Except if it's inspected and passed, the contractor and inspector can probably be held liable as well.

I highly doubt it. Especially since we don't know why it happened or even whether or not 'unlicensed' even had any bearing on it. E.g. if someone backed into it with a truck, the whole thing would be irrelevant.

As in "the person with the truck would have to pay for the damages", or were you going someplace else with that?

  2. Re:When a pool fails... on Officials Use Google Earth To Find Unlicensed Pools · · Score: 1

But all that is irrelevant to the person whose property is damaged.

The proper reason for a lawsuit is to recover actual damages, not treat every accident like a lottery ticket.

I agree with you on both points. Still, as the person paying the damages, you'd want to be able to pass on those expenses to the contractor if they did shoddy work or have insurance pay for as much as you gotten coverage of. And while the people might not be looking to sue you into oblivion, if they can't afford a lawyer straight out, they'll probably hire one that'll take a cut of whatever you pay out. That lawyer will certainly make sure the case is worth their time. Even if they're nice about it, the final cost will be much more just the damages when you factor in your lawyer fees, theirs and even a fair amount for damages.

Or maybe you wouldn't get "serves you right" looks from people when you find out you hired somebody not known for quality work (or a fly-by-night operation). How does one prove a contractor provided sub-standard work using substandard materials for something that's not supposed to exist? Would an insurance company pay for damages caused by an illegal pool mishap, be it a drowning or damages? If your neighbor sues because you flooded their home with run-off, don't you think their lawyer is going to pounce on the pool's legality to maximize what you pay them? Hell, what if you were to buy a place with an illegal pool and didn't know it? Then you're stuck with the problems and increased and unmitigated risks with it.

You realize that every country in the history of humanity has done the exact same things, right?

    Not Tibet.

Tibet was a bunch of separate entities way back in the day. If and when it gets free of the Chinese government, do they get to redivide into those smaller countries? Obviously Songtsän Gampo, the guy who founded the Tibetan EMPIRE, wasn't a true Tibetan. He was just some random, outside oppressor engaged in acts of aggression against his neighbors. The earth was made and Tibet was there immediately with monks and quaint makers of handcrafted goodies for celebrity photo op types to pose with. Damn him for messing with that.

I make it a point to avoid any forum identity that could be easliy traced back to my real name, because stuff comes back to haunt you. Do you really want somehting you said 20 years ago in some gaming forum to come up in a job interview?

In that case, either: 1) Don't be a jack-ass on the Blizzard forums. 2) Don't use the Blizzard forums.

That said, I've given my screen name which I've used for the last decade as part of a background check for an interview, so I'm well aware of the issue. However, nothing I said in the past (I've said a lot of stupid stuff) was an issue. If it is a concern to you, don't use the forums (it's an optional part of an optional game you play, you can deal with it), or simply police your behavior before it is recorded for all posterity on the Intertubes.

It'd be safer to do the second option. While your first suggestion is good, times change. What's fine now may not be 20 something years down the road (or even next week). Today's upright, model citizen can be dragged through the mud later on without any misspeaks if future interpretations or values change enough.

Sort of, yeah. GS has had all that press about conflict of interest investing, but I can guarantee they still have new customers coming in at all levels. Googling information about a company's track record, transparency of fees and BBB/trade-publication reviews can help too. I'm sure there are other /. better able to teach how a consumer (individual or larger) can try weeding out crappy companies for given needs.

The best example I can think of for /. would be Carley Fiorina and her history with HP. I'd be surprised if anybody though McCain picking her to help out with his campaign was a good move when both parties were chanting various "Main street over Wall street" slogans.
