believe, and a disproportionate number of those are children (as Landsburg says, "I do not deny that many children believe in God, just as I do not deny that many children believe in Santa Claus"). I'd wondered before about how many people really did believe in God, but in just a few pages this argument had me thinking that the number was a lot lower than I'd ever thought before.
On the other hand, there were some arguments that I didn't spend much time puzzling over at all. Landsburg summarizes the paradox of "free will", and his dismissal of the paradox, basically as follows: The interactions of atoms that make up our brains and our environments, are deterministic processes, so if you know the state of a system at a given point in time, you could predict the state at any future point in time if you had enough computational power (with a caveat about the randomness possibly introduced by quantum physics). "Where, then, is there room for free will?... Easy: There is room for free will on Tuesday, Wednesday, Thursday and Friday, as the human being in question engages in deliberations that ultimately cause his actions." He says that just as "weather" is shorthand for the aggregate of the interactions of trillions of water molecules, "free will" is the same kind of shorthand:"What caused your decision to get drunk and watch Mystery Science Theater the night before your philosophy final? Free will. An insane person might object that free will can't be it at all, because free will is just a shorthand term for an indescribably complex process involving trillions of neurons, which in turn can be described in terms of quadrillions of atoms and quintillions of subatomic particles. So what? You still have free will, and you know it."
I wrote Landsburg to object that this misses what people really mean by "free will" -- it's not just a shorthand term for the aggregate of particle interactions that make up human choices. It means, very specifically, that you could possibly have done something other than what you did. Landsburg replied to this objection by e-mail: "I dispute that there is any way to make sense of a phrase like 'could possibly have done something else'. I know what it means to say you did something; spacetime consists of all the things that get done; it is what it is." And I agree; it's hard to pin down what the statement means. But it underlies all of our instincts and intuition about human choices and blame: "You could have called yesterday, but you didn't." "I should have studied harder last night." If determinism is true, then these statements make no sense, and therein lies what I think most people mean then they refer to the paradox of determinism vs. free will. I think the issue deserves more thought than it's given in the book.
This is followed by a passage arguing that the controversy over "ESP" is silly, because of course everyone knows certain things by "extra-sensory perception", if by that you mean "things perceived not through the senses" -- like mathematical truths, which are arrived at through thought and not sensory input. Writes Landsburg: "Some of those phenomena have one additional characteristic: They are physically impossible. But if you're going to define ESP by its impossibility, then of course there's no point in debating it... And if impossibility is not a criterion, then mathematical insight is as good an example of ESP -- in the everyday sense of the term -- as any instance of clairvoyance or telepathy." Actually, I think the everyday use of the word "ESP" refers to perceiving facts that do not logically have to be true (so mathematical facts are excluded) -- like "Someone is watching me right now" -- without sensory input. And, once you clarify the definition, most people agree there's no evidence for it, so the whole discussion seems uninteresting.
But even if you throw out 75% of the book's arguments (which is far more than I rejected), you should still enjoy puzzling through the remaining 25% and forming your own conclusions. The most interesting argument in the book, to me, is about how to properly answer the question: How much should the government be willing to spend, to save the life of one of it's citizens? Of course if you're Ayn Rand, the answer is zero, but if you want to answer the question according to the laws of economic efficiency, it's a tough one. Landsburg originally got into the debate by writing a column arguing that ventilator support was not the most efficient way to help the poor. (Unfortunately, he couched it in the language of "ventilator insurance", which I think clouded the issue. I think it would have been more clear to say: "If we're going to spend this money to help the poor at all, it would make more sense to spend it on groceries for a far larger number of people, than to spend it on ventilator support for one person.") Another more liberal economist, Robert Frank, responded with a New York Times editorial arguing with Landsburg's methods and coming up with his own reasoning. I think there are problems with the reasoning on both sides (not logical errors, but rather situations in which the rules that they have adopted, lead to paradoxes and untenable positions -- suggesting that both sides' axioms have to be thrown out), but I still don't know the answer. (My own opinion about the flaws in their logic, and an alternative answer, is at this link: "How much should government spend to save a single life?")
The Big Questions also has excursions into areas of science and mathematics that I had never fully understood before, and in some cases hadn't even thought about. Landsburg describes how he had first learned that colors could be arranged continuously into a color wheel, and later learned that they could be arranged continuously along a line according to their wavelengths, and then a friend pointed out the contradiction. Which is it? Do colors vary continuously in two dimensions (forming a wheel) or one (forming a line)? Or, wait a minute, we measure colors according to the strength of their red, green, and blue components, so don't they vary continuously in three dimensions? Well, the answer is in there.
There are also chapters on Heisenberg's uncertainty principle, Gödel's incompleteness theorem, and the quantum phenomenon of "spooky action at a distance", which explain all of the concepts more clearly than I'd ever heard them explained anywhere else. I think that most writers attempting to explain these concepts err either on the side of being too precise -- determined that everything they right be correct, with no regard for whether they reader grasps it or not -- or too vague -- giving the general air of mystery, but not explaining the rules governing how a phenomenon works, and how to work with those rules to derive other conclusions from them. Landsburg's chapter simply begins, "This chapter is full of lies. That's because I'll be explaining the foundations of quantum mechanics, and I assume that if you wanted a careful accounting of every detail, you'd be reading a textbook." The text then gives an example of considering an electron that moves in a conceptual "circle", where at some points on the circle it has a greater probability of manifesting itself in one location if you examine it, and at other points it has a greater probability of manifesting itself in another location. He uses this to dispel a common misconception about the uncertainty principle:You're just idly wondering where the electron is. In most circumstances, quantum mechanics says that it's quite impossible for you to know the answer to that question.
Aha! A fundamental limitation on human knowledge, no? No. Here's why: Most of the time, the electron is nowhere. Asking "Where is the electron?" is akin to asking "What is the electron's favorite movie?". It's a nonsense question. The inability to answer nonsense questions is not a fundamental limitation on knowledge.
How can the electron be nowhere? Because electrons behave nothing at all like anything you're familiar with. Instead of a location, the electron has a quantum state.This clarified something for me that had bugged me for years. I never took a course in quantum physics, but I had indeed always assumed that electrons did have a "location" and the uncertainty principle referred to a limit on our ability to determine that location. Unfortunately there are probably many people who get through an entire course in quantum physics without getting this cleared up.
Balanced against these valuable insights are some libertarian arguments that are probably nothing you haven't heard before, especially if you have read of one of Landsburg's earlier books, Fair Play -- subtitled "What your child can teach you about economics, values, and the meaning of life", although the book was clearly about what he was teaching to his daughter. Many reviewers of Fair Play took note of passages like this one:Most people have instinctive sympathy for the man who says "I tried for months to get a job and nobody would hire me. Only in desperation did I turn to theft." The same people have only scorn for the man who says "I tried for months to get a date and nobody would go out with me. Only in desperation did I turn to rape."
While I think most rape victims would have some choice words about the comparison, I was more unpersuaded because the passage wasn't structured like a true argument. In a good argument -- like Landsburg's earlier argument against protectionist tariffs -- -- you start with premises that seem apparently true, proceed by steps that seem apparently valid, and end with a conclusion that may not have been obvious from the outset. But in this case, the premise is the argument -- either you think rape and theft are comparable, or you don't. I don't think they are, because (a) the harm to a rape victim is out of proportion to the "benefit" to the rapist, and (b) notwithstanding the claims of college males, you won't actually die without sex. (Just as a thought experiment, if you would die without sex, and a man hadn't been able to get any women to sleep with him, and the government didn't provide any sort of sex "safety net", more people probably would feel sympathy for the rapist, if he only did it to save his own life.)
Some passages in The Big Questions are recycled from Fair Play and require a (just) slightly more thoughtful rebuttal. Landsburg argues that most parents, deep down, must not believe in redistributive taxation because"I have never, ever, heard a parent say to a child that it's okay to forcibly take toys away from other children who have more toys than you do. Nor have I ever heard a parent tell a child that if one kid has more toys than the others, then it's okay for those others to form a 'government' and vote to take those toys away."
OK, but... I have also never heard a parent tell their child that it was OK to build a "jail" and put other kids in that "jail" for wrongdoing. And yet almost everyone, even libertarians, supports some form of imprisonment for lawbreakers. The lesson here is that there are some powers that are appropriate to delegate to a democratically elected government, with all the right checks and balances, but that you don't want random vigilantes seizing for themselves. So if you want a principled argument against taxation, it would take more than that.
And other passages in Fair Play deservedly did not make the cut of being imported into The Big Questions:The massacre at Waco took place only days after my daughter (then aged six) had asked me how the government uses our tax dollars. When she walked in on the television coverage of flamed and carnage, I told her that now she was seeing the answer to her question. And when she heard that there were children in there, that they were burning children, her eyes grew wide with horror, and I both hope and believe that she will never forget that moment.
If you want 230 pages of that, then Fair Play is the book for you!
Of the libertarian arguments that did get carried over into The Big Questions, I think the problem with most of them is not that I think the conclusion is wrong, but, again, that the whole argument is the premise, and if you disagree with the premise then there's nothing to think about. For example:Bert wants to hire an office manager and Ernie wants to manage an office. The law allows Ernie to refuse any job for any reason. If he doesn't like Albanians, he doesn't have to work for one. Bert is held to a higher standard: If he lets it be known that no Albanians need apply, he'd better have a damned good lawyer.
These asymmetries grate against the most fundamental requirement of fairness -- that people should be treated equally, in the sense that their rights and responsibilities should not change because of irrelevant external circumstances.But I think the laws do treat all people equally, because they apply equally whether Bert is discriminating in deciding whether to hire Ernie, or whether Ernie is discriminating in deciding whether to hire Bert. The laws don't apply equally to all roles that people play, which is the distinction that Landsburg is highlighting -- but laws never apply equally to different roles, since roles are defined by what we do, and what is the point of laws, except to draw distinctions based on behaviors? So there may be some other argument against anti-discrimination laws, but "symmetry" by itself wouldn't be enough.
A footnote in this chapter of The Big Questions says, "Portions of this chapter are adapted from my earlier book Fair Play." In the margin where I'd been scribbling all of my notes and equations and counterarguments, I wrote, "That's what's wrong with it!"
And yet, as I said, I would probably have paid up to about $200 for the book, based on how much I enjoyed the parts that I did like. At one point Landsburg praises an insight from Daniel Dennett and Douglas Hofstadter and adds, "You should read all their books." Yes, and all of Richard Dawkins's and Malcolm Gladwell's and Steven Pinker's and Dubner's and Levitt's books, for starters. Landsburg himself would probably agree that it's more important to read those books, than this one. But there's time in your life to read The Big Questions as well. It's even structured so you can consume it in bite-sized portions while taking a break from working your way through those other books -- which are, in truth, more valuable, but not as much fun.

A Tale of Two Windows 7s

When it comes to the merits of Windows 7, it looks like Slate's Farhad Manjoo and PC Magazine's John Dvorak are going to have to agree to disagree. Manjoo gives Windows 7 a big thumbs-up (a sincere one, unlike Linus!), calling it a 'crowning achievement,' while Dvorak is less than impressed, saying, 'Win 7 is really just a Vista martini. The operating system may have two olives instead of one this time out, but it's still made with the same cheap Microsoft vodka.' So, for those of you who've had a chance to check things out, are things really different this time?" Multiple readers have also pointed out that there have been problems with the download and installation of Windows 7 upgrades obtained through the student discount offer, which Microsoft has confirmed. -
Data Entry Errors Resulted In Improper Sentences
shrik writes "Slate has a look at the efforts of Emily Owens, in 2005 a Ph.D student in economics at the University of Maryland, who 'came across thousands of inconsistencies and errors in the sentencing recommendations provided to judges' by the Maryland State Commission on Criminal Sentencing Policy. Quoting: 'The sentencing guidelines for judges were based on a work-sheet [PDF] that "graded the severity of a convict's crime and his risk to society", ostensibly to make the rulings meted out more objective in nature. But on carefully studying her data, Owens noticed something wasn't adding up — the system seemed to be producing 1 error in every ten trials. She also realized that this "recommendation system" actually mattered: crimes and criminals analyzed to be quite similar were resulting in systematically different punishments correlated with the work-sheet.' The source of these discrepancies was ultimately found to be a simple, but very significant, PEBKAC: 'More than 90 percent of errors resulted from the person completing the work sheet [usually the DA, but signed off by the defense attorney] entering the figure from a cell next to the correct one. ... The remaining errors came mostly from incorrect choice of criminal statute in calculating the offense score and from a handful of math errors (in operations that were literally as simple as adding two plus two).' Why AT&T Should Dump the iPhone's Unlimited Data Plan
Pickens writes "Farhad Manjoo has a provocative story at Slate asserting that while the iPhone has prompted millions of people to join AT&T, it has also hurt the company's image because all of those customers use their phones too much, and AT&T's network is getting crushed by the demand. The typical smartphone customer consumes about 40 to 80 megabytes of wireless capacity a month, while the typical iPhone customer uses 400 MB a month. As more people sign up, local cell towers get more congested, and your own phone performs worse. He says the problem is that a customer who uses 1 MB a month pays the same amount as someone who uses 1,000 MB, and the solution is tiered pricing. 'Of course, users would cry bloody murder at first,' writes Manjoo. 'I'd call on AT&T to create automatic tiers — everyone would start out on the $10/100 MB plan each month, and your price would go up automatically as your usage passes each 100 MB tier.' He says the key to implementing the policy is transparency, and that the iPhone should have an indicator like the battery bar that changes color as you pass each monthly tier. 'Some iPhone fans will argue that metered pricing would kill the magic of Apple's phone — that sense of liberation one feels at being able to access the Internet from anywhere, at any time. The trouble is, for many of us, AT&T's overcrowded network has already killed that sense, and now our usual dealings with Apple's phone are tinged with annoyance.'" -
The Fresca Rebellion

But it's time to put the brakes on the paternalistic overreaching of the food police, Saletan argues, when they come after his editor's beloved Fresca ('there are concerns that diet beverages may increase calorie consumption by justifying consumption of other caloric foods'), which will have to be pried from his cold, dead hands. '40 states have enacted special taxes on soda or junk food. And the soda taxers are becoming ever bolder. Their latest manifesto is an article in the New England Journal of Medicine, co-authored by the health commissioner of New York City, the surgeon general of Arkansas, and several others. It declares soda fair game for government intervention (PDF) on the grounds that "market failures" in this area are causing "less-than-optimal production and consumption."' Why the Google Android Phone Isn't Taking Off
Hugh Pickens writes "Farhad Manjoo writes in Slate that while the iPhone commands nearly 14 percent of smartphone sales and BlackBerry about 21 percent, Android has only 3 percent. And even though Android is far friendlier to developers, it has failed to attract anywhere near the number of apps now clogging the iPhone. Manjoo writes that Google went wrong by giving handset manufacturers and carriers too much control over the design and marketing of Android phones so there is no idealized 'Google phone' — instead, Android devices get names like the T-Mobile G1 or the myTouch 3G, and each is marketed separately and comes with its own distinct capabilities and shortcomings. 'Outside handset manufacturers lack ambition — -none of them even seems to be trying to match the capabilities of the iPhone, let alone to knock us down with features that far surpass those of Apple's device,' writes Manjoo. 'A smart handset manufacturer could build a top-of-the-line Android device that outshines Apple's phone in at least a few areas — better battery life, a much better Web browser, a brighter or bigger screen, faster or more functional controls... something that might help Android inspire gadget lust. But so far, that's not happening.' John Gruber echoes this advice and adds this advice to Android manufacturers: 'If Apple is BMW, you can be Porsche.'" -
The Biochemistry of Searching the Internet
Slate is running a story about how searching the internet and keeping up with events through instant communication can fulfill biochemical needs within our brains. Research has shown that anticipation and simply "wanting" can stimulate dopamine production in the brain, and an internet full of answers plays right into that. Quoting: "For humans, this desire to search is not just about fulfilling our physical needs. Panksepp says that humans can get just as excited about abstract rewards as tangible ones. He says that when we get thrilled about the world of ideas, about making intellectual connections, about divining meaning, it is the seeking circuits that are firing. ... The dopamine circuits 'promote states of eagerness and directed purpose,' Panksepp writes. It's a state humans love to be in. So good does it feel that we seek out activities, or substances, that keep this system aroused — cocaine and amphetamines, drugs of stimulation, are particularly effective at stirring it." -
F-22 Raptor Cancelled

Firefox 3.5 Reviewed; Draws Praise For HTML5, Speed

Ever since its debut in 2004, the open-source Web browser has won acclaim for its speed, stability, and customizability. It eventually captured nearly a quarter of the market, an astonishing achievement for a project run by a nonprofit foundation. But recently Firefox seemed to go soft.' The Internet Helps Iran Silence Activists
Hugh Pickens writes "Over the last couple of weeks, those who believe in the transformative power of technology to battle an oppressive state have pointed to Iran as a test case. However, as Farhad Manjoo writes on Slate, the real conclusion about news now coming out of Iran is that for regimes bent on survival, electronic dissent is easier to suppress than organizing methods of the past. Using a system installed last year, built in part by Nokia and Siemens, the government routes all digital traffic in the country through a single choke point, using the capabilities of deep packet inspection to monitor every e-mail, tweet, blog post, and possibly even every phone call placed in Iran. 'Compare that with East Germany, in which the Stasi managed to tap, at most, about 100,000 phone lines — a gargantuan task that required 2,000 full-time technicians to monitor the calls,' writes Manjoo. The effects of this control have been seen over the past couple days, with only a few harrowing pictures and videos getting through Iran's closed net. For most citizens, posting videos and even tweeting eyewitness accounts remains fraught with peril, and the same tools that activists use can be used by the government to spread disinformation. The government is also using crowdsourcing by posting pictures of protesters and asking citizens for help in identifying the activists. 'If you think about it, that's no surprise,' writes Manjoo. 'Who said that only the good guys get to use the power of the Web to their advantage?'"
