If Google has purchased enough, they could actually provide priority themselves keeping the telcos from charging whatever they want.

Since the article is very vague, what happens is that once they compromise the IIS server, they modify each site on the server to write a document footer to every page. The document footer calls a DLL placed in the %windir%\system32 directory. The DLL writes a line of JavaScript to each page which redirects the user to a remote server to download the malicious code.
It would be nice if they could distribute some of the processing power to other applications/projects such as Folding at Home to help them out. Better than wasting the cycles or having machines sit idle...

Unfortunately your legal defense probably wouldn't hold up. She's still in a "public" place. Now I haven't read the law but I doubt it matters if there are people present. I'm pretty sure it has to do with "where" the pictures were taken.
Not to mention, you'd have to be able to prove that other people weren't around...
