    But seriously, don't most P2P clients have user rankings of files? Maybe they need a better moderating system, like the fine one here on slashdot.

    I was a subscriber since it was called 'Pressplay', and the service was fair to use but it was riddled with DRM related issues. I vowed never to buy anything with DRM again after I was unable to authorize my computer to play a few tracks that I had bought, but Napster no longer sold. I did what I was supposed to and 'backed up' all of my licenses, and restored them after a reformat and reinstall of Windows... No dice, the files that I had purchased reverted to a 'subscription' license and I couldn't burn or put them on my mp3 player. I had to re-download the songs I had purchased to fix the licenses, so the files that they didn't sell anymore... *poof* I would love the see the day when the first of the DRM infected music services goes out of business, and we can all hear the collective cries of the people who's purchases are now gone, because we all know an install of Windows only lasts so long. At that point there is only thing to point your finger at, and I hope heads roll.

    Someone needs to spoof screenshots of RIAA IP addresses sharing copywritten music... That's all the evidence we need, right? Maybe then people will start realizing how weak their cases are.

    Your post is from April 26, which means you were using the beta. Since when did we start expecting beta software not to crash your system? I've had a crash or two with the beta, but the release version has been as solid as a rock.

    I have a Creative Zen Micro, and the touch pad for navigation wore out in about a year with moderate use. I'm betting the average iPod lasts longer than that, but if not, I doubt it something to blame only Apple for.

    I love Pandora but I don't think it's a replacement for radio yet. I find that it is good for exploring music that is similar to other songs you like, but it's not that great if you want diversity and discovering new types of music you like. Once you 'train' your station to what you like and don't like, I find that you start getting a lot of repeats.

    That seems a little much to me. That's almost as much as satellite radio. Better quality but only two channels. If they continue to innovate, like with making the audio available via podcast it might be worth it in the long run, but right now that sounds expensive to me.

    Yes. They bought the software 'Pressplay' and renamed it to 'Napster'.

    Who's the victim in this crime though? Who is profiting from it? Didn't the **AA do this very 'crime' to try to thwart piracy?

    You realize, just because someone can go to extrodinary lengths to simulate a crime, doesn't mean that evidence of that crime is invalid in all cases. That's why we have judges to decide these things.

    Doesn't seem extrodinary to me. I seem to remember a time when the **AA was fighting P2P by making blank videos and/or recordings available on P2P, but with file names that made them look like the real movie/song. What if you had one of those available? Is that still a crime? My point is; it can be done, so how can they prove that this isn't the case?

    How is this possible? Aren't they using the file names to determine infringement? What kind of 'evidence' is that? If I purposely renamed a bunch of legal files to look like copywritten mp3 and make them available on P2P am I liable for damages too?

    on emusic. I buy there whenever possible, to 'protest DRM with my wallet' so to speak. Otherwise I just buy the CD and rip it.

    themselves! And to add value to the consumer, they will (automatically) sign you up for text messages about upcoming events that may be (but probably aren't) of interest to you! Sorry for the cynicism, but I haven't found ticketing agencies to be all that honest (e.g. Fandango signed me up for a subscription to a 3rd party children's website because I clicked on an ad for a few bucks off my purchase. I read the ad and closed it; it wasn't anything I was interested in because I didn't have kids. Unbeknownst to me, Fandango had sent my credit card information to this site and signed me up!)

    The iPod is more mainstream than any other player. It's a shame, but I think this shows that the RIAA's message is the only one that is getting through to most non-techies.

    Exactly. It seems pretty clear that they are after the resellers of pirated copies and not the end users. They are offering a free key to those who unknowingly bought a pirated copy, per their FAQ:

    "The Microsoft genuine Windows offer is designed to help customers who unknowingly purchased counterfeit versions of Windows XP, by offering those who qualify a complimentary copy or electronic license key for a genuine copy of Windows XP."

    And

    "Microsoft will make a complimentary copy of Windows XP available to customers that have been sold counterfeit Windows. Customers will be required to submit a proof of purchase, their counterfeit CD, and complete a counterfeit report with details of their purchase. Only high-quality counterfeit Windows will qualify for the complimentary offer."

    I'm assuming that the high-quality counterfeit requirement is to stop people from burning a CD, making up a story and/or reciept, then getting a free copy.
