  1. Loss of 'common carrier' and liability for content on Utah Governor Signs Net-Porn Bill · · Score: 2, Insightful

This does not bode well for the people and ISPs in Utah. Without the 'common carrier' protection, an ISP is liable for any/all content viewed/received by a subscriber. All you need is one pervert to download illegal pron, or one child to download (without authorization) a piece of media and the lawsuits would be be staggering.

  6. Welcome to the era of corporate law-writing... on Verizon-Pushed WiFi Bill Becomes Law in PA · · Score: 1

I don't know what part of this bill bothers me most - that the Gov signed it without a vote from the people (since it affects the public common it should go to a vote), or that this bill aides corporate coffers while blocking public access to information. And those are to say nothing about furthering the digital/economic divides splitting this nation.

While it is generally a good idea for the government to not be in competition with private enterprise, if that private enterprise is not providing a [level of] service for the public then I don't see any problem with the government acting to provide the service.

Considering this bill, was an article produced for this bill that would require [within a specified time] the services that the government was going to provide? Is, for example, Verizon going to provide large area WiFi services covering certain municipalities and allowing free access to those members of the public (on welfare, disability, students, social security, etc) as was the government? I somehow doubt that was written into the bill and that should be a reason for the bill to be dropped.

All in all, a very poor bill that will only serve to improve corporate coffers and futher reduce the public common.

  8. Need to embrace digital media distribution... on TV Piracy is Next · · Score: 2, Insightful

All these entertainment groups need to embrace digital media distribution instead of trying to fight against it. They need to have produced content available in a digital media distribution format within a short time of releasing content to the general public. If an album is released then the high-quality song files should be available for paid download within a short time after. Every book written should be available as a pdf (or somesuch) and downloadable within a year of release of the dead tree version. Every movie released in theaters should have a DVD (without advertising!) following shortly. Every TV series aired should have a DVD (without advertising) released within a year after original airing.

Entertainment groups should be required to embrace and fully utilize digital media distribution, not vilify it.

  10. Reasonable balance... on TiVo Plans More Functionality Reductions · · Score: 2, Interesting

Actually, this sounds quite reasonable. Why would you want to keep PPV/VOD programs stuffing up your TIVO/PVR? A reasonable finite time for PPV should be tolerated as long as a more permanent digital media recording (ie DVD) is made available within the timeline. As for VOD, I don't know why you would/should want to record it anyhow - it's 'on demand' - just order it again should you want to see it.

I don't see how this is any real threat to 'fair use'. You can still record the programs, but you have a limited timeline to watch. If you can't watch within that timeline, maybe you didn't really want to watch.

  12. Editting/censorship implies publishing... on British Telecom Blocks Access to Child Porn Sites · · Score: 1

Good thing this cannot/should-not happen in the US - this would bring a ground swelling of lawsuits against any ISP that tried. If an ISP edited, or censored, any website, or online document, it could be considered that any illegal content found after that point is allowed and/or published by the ISP. If a subscriber to that ISP found some illegal content and the authorities busted the subscriber for downloading/storing said illegal content then the subscribers lawyer could point that the ISP is the party to blame since the ISP is filtering/editing/censoring content and allowed/permitted the illegal content to be available. The lawyer cound argue that the subscriber accidentally accessed the site and did not know about the browser cache, and futhermore since the ISP is filtering content the ISP must be considered a publisher-by-association and be held as accountable as the site operator(s)/proprieter(s)...

Disclaimer : I hate child porn and other illegal content as much as most normal people, but this method is the wrong way of tackling the problem. The sites with illegal content should be shutdown and the site proprieter(s) arrested.

As for taste - mild to lite depending on how well you cook it. You can usually taste the veggies and the meat and pasta usually do their own thing. I usually fix 2 or 3 bags of this stuff and freeze it for quick meals through the week.

Another point I dislike about this law is the punishment clause. One year in jail is seriously excessive. This law would be a prime candidate for 'community control' device. Unless you find a serial violator, there is no reason for jail/prison time. Leave jail/prison to violent/sexual criminal cases.

There have been judgements that have caused mass delusions within the legal profession that corporations have 'rights', but no changes have been made to the constitution to grant same 'rights' to corporations as those of citizens.

Corporations should-not/cannot be given the same rights as citizens. Corporations cannot be held to equal responsibilities as citizens, nor can be punished to equal measurements to citizens. Corporations have much more resources available to utilize the legal and/or government systems to their own purposes. The power of broad- and cable-casters is too strong with these 'flags'. One can easily see that eventually all shows on TV would have a flag enabled to stop recording and/or time-shifting.

Punishing the general driving population by requiring breathalyzer tests is not a good idea. Even if it includes a generous insurance reduction, it would still be a bad idea. A good idea to handle DUI offences is to improve the punishments and get the habitual drunks off the road.

An example: After the third strike he should never get a drivers license in any state, never own/register another motor vehicle in any state, and be sentenced to minimum five years community control (ankle strap, payments & all). No hardship, no pleas, no nonsense.
