    Can you buy these things without the subscription?My point is that we have VCR's that don't need a subscription. I know how to program a VCR. I don't need a subscription that lets me choose "The Simpsons" and then does the work for me. I think I can figure out when the simpsons is on. I can press a record button also. Without a subscription service people would be able to just record whatever they wanted and then the companies wouldn't be able to track the viewing habits to sell to large media conglomerates. Does anybody make a PVR that you program yourself(like an old fashioned VCR)? without any subscription or big brother intervention?(besides your PC, of course. I'm talking about a set-top box.)

    If the EULAs were standardized and readable, normal aol-using folks would be able to understand what is really getting installed. Remember when they did that with food labels(in the US). Now all food labels look the same ie. "Nutrition Facts". It's clear and easy for everybody to read. For instance I found this at nutri-facts.com

    • Declaration of total percentage of juice in juice drinks. This enables consumers to know exactly how much juice is in a product.


    Somebody should take that list and create the End User License Agreement Act, in which they list what MUST be clear and concise in the EULA. Until somebody passes a law requiring standardization, rogue software makers will continue to use the EULA to hide revelations of spyware.

    I was unaware that it wasn't it's own software product. I am aware of several programs available that allow you to copy and convert movies to VCD, many of which are free or cheap. I noticed that on their site they don't allow you to download their software, and the trial version of the "software" is being developed. Now I see why you can't download it, becuase it's somebody elses software that you download from somewhere else. That's just like those folks on ebay that sell those "Buy Wholesale!" just $2.99, and all you get is a link or an email. I heard a story of a guy who bought one of those "Learn to Make Millions on the Internet" books. Turns out all it was was an email which said "Sell this message on the internet for $3". That stuff can't be legal.

    Let's not forget that EVERY SINGLE porn site in existence uses a third party for billing. That is why the name on your credit card statement is always something like "California Billing". This means no more mastercard for porn sites at all. That will kill 50% of thier business. Porn sites probably make up the largest percent of online sales, so this doesn't bode well for e-commerce in general.

    ALthough the article says that they dont' any problems with people accusing entrapment, it would be entrapment if they left a brand new car, with a shiny new cd player, with the door WIDE open and the keys in it. Okay, that might be entrapment. They said that they put garbage and such in the car to make it look as normal as possible

    That sounds nice and all but they fail to describe the great benefits. If they did it would sound something like:
    It will crash all the time.
    It will be insecure and probably allow outsiders access to your network.
    You will need to upgrade every X amount of years, just because we say so.
    You will need to download patches every week, or else deal with viruses and trojans.

    Why don't these people do their homework before introducing something so completely stupid, which so obviously violates the first amendment, with no real chance of passing? Yeah, like ICANN is gonna create .prn just because some idiot doesn't want to take the time to monitor what their kids are doing on the internet.

    Is it like a PR thing? "I tried to introduce a bill to protect kids, so that means I'm all about family values, so please donate to my campaign, and/or vote for me, all the while ignoring my obvious stupidity."

    As for the other part, you should be able to videotape whatever you damn well want in your own home. Hey, if some chick comes over my house and wants to take a shower, she'll just have to take the chance that it might show up on myprivateshowervideo.prn.

    Everyone keeps posting saying that any kid will recognize that it's a bot and not a real kid. But the fact is that most parents are letting their very young children chat unattended, and when I say young I mean like 7,8,9. Do you think they sit there and say "I think this is a bot, designed to market to todays youth population, by using clever AI technology." How many 7 year olds do you know who would say that? Most kids have no idea that it is even possible. Children are very short-sighted so they think the other people chatting must be just like them. It's human nature.

    In the past, artists needed the promotion power of major labels in order to make money peforming live and/touring. Now, with the internet, any kid in his garage can set up a website for his band, record his band directly to mp3 to his computer and distribute it. There are plenty of music websites to review the material and spread the word about a great band. Then with the demand grows, the band can tour and make money *on their own*. Most people know that artists never made much money on CD sales anyway. I know it's true because my band is doing it right now. We recorded an album with our own cash and have sold several hundred copies via the internet(despite the fact that our MP3s are freely available). That has created the demand and now we tour the southeast US regularly. It's not great money but it's enough and it's fun. Another good example is the band Dredg. Their indie album sold thousands of copies on the internet(MP3s also freely available). They have a real cool indie alt-rock sound, comparitive to Radiohead(for lack of a better comparison)but they are in no way a radio band. The record labels don't like that a band can make it on their own these days, and many bands are making it on their own. I love it. Sure I don't buy major label CDs anymore. It's because the artists suck. I buy plenty of independent artist CD's, and I spend lots of money going to see these local bands. It's the way it's going to work from now on.
    If you wanted to buy a painting, would you want it straight from Picasso's hands, or would you rather have Picasso paint it, give it to a producer who messes it all up, and packages it, and then sells it to you for a huge markup? Duh! Get it straight from the artist.

    I once saw the Dixie Chicks on TV and those girls said just that. That their albums are nothing more than promotional materials to promote their live show. Now, I'm no country fan, but they really know how to put on a show, and they're hot.

    Although I agree with your post, I think it's not that Microsoft software is really finished, but it's that Joe Consumer thinks it is. When Joe Consumer boots his Windows 98, and loads up Office 97, he's as happy as a clam, and he doesn't necessarily long for (or understand) the new features in XP. So, he doesn't buy another piece of MS software. Last year I was doing ISP tech support and something like 30% of customers still use Windows 95. "If Windows doesn't look any different then how is it better?" is the state of mind(hence the new XP gui). Meanwhile the same guy is paying AOL $25 a month for the rest of his life. That is why I agree that MS needs a subscription based service to succeed from here on out.

    IANAL but how do you prove in court that receiving a 5 kilobyte email message costs your company $50? Is 5 kB of bandwidth really worth $50?
    Don't get me wrong, I wish that was money going into my pocket. Frankly, I'm starting to worry because I keep getting these porn spams from Russia and the girls keep getting younger and younger. I can't delete them fast enough.

    On the main page of his site he has the Gomez certification logo at the bottom. This in fact is misrepresentation since Gomez certifications have all expired according to Gomez.com.
    Here is the quote.

    How is this guy qualified to write any tech article if he is bewildered by a PC interface?br>It sounds to me like this guy is lost on anything more complicated than an etch-a-sketch.
    He also says "All in all, my advice is to stay away from the Zaurus SL-5500, unless you're a hard-core Linux fan."
    Well, means it will be perfect for all of us!

    IANAL but i am a few credits away from a degree in Psychology. There is one main reason why Sony will prevail. "A psychologist diagnosed him with depression and schizoid personality disorder", this means they already knew that this person was a threat to himself and should have been receiving treatment. His mother might as well have handed him a loaded gun to play with, he would have killed himself anyway (his mother would have then tried to sue Smith & Wesson). His mother is completely to blame, and she knows it. At some point she made the decision not to force him into a hospital. A good analogy would be like a blind man going for a drive, and when he drives off a cliff, his family sues Ford, demanding they put warning stickers that say "Do not drive if you are blind". Frivolous lawsuits like this probably happen everyday, we just don't hear about them.
