  4. Microsoft, DRM & the Music Industry on Microsoft's Music Subscription Service · · Score: 1

Considering the absurd track-record Microsoft has in locking down its own software (copy-control and security), anyone who entrusts their IP to Microsoft's care is 1. an litigious lawyer, 2. someone who deserves to get ripped off, or 3. some 60 yr-old music industry dunce. Take yer pick. Whenever it opens for business, I'm thinking hacked in under a month.

  5. Signing with a Label: Necessary Evil? on Online Business Model for a Band? · · Score: 1
I have a fair amount of experience dealing with both musicians and labels. My gf actually runs her own label and while most of the revenues are from back catalog, they do sign a few new artists a year. She has a law degree so naturally she handles a lot of the contractual aspects of the business not the A&R.

She has recently designed a new royalty structure for her newest artist. Generally speaking, the label recoups its support costs before the band sees a dime. This is still true in the new system. The difference comes in the way net profits are paid out. Its a more equitable split than it used to be.

With that said, I think there are two truisms that persist in the music industry. 1. You make money as an artist by playing live shows, and 2. Signing with a label allows you to leverage the economies of scale.

There's simply no way a single band can afford to advertise effectively. The labels actually split a lot of advertising costs with their distributors (one of the dirty little secrets), so for every dollar the label spends on advertising, it's actually leveraged to $2 spent in the market. A band on its on can't reap this kind of benefit.

The trick in the end for the artists is that

    1. You need to protect whatever money you make when you play live shows,

    2. This is part of the larger contract issue... don't sign a contract you don't fully understand (duh),

    3. You'll find that the more progressive indie labels are proactively addressing the issue of equitable distribution, and

    4. You need to get yourself out there and DO it.

I actually went to Kiev in 2001 to start an outsourcing company. It was a FASCINATING if not profitable experience. Kiev is somewhat cosmopolitan for an Eastern European city though not Paris. We started a joint venture with a CompSci department at the University of Kiev. The first class of recruits would probably have gotten a B as a group with a couple of A students and a bunch of Bs and a couple of Cs. The educational system for tech there is very rigorous. These guys were ready to go in C++ but we had them all take certs in Java to have things covered. Sadly, we were underfunded and when the bubble burst, trying to sell a software service contract for a startup in Kiev to someone in the US was nigh impossible. One year and the team took their terminals as severance. Helluva learning experience.

I recognize that you'd still need the Apple OpenFirmware to install OS X, but at least we'd be one step closer.

I'll bet that given the consolidation we've seen in the PDA market and the "lack" of support in Garnet (PalmOS 6) for the Mac platform (yeah yeah Missing Sync yada yada yada), Ol' Stevie is kicking himself for sending these guys out-of-house.

  14. Price vs. Capabilities on OQO Price And Release Date Set · · Score: 1

Of course everyone wants it all for cheaper, but there are a few things to consider here.

    1. This is supposed to replace a laptop and a pda for an executive. This is not a primary machine for someone who is coding or gaming. Email, Word, Excel, Web browsing, etc. These are the target apps, so the specs speak to that.

    2. This is a new class of device. The price point is obviously high relative to PDAs because it's NOT a PDA.

    3. This is Rev. A hardware. It's been two YEARS in the making. How long before they rev the hardware and discount these Rev A models? (Bigger HD, 11g instead of 11b, 512MB instead of 256, etc.)

    4. Gimme this form factor with a 1ghz G3 running OS X and I'm a buyer. Windows does nothing for me and the last app I would ever run on a Winbox is Outlook, but I guess to each their own. Linux is an option, but doesn't the touchscreen need drivers?

LAST - This isn't news. But that guy from Handtops.com (the only two links in the summary are to Handtops.com) is a shameless huckster. I liked the site until he started shamelessly promoting it without any real news.

  16. Ebay Vigilantes on What Do You Think of Online Vigilantes? · · Score: 3, Informative

Ebay has a problem with fraud. Especially in electronics/computer auctions. They do, in fairness to them, attempt to monitor and control fraudulent auctions, but clearly they are losing the battle. There has been an individual lately trying to sell the new Motorola V710 on eBay. (It's is as yet unreleased.) A number of people have determined that beyond using the regular channels, such as registering a complaint with eBay, they (or one person in particular) need to take more aggresive action and have managed to "guess" the password to the AOL account that the auctioner is requesting correspondance to. He made it clear a couple of times that he "guessed" the password, but didn't "hack" the account. Despite what I may think about auction scammers, taking the law into your own hands is foolish. You are opening yourself to civil and possibly criminal liability. Is it worth it? Doubtful. In today's paranoid security landscape, regardless of your intent, you could easily wind up being the scapegoat. Last I checked, any attempt to access a service which you are not licensed to use is a crime. ie, You can "scan" whatever you want, but as soon as you connect... BLAMO! Off to the slammer you go!!! A word to the wise.
