There is no practical or legitimate way for those operators were to know of fires springing up in the distance and creeping into the area. There was no TFR in effect for that location at that time and this nothing illegal took place. As soon as the operators were aware of manned aircraft there, they descended and cleared the airspace even though they were taking part in what was supposed to be some kind of flight time record.

You worked as a telemarketer and you still don't know what you are talking about. I don't blame you for the ignorance only your lack of proper training. Having someone say 'take me off your/the/some/a list" does nothing. The entity can purchase a new list with your number and call again. So what you have suggested has no ligit purpose. One needs to specifically state that they want their number (name is unnecessary and not relevent) ADDED to the company's do-not-call list. That specificlaly requires the company to add the number to their scrub list. It is this list against which all future lists are to be compared/scrubbed so that you do not get called again.

From what part of your anatomy did you get that "you get $500" comment? You are not a whistleblower and are not entitled to recovered funds. Had you been trained properly (or completed your own research) you would know that $500 is not automatic, nor is it some limit. The Telephone Consumer Protection Act of 1991 provides a private right of action (PROA) (i.e. you have the right to sue the offending entities) thorugh which you are entitled by statute $500 per violation of the law (and there can be many violations in a single call). That amount is set by law and cannot be reduced, however the court in its discredtion can treble (that means triple), the damages if you can shoe the offendind entity violated the law willfully or knowingly.

The law has a lot of nuiances, so you just have to do a little research. Google '47 USC 227' or 'CFR 64.1200' and learn more. In short each of these things are violations of the law:

    * prerecorded commercial call initiated to a residence with an EBR (established business relationship)
    * call initated to a device through which the user has to pay (e.g. cell phone)
    * falure to send the person a copy of the company's policy regarding the maintenace of their DNC list
    * failure in trianing person placing the call in existance and use of company DNC list
    * failure to have a company do-not-cal list
    * failure to properly identify the entity eithe rplacing the call or on who's behalf a call is made
    * making two or more violating live calls in a 12 month period (yes, this means that a company has to live call you at least twice after a DNC request in order for you to have a PROA

That is just a short list, but there are plenty more requirements. The fact is very few people are aware of their rights. I have had only 3 cases in court and have won or settled each one and have settled a couple of more without having to file. So believe me, my knowledge is a good deal more extensive than your own in this area. Once I graduated school and got a real job (the telemarketing research and suits were used as a learning experience) I didn't have time to push any more, but around the holidays I get a lull and may pick it up again for kicks and giggles.

I shouldn't have an effect for you. The DNC list is for *residential* numbers. You are not suppose to place a business number on the National DNC list. If you don't want such calls, change your number to something that is unlisted, but then that would defeat the pupose of a business line.

You also seem to consider the inverse. What if you call another business that, unknowing to you, placed their number on the Nat DNC list? Would you want to be fined or chastised when you had a reasonable expectation that a business line is for, well ... conducting business?

Be careful of calls that you make to a resident. If you call a residential number on the list (you have purchased a list of numbers as you are required to do.. have you not?), then you can be in violation of federal law. If you make *any* calls as a business to anyone other than other businesses (meaning any residents at all) then you better be aware of the Telephone Consumer Protection Act of 1991 [47 USC 227]. If you do not maintain a company do-not-call list on your own as well as have a policy regarding the maintenance of that DNC list, then *you* are8 in violation of the law. So don't go whining until you are sure that you are following the law as already required.

In my case, this is certainly true. My number was listed on my personal, non-commercial website [floridacaves.com] whois registration information. They called the number to advertise their services. Unfortunately for them, it was a personal cellular number and it has been illegal for more than a decade to place telemarketing calls to such a number.

I sued them last year under the Telephone Consumer Protection Act of 1991 [47 USC 227] and won a $5,149 small claims court judgment against them (for making a commercial prerecorded call to a cellular number, for failing to send me a copy of their do-not-call policy, for failing to train their staff in proper use of the do-not-call policy, and for willfully or knowingly violating the law).

I just hadn't gotten around to collecting as I thought they might have gone out of business or hidden assets, however, if they want to use their name again on public records, then they are still in business and collectable. I'll have to file to domesticate my judgment in Nevada, but that should not be too hard. Once cannot let a company like this get away with strong-arming people when they do it themselves, in my personal opinion (gained from my own experience with them).

Just because my number was listed in my website registration, it does not grant them prior EXPRESS permission that is *required* before that may place commercial calls to a cellular number.

The TCPA gives you specific private right of action to go against the companies that violate the law. Do your own research at http://www.tcpalaw.com/

  19. Re:Great! on Breathe Under Water Without Oxygen Tanks · · Score: 2, Interesting

Weight can indeed be an issue. For one thing, the term 'oxygen tank' is extremely misleading. Except for trained technical divers, SCUBA divers do not use pure oxygen underwater (yet most newspapers stupidly say the diver 'ran out of oxygen' if they refer to a fatality).

Humans will not float with steel tanks attached without some method of buoyancy compensation. Aluminum tanks are ~3 pounds negative when full and are ~3 pounds positive when empty (77.4 ft^3 [the amount of gas in an Al80 at 3000psi] weighs approx 6 pounds). A steel tank is typically negatively buoyant, even when empty. Divers need to carry weight/ballast so they can remain at their decompression/safety stop depth, even with a near empty tank, and to compensate for the positive buoyancy of exposure protection (e.g. neoprene wetsuit).

I don't think "plastic air tanks" are available. What you are most likely considering is the carbon fiber tanks that firefighters use. They need something lightweight since they are always carrying them above water. They would not be useful for underwater use since the diver would have to carry a lot of weight to overcome the positive buoyancy aspects of the tank on top of the ballast for theit exposure suits and natural buoyancy characteristics.

Oxygen is used to accelerate decompression after deep or long exposure dives. Oxygen is not taken below a depth of 20 feet (1.6 atmospheres) due to the effects of exposure. It can be managed, but just takes experience, training, and very good depth control. On deep dives, I'll normally have a scooter, 2-3 other bottles beside my backgas tanks, and will be drifting 3-60 miles away from shore without anything onto which one can hold onto for support while maintaining the exact same depth for 20-30+ minutes.

Compressed air does indeed have moisture filtered in order to avoid oxidation in the tanks. Most shops use partial pressure blending techniques to mix the Nitrox blend. Normally AVO (Aviator's oxygen) is used (instead of medical oxygen) since it is easier to obtain [some places claim some BS about needing a prescription], and because it has been ultrafiltered for moisture so it would not freeze the plumbing in planes at altitude. /technical diver //SCUBA instructor

  21. Re:Oxygen tanks on Breathe Under Water Without Oxygen Tanks · · Score: 1

You would certainly not blackout using oxygen at 20 feet. This is the normal depth where technical divers switch from the bottome mix (or some other decompression mix) to oxygen. At 20 feet, oxygen is at a partialo pressure of 1.6 {[(depth/33) + 1] * FO2} where FO2 is the fraction of oxygen in the gas (in our case 100%).

In a nutshell, the buildup of too much oxygen can casue temporary neurological issues that can lead to convulsions (consider it like your computer locking up and automatically rebooting itself). This isn't deadly in itself, however being underwater with a regulator in your mouth can lead to drowning when you drop it while blacked out.

A certain cave diving team regularly decompresses on 100% oxygen at 30 fet, however they are in a dry area and can afford the risk, however they take breaks on a regular basis, by breathing a low FO2 gas, to reduce the amount of 'oxygen loading'.
