I have never heard of this. Can you give me an example of a case where a recognised shooters organisation in Australia has quoted the United States constitution as its legal defense to own a firearm?
I am not sure about the laws in the USA, and IANAL, but my understanding in Australian law is that there must be an exchange of something of value for the contract to be legally binding.
For instance, if you provided them with information in the site that could be considered of any value then the contract could be binding.
However, at least here in Oz, just because someone accepts your terms of service which includes agreeing to sign over their life savings, it will take more than just clicking a link to make that enforceable. You will have to show that they gained something of value from the agreement (it may be a few cents value, but it has to be something).
On this subject, another unmentioned factor that can possibly stem the tide of jobs moving from the USA to India is the falling US dollar.
I would assume that the initial contracts drawn up with the outsourcing companies would have been in US dollars and probably wont change for a while. However, when the contract comes up for renewal, if the US dollar keeps falling, the Indian companies will be forced to increase their prices to compensate for the exchange rate. As they increase prices, American labour becomes more affordable, and the circle is complete.

A BIG reason PHBs dont use GNU/Linux / FOSS is because misinformed geeks keep spreading the nonsense that if you use open source / free software then you have to make publicly available the source code to your applications.
This is NOT true.
You do not have to unless you are going to make modifications and then sell / distribute the modified code. If it is an in-house application and never gets distributed, there is no requirement AT ALL to release the source code back into the community.
PHBs would be far more comfortable using F/OSS if they didnt have geeks telling them how good it is that the company will become part of the F/OSS movement, and instead were told about the virtues of using F/OSS.
First, determine exactly what you want to do. What do you like doing? Programming? Helping friends fix their boxes? Graphic design / flash?
Then, start doing things just for fun. Put together some strange network at home. Volounteer for an OSS project. And do heaps of reading.
Then, its a matter of just keeping on trying. As you have another profession, keep doing that until an opportunity presents itself. When it does, take it, even if its short term. Once the contract runs out, revert back to what you were doing until another opportunity opens.
University degrees really dont matter unless you want to get into research. In the current climate its more about planning, adaptability and determination...and the BIG one...how well you can market yourself and your skills. A lot of people will tell you that its impossible to find a job in IT atm...total BS. Ive just moved back in after a couple of years moving in and out of the industry. Its all about attitude.
Free trade is about money, NOT people. Can you honestly go up to someone and hold a straight face saying companies outsource to India because they want to help the poor in this world? Or because Indians are better programmers?
The reason is it saves money. The PHBs get a nice fat bonus for cutting costs. If the quality of the final product is no good, they just blame it on the contractors.
Look on the bright side, eventually management consultants will start getting outsourced. Then theyll get to taste their own medicine.

Sorry to say, I get a 4 wheel drive (or SUV as you Americans like to call them) for a number of reasons, none of which I have to justify to anyone else.
SUV's are no good in snow blah blah blah. Hey, maybe theres more surfaces in this world than just snow. Ive lost count of the number of "normal" cars that either we have pulled out or seen someone else pulling out of the sand with our off-road vehicles. Same with mud.
Go out, get a life, and spend your time complaining about things that may make the world a better place.
And then the Apple and Sun developers can get their hands on the next book in the series - Linux: The Missing Desktop to learn what REAL usability is all about.

Agreed with all of the above, but my opinion is the reason 1 and 2 sucked was the lack of muppets. Sorry, but the computer generated effects just do not do it the same. Which looks more believable? Yoda the muppet talking and walking slowly, or yoda the computer generated thing racing around the room like a posessed leprechaun? To me he looked more like he was trying to kill and eat someone.
And the characters are not as good in 1 and 2. Take Jar Jar. CP3O was a bit stupid, but funny stupid. Jar Jar is just idiotic. And again, as he is not a muppet, in a lot of scenes he looks like a cartoon character inserted into the film. Why dont we just have Roger Rabbit and not pretend to be a serious movie?
Come on Mr Lucas, all will be forgiven though if you can just find a painful enough way for Jar Jar to die!
While Lucas is at it destroying the movies, how about Jar Jar turning to the dark side in Ep 4.
We get a scene of Darth Vader telling Jar Jar to lash out with his anger and Jar Jar goes ballistic and runs around killing anything he can get his hands on.
Then, in ROTJ, when we see the Emperor, it is actually Jar Jar wearing a hooded robe, he is the new emperor
